P.C., dated 04-08-2009 of Nettapakkam Police Station, Puducherry, (3) Cr.No. 53/ 2011 under sections 34 B IX of PP Act., dated 14-05-2011 of Nettapakkam Police Station, Puducherry, (4) Cr.No. 111/2011 under section 151 @ 107 Cr. P.C., dated 04-09-2011 of Nettapakkam Police Station, Puducherry, (5) Cr.No. 13/2016 under section 302 IPC, dated 15-03-2016 of Nettapakkam Police Station, Puducherry, (6) Cr.No. 66/2017 under section 25(1-a) of Arms Act., P.T. CC. No. 06/2018 and your vengeful acts along with your accomplices against your opponents have created panic in the minds of the people;

And whereas, the Station House Officer, Nettapakkam Police Station, has filed a case against you vide IR.No. 01/2019 under section 144 of Cr.P.C, dated 07-02-2019. It is stated by the Station House Officer, Nettapakkam Police Station that you have indulging in crime such as threatening the public, extortion, murder, hurt cases, disturbance to the public tranquility peace and order and you have created panic in the minds of local inhabitants. It is also stated that you have become a source of terror among the public. As a result, the people of the locality being afraid of you and do not come forward to lodge any complaint against you. It is also stated that even witnesses don't come forward voluntarily to give evidence against you in the cases where you are the accused;

And whereas, the Station House Officer, Nettapakkam Police Station, further submitted that if, you are allowed to reside in Subdivisional Magistrate (South) Jurisdiction limits, it is apprehended that you would continue to indulge in serious offences like threatening the public extortion, murder, hurt cases, disturbance to the public tranquility, peace and order, etc., and thereby emerged as a perennial source of threat to the community and disturb public peace and order;

And whereas, summons were served for your appearance on 20-03-2019 to file your explanation/objection as to why the Subdivisional Magistrate (South), Villianur, should not order to prevent you from entering into the south region under section 144 (3) of Cr.P.C. You have put forth your side which is not convincing;

And whereas, based on the report laid before me, I am of the opinion that if, you are allowed to reside within the limits of this jurisdiction, you will continue to indulge in and also motivate serious offences and thereby become a perennial source of threat to the community and disturb public peace and order. Such situations cannot be handled effectively by taking recourse to usual procedures contemplated by law and hence, it is necessary that special provision under section 144 of Cr.P.C. is invoked to take action against you to prevent harm to life and properties of citizens and uphold public peace and order;

And whereas, I am satisfied that in view of the ensuing General Elections to the Lok Sabha and Bye-Election to Thattanchavady Assembly Constituency, wherein, it necessitate to maintain law and order for peaceful and fair election and the given time constraint, serving of notice to you as provided under the code could not be followed and that your activities will endanger human life and properties and your presence is a threat to public tranquility in Puducherry District and therefore, an immediate action is required for curtailing your illegal activities in the locality;

Now, therefore, based on the reasons stated above, I, Pravimal Abhishek Polumatla, I.A.S., Assistant Collector-cum-Executive Magistrate, Puducherry, in exercise of powers conferred under Code of Criminal Procedure do hereby prohibit you under section 144 of Cr.PC from entering into the jurisdiction of Subdivisional Magistrate Court (South) for a period of two months from the date of this order or till any further orders are passed by the Competent Authority revoking this prohibition as per law, whichever is earlier except when you are summoned to attend the cases in any of the Courts in Puducherry. However, you may appear either in person or by Pleader before the undersigned to represent against the order;

It is stated by the Station House Officer, Thirukkanur Police Station, that you have formed a gang of rowdies in the surrounding Tamil Nadu and Puducherry areas and bent upon indulging in crime such as communal clash, rioting, attempt to murder, intimidation, robbery and disturbance to the public tranquility and order and you have created panic in the minds of local inhabitants and the farmers and business community in the rural limit. It is also stated that you have become a source of terror among the public. As a result the people of the locality being afraid of you and do not come forward to lodge any complaint against you. It is also stated that even witnesses don't come forward voluntarily to give evidence against you in the cases where you are the accused;

And whereas, the Station House Officer, Thirukkanur Police Station, further submitted that if, you are allowed to reside in Subdivisional Magistrate (South) Jurisdiction limits, it is apprehended that you would continue to indulge in serious offences like communal clash, rioting, attempt to murder, intimidation, robbery and disturbance to the public tranquility and order, etc., and thereby emerged as a perennial source of threat to the community and disturb public peace and order;

P.C @ 302 IPC, dated 22-04-2010 of Villianur Police Station, Puducherry, (3) Cr.No. 235/2013 under sections 294,(b) 323, 506(ii) 379 r/w 34 IPC, dated, 21-11-2013 of Villianur Police Station, Puducherry, (4) Cr.No. 285/2014 under sections 4(1) (G), 4(i) (A), 13 (A) (Class-I) r/ w 41 (A) of TNP Act (Trans.) dated, 11-01-2014 of Thuraiyur PEW-PS, Tamil Nadu, (5) Cr.No. 234/2017 under sections 25(1-B) of Arms Act 1959 & 506(ii) IPC, (6) Cr.No. 116/2011 under sections 144 Cr.P.C., dated 29-03-2011 of Villianur Police Station, Puducherry, (7) Cr.No. 307/2011 under sections 144, Cr. P.C. dated 11-09-2011 of Villianur Police Station, Puducherry, (8) Cr.No. 74/2014 under section 144, Cr.P.C., dated 04-11-2014 of Villianur Police Station, Puducherry and your vengeful acts along with your accomplices against your opponents have created panic in the minds of the people;

And whereas, the Station House Officer, Villianur Police Station, has filed a case against you vide FIR.No. 108/2018 under section 144 of Cr.P.C, dated 06-11-2018. It is stated by the Station House Officer, Villianur Police Station that you have formed a gang of rowdies and bent upon indulging in crime such as hurt, criminal intimidation, wronful restrained, damaging the public property and disturbance to the public tranquility and order and you have created panic in the minds of local inhabitants and the farmers, and business community in the rural limit. It is also stated that you have become a source of terror among the public.

As a result the people of the locality being afraid of you and do not come forward to lodge any complaint against you. It is also stated that even witnesses don't come forward voluntarily to give evidence against you in the cases where you are the accused;

And whereas, the Station House Officer, Villianur Police Station, further submitted that if, you are allowed to reside in Subdivisional Magistrate (South) Jurisdiction limits, it is apprehended that you would continue to indulge in serious offences like hurt, criminal intimidation, rioting, etc., and thereby emerged as a perennial source of threat to the community and disturb public peace and order;

And whereas, summons were served for your appearance on 03-01-2019, 24-01-2019, 13-03-2019 to file your explanation/objection as to why the Subdivisional Magistrate (South), Villianur, should not order to prevent you from entering into the south region under section 144 (3) of Cr.P.C. You have failed to appear before the Court to defend you side;

And whereas, based on the report laid before me, I am of the opinion that if, you are allowed to reside within the limits of this Subdivisional Magistrate Court (South) jurisdiction, you will continue to indulge in and also motivate serious offences and thereby become a perennial source of threat to the community and disturb public peace and order. Such situations cannot be handled effectively by taking recourse to usual procedures contemplated by law and hence, it is necessary that special provision under section 144 of Cr.P.C. is invoked to take action against you to prevent harm to life and properties of citizens and uphold public peace and order;

And whereas, I am satisfied that in view of the ensuing General Elections to Lok Sabha and Bye-Election to Thattanchavady Assembly Constituency, wherein, it necessitates to maintain law and order for peaceful and fair election and the given time constraint, serving of notice to you as provided under the code could not be followed and that your activities will endanger human life and properties and your presence is a threat to public tranquility in this jurisdiction and therefore, an immediate action is required for curtailing your illegal activities in the locality;

Now, therefore, based on the reasons stated above I, Pravimal Abhishek Polumatla, I.A.S., Assistant Collector-cum-Executive Magistrate. Puducherry, in exercise of powers conferred under Code of Criminal Procedure do hereby prohibit you under section 144(2) of Cr. P.C. from entering into the region under the jurisdiction of Subdivisional Magistrate Court (South) for a period of two months from the date of this order or till any further orders are passed by the CompetentPART-I ] LA GAZETTE DE L'ETAT 1507 Authority revoking this prohibition as per law, whichever is earlier except when you are summoned to attend the cases in any of the Courts in Puducherry. However, you may appear either in person or by Pleader before the undersigned to represent against the order.

And whereas, I am convinced of your involvement in various criminal cases under (1) Cr. No. 93/2018 under sections 120(b), 302 r/w 34 IPC., dated 05-04-2018 of Villianur Police Station, Puducherry, (2) Cr.No. 258/2018 under sections 506,(ii) IPC & section 25 (1) (B) (b) of Arms Act 1959 of Villianur Police Station, Puducherry, and your vengeful acts along with your accomplices against your opponents have created panic in the minds of the people;
