GOVERNMENT OF PUDUCHERRY The Inquiry Officer in his final report vide I.D. Note No. 03/2019-US(DI)/CS, dated 27-2-2020 has conveyed OFFICE OF THE DEPUTY DIRECTOR that "all attempts to contact the Charged Official were (PUBLIC HEALTH)

in vain. The same was also informed by the Presenting NO. 6543/DD(PH)/ESTT./E2/2019/116.

Officer. The Inquiry Authority does not receive any information from the Charged Official. This shows that

MEMORANDUM

Sub. : DD(PH)–Estt.–Unauthorised absence and Misbehaviour by Thiru S. Kumar, Health Assistant, Primary Health Centre, Thirukkanur, Puducherry "Removal from Service" under rule 14 of CCS(CCA) Rules, 1964 (1965)—Orders-issued.

Ref. : T h i s O ff i c e M e m o r a nd u m N o . 6 5 4 3 / DDPH/Estt./E2/2016, dated 19-03-2020 published in "The Hindu" and "Dinakaran" on 24-03-2020.

Whereas, Thiru S. Kumar, Health Assistant, Primary Health Centre, Thirukkanur, Puducherry, was continuously on unauthorized absence from duty with effect from 11-04-2019. Since, the Memoranda issued at various dates to his office address and the residential address available in this office has been returned as "Unclimed", disciplinary proceedings was contemplated vide Charged Memorandum No. 6543/DDPH/Estt./E2/2016/181, dated 27-08-2019 has been sent to his last known address and Primary Health Centre, Thirukkanur, were returned to this office by the postal authorities "Unclimed";

And whereas, the Inquiry Officer has also summoned the official for enquiry and the same was returned by the Postal Authorities with a mention "Not Climed".

Charged Official does not cooperate with the inquiry.

The Department may give wide publicity in leading newspapers about unauthorised absence";

And whereas, Thiru S. Kumar, Health Asistant, PHC, Thirukkanur, has been instructed through Newspaper notification (The Hindu and Dinakaran, dated 24-03-2020) to submit his explanation/defence statement within 10 days from the date of publication/issue of the Memorandum as to why, his services should not be terminated by imposing major penalty under rule 14 of CCS(CCA) Rules,1964(1965). But, he has not furnished his explanation within the stipulated period and he has not joined duty till date.

Now, therefore, the undersigned in exercise of the powers conferred up on him is hereby order that Thiru S. Kumar, Health Assistant, Primary Health Centre, Thirukkanur, Puducherry, is awarded the major penalty of "Removal from Service" under rule 14 of the Central Civil Services (Classification Control and Appeal) Rules, (1964) 1965 with immediate effect from the date of issue of this order. The period of absence from duty is treated as "Dies-non".

Whereas, the Government is of the opinion that an industrial dispute has arisen between the management of M/s. Texbond Nonwovens, Mannadipet Commune, Puducherry and Thiru V. Rajiv Gandhi, Madagadipet Post, Puducherry, over non-employment in respect of the matter mentioned in the Annexure to this order;

And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated vide G. O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the Labour Department, Puducherry, to exercise the powers conferred by clause (c) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by the Secretary to Government (Labour) that the said dispute be referred to the Labour Court, Puducherry for adjudication. The Labour Court, Puducherry, shall submit the Award within

3 months from t h e d a t e o f i s s u e o f r e f e r e n c e a s s t i p u l a t e d u n d e r sub-section (2-A) of section 10 of the Industrial Disputes Act, 1947 and in accordance with r u l e 1 0 -B o f t h e I n d u s t r i a l D i s p u t e s ( C e n t r a l) Rules, 1957. The party raising the dispute shall file a statement of claim complete with relevant documents, list of reliance and witnesses to the Labour Court, Puducherry, within 15 days of the receipt of the order of reference and also forward a copy of such statement to each one of the opposite parties involved in the dispute.

The tenders in sealed covers superscribed as "Tender for purchase of old newspapers and waste papers" should be addressed to the Director, Directorate of Higher and Technical Education, Puducherry and sent to this office, so as to reach before 12.00 noon on 19th August 2020. The tenders will be opened on the same day at 4.00 p.m. in front of the tenderers those who are present at that time. In case, the day for tender opening being declared as public holiday for any reason, the tenders will be received and opened at the same time on the next working day.

4. The intending tenderers should deposit an amount of ` 200/-(Rupees two hundred only) as earnest money deposit along with the tenders. The earnest money deposit of the unsuccessful tenderers will be refunded immediately after the finalization of tenders.

5. Tenders received after the due date and time will be rejected. Tenders without GST number and Certificate are also rejected.

7. The successful tenderer should arrange to weigh the old newspapers/waste papers, pay the cost thereof along with applicable GST and clear the items within 24 hours from the time of the tender sale is over at his/ her own risk and cost, failing which this Directorate is not responsible for loss thereafter and earnest money deposit will be forfeited.

8. No claim on the quality, quantity and value of the sold goods will be entertained, once the tender is finalized.

9. Materials can be inspected during office hours without crowding in and outside the office due to COVID-19 which leads to cancellation of tender.

10. In case of any dispute, the decision of the undersigned will be the final.
