NOTIFICATION
The Legislative Department, Ministry of Law and Justice, Government of India, has enacted a new law viz. "The Rights of Persons with Disabilities Act, 2016" (No. 49 of 2016) on 27-12-2016. The Ministry of Social Justice and Empowerment, Government of India appointed 19th April 2017 as the date on which the Act shall come into force vide Notification S.O.No.1215(E), dated 19-4-2017. The Ministry of Home Affairs, Government of India, has delegated the powers of the State Government under the Act to the Administrators of all the Union Territories vide Notification S.O. No. 3870 (E), dated 12-12-2017 and published in the Gazette of India in No. 3394, Section 3 of the Extraordinary Part-II, dated 12-12-2017. The Puducherry Rights of Persons with Disabilities Rules, for the Union territory of Puducherry under section 101 of the Act has been notified vide G.O. Ms. No. 12/SWS/ 2018-19, dated 19-12-2018 and published vide Part-II of Extraordinary Gazette No.77, Government of Puducherry vide dated 21-12-2018;
Whereas, section 79 of the Act requires appointment of State Commissioner for Persons with Disabilities for the purpose of implementing the various provisions of the Act;
Now, therefore, the Lieutenant-Governor is pleased to designate the Secretary to Government (Welfare) as the Ex officio Commissioner for persons with disabilities for the purposes of the Act. The Ex officio Commissioner shall discharge duties in accordance with the provisions under sections 80 to 83 of the Act and Rule 21 to 34 of the Puducherry Rights of Persons with Disabilities Rules, 2018.
Notification (1) "The Rights of Persons with Disabilities Act, 2016" (No. 49 of 2016), dated 27-12-2016 of the Ministry of Law and Justice and published in the Gazette of India, Extraordinary No. 59, Part-II, Section-I, dated 28-12-2016, Government of India, New Delhi. The Ministry of Social Justice and Empowerment has framed the Central Rules thereunder a notified vide Notification (2) "The Rights of Persons with Disabilities Rules, 2017" notified in G.S.R. 591(E), dated 15-06-2017 of the Ministry of Social Justice and Empowerment and published in the Gazette of India No. 489, dated 15-06-2017;
And whereas, the Ministry of Home Affairs, Government of India, has delegated the powers of the State Government under the Act to the Administrator o f all the Unio n Ter r ito r ies, vid e No tificatio n (3) No. S.O. 3870(E), dated 12-12-2017 of the Ministry of Home Affairs and published in the Gazette of India No. 3394, dated 12-12-2017;
And whereas, the Puducherry Rights of Persons with Disabilities Rules, 2018 has been notified vide G.O. Ms. No.12/SWS/2018-19, dated 19th December 2018 and published in the Gazette of Puducherry, Extraordinary Part-II, No.77, dated 21st December 2018 (hereinafter referred as the said rules);
And whereas, sub-rule (2) of rule 36 of the said rules provide or a Governing Body to manage the State Fund constituted under section 88 of the said Act; Now, therefore, in pursuance of sub-rule(2) of rule 36 of the said rules the Lieutenant-Governor of Puducherry hereby appoints/nominates as the case may be, the following persons as Members of the Governing Body, with effect from the date of publication, namely:-
