Ms. No. 31, dated 04-01-2022 of Directorate of School Education (Secretariat Wing), Puducherry, the Lieutenant-Governor, Puducherry, is pleased to notify the criteria for selection of Teachers and other categories of Staff under the Cadre Control of the Directorate of School Education, Government of Puducherry, to the system of giving weightage to the marks secured in the academic qualifications and to the Employment Exchange Registration Seniority as per the procedures detailed in the Annexure to this Order.

be assessed as below on the class they obtained:

First Class and Above – 50%

Second Class – 45%

(C) Common Aspects for all Categories of Posts

— To arrive at % of aggregate marks of essential qualifications, for every additional attempt 5% will be deducted; Even if, the candidate completed the required essential qualifications within the stipulated period of the course but made additional attempt(s) 5% will be deducted for every additional attempt(s).

— For all the categories of posts Employment Exchange Registration Seniority would be calculated uniformly at the rate of 1.00 % per year subject to a maximum of 10 years from the date of registration of the essential qualification for the particular post including TET.

NOTIFICATION

Whereas, the Government is of the opinion that an industrial dispute has arisen between the management of M/s. Ravikumar Distilleries Limited and All India Trade Union Centre, over payment of bonus for the year 2021-22 to Thiruvalargal S.Vinayagamurugan and 40 others, in respect of the matter mentioned in the Annexure to this order;

And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated vide G.O. Ms. No. 20/9/Lab./L, dated 23-5-1991 of the Labour Department, Puducherry, to exercise the powers conferred by clause (d) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by the Secretary to Government (Labour) that the said dispute be referred to the Industrial Tribunal, Puducherry, for adjudication. The Industrial Tribunal, Puducherry, shall submit the Award within 3 months from the date of issue of reference as stipulated under sub-section (2-A) of section 10 of the Industrial Disputes Act, 1947 and in accordance with rule 10-B of the Industrial Disputes (Central) Rules, 1957. The party raising the dispute shall file a statement of claim complete with relevant documents, list of reliance and witnesses to the Industrial Tribunal, Puducherry, within 15 days of the receipt of the order of reference and also forward a copy of such statement to each one of the opposite parties involved in the dispute.

(i) Whether the dispute raised by the Petitioner Union All India United Trade Union Centre (AIUTUC), against the management of M/s. Adverting to the Orders, dated 30-06-2023 of the H o n ' b l e H i g h C o u r t o f J u d i c a t u r e a t M a d r a s i n W.P. Nos. 34726 of 2022 and 3241 of 2023 and G.O. Ms. No. 1/CHRI/T.2/2023, dated 14-07-2023, and in exercise of the powers conferred under the Puducherry Hindu Religious Institutions Act, 1972, Thiru P. Nilakandan, S/o. Ponnambalam, Fieldman, Department of Animal Husbandry and Animal Welfare, Puducherry, is hereby appointed as Temple Administrative Officer of Sri Muthu Vinayagar, Sri Subramaniyaswamy and Sri Nagamuthumariamman Devasthanam, Saram, Puducherry, on Honorary basis. The Temple Administrative Officer shall administer the said Devasthanam as envisaged in the provisions of the Puducherry Hindu Religious Institutions Act, 1972, and the rules framed thereunder.

Important duties and responsibilities of the Temple Administrative Officer are given below:

(i) To take over the administration of the said Devasthanam along with movable and immovable assets;

(ii) Submission of compliance report on taking over of the administration of the temple along with the details of movable and immovable properties with a period of fifteen days from taking over the administration;

(x) Shall not connive at or facilitate any act or conduct of another person which would involve a breach of trust or occasion risk or loss to the property belonging to the Institution;

(xi) Shall strictly conform to and carry out the terms and shall not encumber the properties of the Institution by persistingly incurring expenditure beyond the limits of the income of the property of the Institution;

(xii) Shall not in any way make use of the property of the Institution or of his position as Temple Administrative Officer, for his self-interest or private advantage; and shall be personally responsible for the exercise of his judgment and for performance of his duty and he cannot therefore escape responsibility by leaving to another person the exercise of judgment or the performance of that duty.

The Temple Administrative Officer shall hold office for a period of three years from the date of its appointment, unless in the meanwhile removed or dismissed or on resignation is accepted or otherwise cease to be Temple Administrative Officer.

CIRCULAR

Sub : Enquiry under section 68(2) of the Registration Act, 1908 by the District Registrar on complaints relating to fraudulent registrations which result due to non-adherence of Instructions/Circulars/ provisions of the Registration Act, 1908 and the Rules framed thereunder by the Registering Officers - Reg.

Ref : Circular No. 4225/REGN/A3/DRO/2021, dated 05-08-2021 of Inspector-General of Registration, Puducherry.

The circular cited under reference was issued by the Inspector-General of Registration, Puducherry, instructing the District Registrar, Puducherry, to enquire into the complaints relating to fraudulent registrations due to non-adherence of the stipulated procedures by the Registering Officers.

2. Consequent to issue of the Circular 4225/REGN/ A3/DRO/2021, dated 05-08-2021, it has been reported that several petitions/representations and complaints of fraudulent registration have been received and most of the cases are either in the state of issue of order or enquiry is pending.

3. The Hon'ble High Court of Judicature at Madras vide Order, dated 17-07-2023 in Writ Petition No. 10124 of 2023 and W.M.P.No. 10149 of 2023 have quashed the said Circular No. 4225/REGN/A3/DRO/2021, dated 05-08-2021 of the Inspector-General of Registration, Puducherry. Therefore, it is hereby advised to direct all the parties connected to the petitions/representation submitted so far, to approach the Civil Court of Competent Jurisdiction for remedy.

(B) Eligiblity/Qualification Criteria

(i) The bidder shall have a valid authorised certificate for collection of E-Waste issued by State/ Union Territory and should be enclosed with the tender. Failure to submit the same along with the quotation will lead to disqualification of the bidder. Agencies without having above registration and authorization will be not allowed to participate in the bid.

(ii) The Firm may enclose sufficient documents regarding execution of Government work order, specifically Disposal of e-waste.

(iii) All bidders must enclose G.S.T. Registration Certificate along with the tender documents.

Women and Children Hospital, Puducherry, shall have the right to forfeit the entire amount of the bidder and dispose the items to alternate bidder.

(vii) The total price should be inclusive of all miscellaneous charges like transportation, labour or any other incidental expenses, etc., as all above items are interlinked to each other therefore, no comparison will be made on individual item. The contract will be awarded on comparison of consolidated price of all items.

(viii) Each page of tender document should be signed by the bidder(s).

(ix) Incomplete and unsigned quotations are liable to be rejected.

The bid shall remain valid for 60 days after the date of bid opening. If, any bidder withdraws his/her tender before the said period shall without prejudice to any other right or remedy, is at liberty to forfeit the bid Security absolutely.

(D) General Terms and Conditions

(i) The items shall be sold to the highest price of bidder.

(ii) The earnest money deposit of the successful bidder shall be adjusted in the bid forthwith. The earnest money deposit of unsuccessful bidders shall be returned immediately, without any interest.

(iii) No items, once disposed off to the successful bidder, shall not be taken back by Office of the Medical Superintendent, Rajiv Gandhi Government Women and Children Hospital, Puducherry.

(iv) The successful bidder has to make full balance payment in the form of Demand Draft in favour of the Junior Accounts Officer, Rajiv Gandhi Government Women and Children Hospital, Puducherry, within 24 hours after confirmation, failing which the offer will be cancelled and earnest money deposit shall stand forfeited.

(i) Bids are invited in two bid systems, (1) Technical and (2) Commercial, which shall be sealed separately in a single sealed envelope.

(ii) Sealed bids shall be received, not later than 13-10-2023 up to 4.30 p.m. No bids will be accepted after this date and time under any circumstances. This office will not be responsible for any postal/courier delay and also for reasons beyond the control of this office.

(iii) Technical bids must contain the earnest money deposit for specified amount, along with complete technical details as desired by this tender and signed tender document in all pages. The commercial bid must contain total price for all items in sealed condition. First Technical bids of all the tenders will be opened on scheduled date, time and venue. Technical bids without earnest money deposit will summarily be rejected.

(iv) The Commercial bids of only successful Technical bids will be opened on scheduled date, time and venue.

(F) Submission of bids

(v) Tender Fee of ` 500 (Rupees five hundred only) and earnest money deposit (EMD) of ` 5,000 (Rupees five thousand only) must accompany with each quotation. This shall be in the form of Demand Draft from any Nationalized /Scheduled Bank drawn in favour of Junior Accounts Officer, Rajiv Gandhi Government Women and Children Hospital, payable at Puducherry, without which, the tender will summarily be rejected. No Cheque/Money Order/Cash shall be accepted. The tender fee and earnest money deposit will not attract any interest.

(vi) The successful bidder shall be required to lift all the items from the disposal site to its premises within 24 hours after the payment of the quoted amount (earnest money deposit amount will be adjusted with the quoted value). On failure to do so, Office of the Medical Superintendent, Rajiv Gandhi Government (i) The first envelope shall be superscripted with the name of work and the words "Technical bid" in capital letters. The first envelope shall be opened on the date of opening of tender. The bidder should specifically provide full technical details of the Registration Certificate validity, etc., No price details shall be given in this envelope. Violation to this would result invalidation of tender. The bid Security shall be enclosed with the envelope marked "Technical Bid".

(ii) The second envelope shall be superscripted with the name of work and the words "Price bid (Commercial bid)" in capital letters. It shall contain full details of the price. Any deviation from our standard conditions shall be specifically spelt out.

(iii) Any deviation of any sort e.g., Technical or Commercial terms and conditions shall be specifically indicated in the Technical bid itself.

(iv) Silence or use of the word "Noted" against any of the bid conditions shall mean bidder agrees to comply with that/those conditions of bid.

(v) All prices and other information in this regard having a bearing on the price shall be written both in figures and words in the prescribed offer Form.

(vi) The bid should be submitted in the prescribed bid format given as prescribed in "Bidding Procedure" of this document.

(vii) Any false representation is found during the tender process, the tender offered by him/them will be cancelled.

(viii) Other than the tenderer or his/her authorized person, one will be admitted at the time of opening the tenders or in the auction process.

(ix) No bid may be modified subsequent to the deadline for submission.

(x) In case, highest tender amount offered by the tenderer is found to be not acceptable by the undersigned, the public auction will be conducted on the spot keeping the highest tender amount as minimum bid amount.
