ORDER
(UNDER SECTION 144 OF Cr. P.C.)
Whereas, the Election Commission of India has announced on 26-02-2021 that General Elections to Puducherry Assembly 2021 will be held on 06-04-2021 and soon after this announcement of the Election Schedule, the Model Code of Conduct has come into force with immediate effect.
And whereas, since the Model Code of Conduct (MCC) is in effect in Puducherry, it is now mandatory for all Political Parties as well as for the Independent Candidates contesting in the upcoming elections to follow the MCC in letter and spirit till the election process is over.
And whereas, consequent upon the enforcement of the MCC, prior permission from concerned authority becomes mandatory for organizing public political meetings/campaigns/electioneering/rallies/agitations/ demonstrations by Political Parties, Independent Candidates, Unions, etc., in order to maintain law and order decorum and ensure smooth conduct of elections.
[ 311 ]LA GAZETTE DE L'ETAT [ PART-I 312 312 Now, therefore, I, PURVA GARG, I.A.S., in exercise of powers conferred upon me under section 144 of the Criminal Procedure Code, 1973, and the Disaster Management (DM) Act, 2005, with a view to ensure conduct of elections in a peaceful manner with due regard to public tranquility/safety amidst ongoing COVID-19 pandemic crisis, do hereby order that any and all public political meetings / campaigns / electioneering / rallies / agitations / demonstrations by Political Parties, Independent Candidates, Unions, etc., in Puducherry region shall be carried out only at the notified places (Annexed) after obtaining prior permission from the Office of the District Magistrate, Puducherry.
Any such political meetings / campaigning / electioneering / rallies / agitations / demonstrations performed outside the locations identified in the Annexure and or without prior permission from the Office of the District Magistrate, shall be considered unlawful assembly and legal action under section 188 of IPC and other relevant provisions of law shall be initiated against the violators.
This order shall come into force with immediate effect and will remain in force till 04-05-2021. This order shall apply to the Puducherry region of Union territory of Puducherry.
This order shall not apply to marriages, religious and funeral processions, ceremonies and Government functions.
The emergent nature of the case and the circumstances do not permit serving of notice to the concerned in due time and hence, this order is passed ex parte under section 144(2) of Criminal Procedure Code, 1973.
