NOTIFICATION
Whereas, the Government is of the opinion that an industrial dispute has arisen between the management of M/s. Puducherry Agro Products Food and Civil Supplies Corporation Limited, (PAPSCO), Puducherry and the union workmen represented by PAPSCO Thozhilalar Nala Sangam, affiliated to Puducherry State Government Employees Federation, Mullai Nagar, Puducherry, over payment of bonus @ ` 5,000 to the daily rated employees as per Payment of Bonus Act, 1965 for the year 2016-17 and the demand of the union for payment of productivity linked bonus @ 38% to the d a i l y r a t e d e m p l o y e e s s u b j e c t t o a c e i l i n g o f ` 11,000 on par with regular employees for the year 2016-17, in respect of the matter mentioned in the Annexure to this order;
And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;
against the management of M/s. Puducherry Agro Products Food and Civil Supplies Corporation Limited (PAPSCO), Puducherry, over payment of bonus @ ` 5,000 to the daily rated employees as per Payment of Bonus Act, 1965 for the year 2016-17 is justified or not?
(b) If not justified, whether the demand of the union for payment of productivity linked bonus @ 38% to the daily rated employees subject to a ceiling of ` 11,000 on par with regular employees for the year 2016-17 is justified?
(c) If justified, what relief the union workmen are entitled to?
(d) To compute the relief if any, awarded in terms of money if, it can be so computed?

Now, therefore, by virtue of the authority delegated vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the Labour Department, Puducherry, to exercise the powers conferred by clause (d) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by Secretary to Government (Labour) that the said dispute be referred to the Industrial Tribunal, Puducherry for adjudication. The Industrial Tribunal, Puducherry, shall submit the Award within 3 months from t he d a te o f i ss ue o f r ef er en ce a s s ti p u la t ed u nd er sub-section (2-A) of section 10 of the Industrial Disputes Act, 1947 and in accordance with r ule 1 0 -B o f t h e I n d u s tr ia l D is p u te s ( C en tr al ) Rules, 1957. Suolificio Linea Italia (India) Private Limited, Sedarapet, Puducherry and the union workmen represented by Chemcrown Exports Suolificio Linea Italia Thozhilalargal Sangam, Mudaliarpet, Puducherry over extension of the benefits of 12 (3) settlement, dated 17-04-2019 to 12 employees listed in Annexure-I in respect of the matter mentioned in the Annexure to this order;
And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;
Now, therefore, by virtue of the authority delegated vide G.O.
