NOTIFICATION

Whereas, the Government is of the opinion that an i n d u s t r i a l d i s p u t e h a s a r i s e n b e t w e e n t h e management o f M / s . Solara Active Pharma Sciences Limited, Periyakalapet, Puducherry and the Union workmen represented by Illanthalaivar Ragul Gandhi Puducherry Shasun Thozhilalargal Nala Sangam, Periyakalapet, Puducherry, over unfair labour practice in respect of the matter mentioned in the Annexure to this order;

And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the Labour Department, Puducherry, to exercise the powers conferred by clause (c) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by the Secretary to Government (Labour) that the said dispute be referred to the Labour Court, Puducherry, for adjudication. The Labour Court, Puducherry, shall submit the Award within 3 months from the date of issue of reference as stipulated under sub-section 2-A of section 10 of the Industrial Disputes Act, 1947 and in accordance with rule 10-B of the Industrial Disputes (Central) Rules, 1957. The party raising the dispute shall file a statement of claim complete with relevant documents, list of reliance and witnesses to the Labour Court, Puducherry, within 15 days of the receipt of the order of reference and also forward a copy of such statement to each one of the opposite parties involved in the dispute.

Whereas, the Government is of the opinion that an i n d u s t r i a l d i s p u t e h a s a r i s e n b e t w e e n t h e management o f M / s . Puducherry State Health Society, Puduchery and the Union workmen represented by Puducherry Health Mission Employees' Association, Puducherry, over non-payment of Bonus for the year 2018-2019 in respect of the matter mentioned in the Annexure to this order;

And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

NOTIFICATION

The Government of India, Ministry of Parliamentary Affairs as a part of Digital India Programme (DIP), desires to roll out e-Vidhan as NeVA covering all 40 houses including two houses of Parliament and thereby putting them all on a single platform in the concept of 'One Nation One Application'. Further, e-Vidhan is a Mission Mode project to digitize and make functioning of the State Legislatures as paperless to achieve Go Green Campaign. Puducherry being a Union Territory, 100 % funding for the project will be provided by Ministry of Parliamentary Affairs, Government of India.

2. The Ministry of Parliamentary Affairs being the Nodal Ministry has requested to constitute State Level State Project Management Unit-cum-NeVA Implementation Committee for implementing e-Vidhan (NeVA) in Puducherry State Legislature.

3. Therefore, the Lieutenant-Governor is pleased to constitute the following Committee for implementing e-Vidhan (NeVA) in Puducherry State Legislature.

Now, therefore, by virtue of the authority delegated vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the Labour Department, Puducherry, to exercise the powers conferred by clause (d) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by the Secretary to Government (Labour) that the said dispute be referred to the Industrial Tribunal, Puducherry for adjudication. The Industrial Tribunal, Puducherry, shall submit the Award within 3 months from the date of issue of reference as stipulated under sub-section 2-A of section 10 of the Industrial Disputes Act, 1947 and in accordance with rule 10-B of the Industrial Disputes (Central) Rules, 1957. GOVERNMENT OF PUDUCHERRY 2. In this regards, the Ministry of Rural Development has directed the State/Union Territory Governments to establish the Office of Ombudsman in the Districts for redressal of grievances under MGNREGS in a time bound manner and also appoint an Ombudsman. This Union Territory has been advised by the Ministry to engage the Ombudsman at the earliest in the Empowered Committee Meeting held on 17-08-2020.

3. Central Government norms for process of appointment; application, tenure and termination; autonomy; remuneration; powers and responsibilities; procedure for redress of grievances and action to be taken on the Report of the Ombudsman have been detailed in Ministry's Guidelines on Ombudsman, dated 28th August 2017 vide Guidelines for Appointment of Ombudsman issued by the Ministry of Rural Development, Government of India, New Delhi, dated 28-08-2017.

4. In accordance with the guidelines of the Ministry for appointment of Ombudsman, the Lieutenant-Governor, Puducherry, is pleased to Constitution of Selection Committee for appointment of Ombudsman under MGNREGA in this Union territory of Puducherry with immediate effect comprising of the officers detailed below:

(i) Development Commissioner, . . Chairman Government of Puducherry.

(ii) Representative of Union Ministry . . Member of Rural Development, Government of India.

(iii) Eminent Civil Society Person . . Member nominated by Union Ministry of Rural Development, Government of India.

(iv) Secretary to Government . . Member (Rural Development), Puducherry. Convenor.

The following qualifications shall be prescribed for the selection of Ombudsman:

(RURAL DEVELOPMENT)

(i) Person of eminent standing and impeccable integrity with at least ten years of experience in public administration, law, academics, social work or management.

ORDER

Section 30, Schedule I of the Mahatma Gandhi NREGA Act, 2005 mandates that there shall be an Ombudsman for each District for receiving grievances, enquiring into and passing Awards as per Guidelines. The work of the ombudsman is in the nature of pro bond public service and no posts are created in the State for the purpose.

(ii) Preference may be given to person resident of the same or neighboring District.

(iii) Experience in working with people or community organisation shall be mandatory qualification.

(iv) No person who is a member of a recognized political party or banned organisation shall be considered for appointment as ombudsman, each person shall be required to file a declaration to this effect along with the application.

(v) The person selected as Ombudsman must be physically active and capable of conducting field tours, inspections and visit to remote rural location in the Districts.

6. The following procedure shall be followed for appointing the Ombudsman:

(i) Application shall be invited through open advertisement.

(ii) The Selection Committee shall prepare a panel of suitable persons for consideration for appointment as Ombudsman and rank them in order of preference.

(iii) No written test or examination shall be conducted while an interview and an internal marking system should be evolved by the Selection Committee to rank persons in order of preference.

(iv) Prior to appointment, the panel prepared by the Selection Committee shall be published on the official website ([email protected]) to invite comments from the public.

(v) On expiry of 30 days of publication, the comments shall be examined by the Selection Committee.

(vi) All comments and objections shall be settled within 30 days of the date of expiry of the period for inviting comments. Anonymous comments and objections need not be considered.

7. The Ombudsman shall be appointed for tenure of two years and extendable not more than twice by one year each based on performance appraisal process or till the incumbent attains the age of 68 (Sixty eight) years, whichever is earlier. There shall be no reappointment.

8. The Ombudsman shall be allowed compensation, in the form of fee, of ` 1,000 (Rupees one thousand only) per sitting with maximum upper limit of ` 20,000 (Rupees twenty thousand only) per month. Sitting means, per day functioning irrespective of number of cases and its duration in terms of working hours.

9. As per para 5.1 of the 2017 Guidelines, one ombudsman may have jurisdiction in more than one District in case of number of MGNREGS works is likely to be low. As per para 2.2.2 of the 2017 Guidelines, smaller Districts having low expenditure under MGNREGS may be clubbed together to have common ombudsman. Hence, for both Puducherry and Karaikal Districts only one Ombudsman will be appointed.

10 The Office of MGNREGA Ombudsman shall be located in DRDA, Puducherry, technical and administrative support will be provided by the DRDA, Puducherry. All necessary support to enable the ombudsman to carry out the assigned functions, including support staff, office equipments, complaint box, and telephone helpline, etc., shall be provided to the Ombudsman by the District Authority.

11. The State Government shall provide necessary legal support to cases in Courts relating to actions taken in the official capacity by the Ombudsman.

12. Secretary (Rural Development) will act as a Appellate Authority on the disclosure of Ombudsman.
