W h e r e a s , a n Aw a r d i n I . D . ( L ) N o . 11/ 2 0 1 9, dated 29-02-2024 of the Labour Court, Puducherry, in respect of the industrial dispute between the management of M/s. Classik Plasto Packagings Limited, Industrial Estate, Thattanchavady, Puducherry and Thiru T. Ramesh Babu, Muthialpet, Puducherry, over refusal of employment has been received;

This Industrial Dispute arises out of the reference made by the Government of Puducherry, vide G.O. Rt. No. 21/AIL/Lab./T/2019, dated 08-02-2019 of the Labour Department, Puducherry, to resolve the following dispute between the Petitioner and the Respondent, viz. (i) Whether the dispute raised by the petitioner Thiru T. Ramesh Babu, Muthialpet, Puducherry, against the management of M/s. Classik Plasto Packagings, Industrial Estate, Thattanchavady, Puducherry, over refusal of employment is justified or not? If justified, what relief the petitioner is entitled to?

(ii) To compute the relief if any, awarded in terms of money if, it can be so computed.

2. The averments set forth in the claim statement is

as follows:

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 17 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), read with the Notification issued in Labour Department's G.O. Ms. No. 20/9/Lab./L, dated 23-05-1991, it is hereby directed by the Secretary to Government (Labour) that the said Award shall be published in the Official Gazette, Puducherry.

The Managing Director, M/s. Classik Plasto Packagings Limited, Puducherry.

Respondent The petitioner was working as Driver for the vehicle PY-01-AL-8442 in the respondent's factory for more than six years and availed ESI leave from 07-07-2018 to 27-08-2018 due to leg injury and the petitioner rejoined duty on the following day after i n f o r m i n g t h e m a n a g e m e n t a b o u t t h e F C expenses. On the date of joining the duty, he was asked to meet the MD, when the petitioner went to the MD's rooms, he was humiliated by the MD's husband by filthy language and he was asked to get out of the room and from the job on allegation that the petitioner tried to cease the engine by not dispensing with engine oil and for having not intimated the date of expiry of insurance to the management. Later, the MD called the petitioner and asked for explanation and when the petitioner was explaining, her husband once again used filthy language against the petitioner and to get away from the factory. The petitioner requested the management to pay three months salary, bonus, EPF benefits, gratuity, etc., as the management itself refused for employment. The management also accepted to settle the financial dues, but, later refused to pay the accepted settlement. The petitioner is the bread winner of the family and is suffering a lot due to the abovesaid facts. Hence, the claim.

3. The averments set forth in the counter is as

follows:

This Industrial Dispute coming on this day before m e f o r h e a r i n g i n t h e p r e s e n c e o f T hiruvalargal M. Vaikunth, S. Kamalini, R. Vikneshraj and G. Anand, Counsels appearing for petitioner and Thiruvalargal V.P. Chamuraj, Counsel for the respondent and upon hearing the Learned Counsel for petitioner and respondent and on perusing the entire records of the case, having stood over for consideration till this date, this Court delivered the following:

The respondent herein denies the averments made by the petitioner in the claim statement are absolutely false and not maintainable under law and there is no merits in it. The present industrial dispute raised by the petitioner, over his non employment is implicated on false representation of the petitioner. The21 May 2024] LA GAZETTE DE L'ETAT 365 petitioner was working in the respondent concern from 21-05-2014 to 27-07-2018 for a period of four years two months only and further, he was not in service for full period of five years, he don't have the eligibility for gratuity benefits as claimed by him.

The contention of the petitioner is that the petitioner was working as a Driver in the respondent's factory for more than six years and while so, the petitioner availed ESI leave from 07-07-2018 to 27-08-2018 due to leg injury and later when the petitioner reported to duty the petitioner was informed to meet Managing Director of the respondent company and thereby, the petitioner went to Manager Director's room and at that time the husband of the Managing Director scolded the petitioner in filthy language stating that the petitioner tried to cease the vehicle by not dispensing the engine oil and also not intimated the insurance expiry date of the vehicle and when the petitioner tried to explain the husband of the Managing Director again abused the petitioner in filthy language and further, informed the petitioner to get away from the factory and therefore, the petitioner had requested the management to pay three months salary, bonus, EPF benefit and gratuity but, the respondent management failed to settle the dues and therefore, has raised the above dispute.

(ii) The petitioner in the month of July, 2018 was on ESI leave, i.e., from 07-07-2018 to 27-07-2018 and the same was accepted by him in his complaint and further, the petitioner had worked only for 6 days of July, 2018. The petitioner had received an advance of ` 2,000 from the respondent and in fact, the petitioner is in arrears to the respondent and there is no any balance in the salary of the petitioner, payable by the respondent. The respondent company is a tiny unit and only nine employees are engaged in its unit and respondent unit is not covered under the Provident Fund Act and hence, there is no any deduction made by the respondent towards the provident fund, as it is not a mandatory to the respondent unit. On 26-07-2018, the respondent had conducted an internal inquiry against the petitioner for the charges of mishandling of funds (with its customer namely SVS Oil mills and also with the respondent's management). Non-maintaining of the vehicle entrusted to him and non-mentioning about the availing of the ESI leave and at that time of the said enquiry, the petitioner had abruptly left the office of the respondent without giving his explanations to the management and from that day he has not turned to the office of the respondent till date. The management has not asked the petitioner to quit the job or denied his employment at any point of time and he himself had left the job without any intimation. The petitioner has raised the allegations as against the respondent only with an intention to drag money from the respondent and to harass the respondent. Hence, prayed for the dismissal of the petition with exemplary costs.

4. Points for consideration:

1. Whether the respondent informed the petitioner to quit the job and thereby failed to provide work to the petitioner?

2. Whether the petitioner has abandoned the job

on his own?

3. Whether the petitioner is entitled for the reliefs

as claimed in the claim petition?

5. On Points 1 to 3:

7. Whereas, the respondent admitted that the petitioner was working in the respondent company as Driver but, denied the contention of the petitioner that the petitioner worked for six years. It is the specific contention of the respondent that the petitioner had worked in the respondent company as Driver only for the period from 21-05-2014 to 27-07-2018 that is for four years and two months and therefore, as the petitioner was not in service for full period of 5 years, the petitioner is not eligible for gratuity benefits. The further contention of the respondent is that in the month of July, 2018, the petitioner had availed ESI leave from 07-07-2018 to 27-07-2018 and therefore, in July, 2018 the petitioner had worked only for 6 days and further had received advance from the respondent company and the same had to be repaid to the respondent and hence, there is no any balance in the salary to be paid by the respondent to the petitioner. The respondent's further contention is that the respondent company is a small unit with nine employees and hence, the respondent has not deducted any amount from the workman towards provident fund subscription and therefore, the respondent is not liable to pay any amount towards provident fund and further on 26-07-2018 when the respondent had conducted internal enquiry with the petitioner towards mishandling of funds and not maintaining the vehicle entrusted to him and for not informing about the ESI leave availed by him at that time the petitioner abruptly left the office without giving any explanation and at no point of time, the respondent had informed the petitioner to quit the job and it is the petitioner who had left the job without any intimation and thereafter, has raised this dispute to grab money from the respondent.

deserted the job from the respondent company and hence, in the said circumstances, the contention of the petitioner that the respondent directed the petitioner to quit job and thereby the respondent failed to give job to the petitioner is unsustainable one.

8. Thus, in this case it is admitted by both parties that the petitioner had been working as Driver in the respondent company. The contention of the petitioner is that he had been working in the respondent company for six years and thereafter the respondent informed the petitioner to quit the job and whereas, the contention of the respondent is that the petitioner was working as Driver in the respondent company for four years and two months that is from 21-05-2014 to 27-07-2018 and thereafter, when the respondent questioned the petitioner regarding his mishandling of funds and other improper maintenance of vehicle the petitioner had abruptly left the office without giving any explanation and thereafter, has abandoned the job on his own. When the petitioner contend that he had worked for period of six years in the respondent company it is found that the petitioner had not produced any single documents on his side and more particularly regarding his employment and further, the petitioner has not stated any reason as to why the petitioner has not produced any single document pertaining to his job and apart from that the petitioner has also not taken any steps to direct the respondent to produce documents pertaining to his employment. It is admitted by both sides that petitioner had worked in the respondent company till July, 2018 and in the said context it is found that the petitioner has failed to prove that he had been working in the respondent company prior to 2014 and more particularly for the period from 2012 onwards so as to accept the contention of the petitioner that he had worked in the respondent company for more than six years. Hence, in the said circumstances this Court holds that the petitioner is found to have worked in the respondent company from 21-05-2014 to 27-07-2018 and thereby the period of service of the petitioner in the respondent company is only less than five years as contended by the respondent.

10. The other contention of the petitioner is that the petitioner is entitled for EPF benefits for the period from July, 2018 to till date. It is the contention of the respondent that in the respondent company there are only nine workers and therefore, no amount has been deducted towards PF subscription. The petitioner also during his cross-examination as P.W.1 has deposed that he does not know whether in the respondent company there were only 9 workers and therefore, there was no necessity to deduct any amount towards PF and ESI. However, this Court finds that it is the categorical admission of the respondent that the petitioner was on ESI leave from 07-07-2018 to 27-07-2018. This Court finds that a workman would be entitled for ESI leave only when the company or organization is registered with Employees State Insurance Corporation and further, such registration would be done when the organization or establishment has 10 or more employees. Therefore, when the respondent admits that the petitioner was on ESI leave then it is to be inferred that the respondent company was registered with Employees State Insurance Corporation and further, such registration would have been done only when there were 10 or more employees and hence, in the said context the contention of the respondent that the respondent company was a small unit with nine workmen and thereby no amount towards PF and ESI was deducted is unacceptable only. However, in this case the petitioner is found to have abandoned the job on his own from July, 2018 and therefore, in such case this Court holds that the petitioner is not entitled for ESI benefits and also bonus for the period from July, 2018 onwards.

11. Thus, this Court on considering the above submissions and discussions holds that the industrial dispute raised by the petitioner is not justified and the petitioner is not entitled for any claim as prayed in the claim petition.

In the result, this petition is dismissed. There is no

order as to costs.

9. This Court finds that as per Gratuity Act to claim gratuity the employee had to put in 5 years of service. Therefore, a qualifying period of 5 years of service is required for entitlement of gratuity, but, in this case the petitioner is found to have worked for a period less than five years and therefore, in the said context the contention of the respondent that the petitioner is not entitled for gratuity is found to be acceptable one. The next contention of the petitioner is that the petitioner was informed to get away from the respondent company and thereby the respondent has directed the petitioner to quit the job, but, however during the cross-examination the P.W.1 clearly admits that he himself has left the company on his own as the husband of the Managing Director scolded the petitioner. Thus, from the categorical admission made by the P.W.1, this Court holds that it is the petitioner who himself has

1. Period of deputation : The period of deputation is with effect from the date of joining, i.e., from the forenoon of 27-03-2024 to 26-03-2026 or till the necessity therefor ceases, whichever is earlier.

2. Pay, Dearness Allowance and other allowances : The Pay of the Officer will be regulated in consultation with Department of Personnel Training, Government of India, as the Officer has opted for deputation from the Level-14 to Level-13 of the Pay Matrix. Until such time, the Officer will be allowed to draw Pay in Level-13 corresponding to his present Pay in Level-14 and difference if, any may be allowed to draw as personal Pay.

3. Leave : During the period of deputation, he will continue to be governed by the leave rules applicable to him in his parent Department. 9. Provident Fund : During the period of deputation, he will continue to subscribe to the Provident Fund on his parent Department to which he may be subscribing when he is placed on deputation, in accordance with the rules of such fund.

10. Leave Travel Concession : During the period of deputation, he will be entitled to Leave Travel Concession as admissible under the Central Government Rules, the liability in this regard being borne by the borrowing authority.

11. Medical Facilities : During the period of deputation, he will be entitled to medical facilities and educational concession not inferior to those, he would have enjoyed had he remained in the service of the Government.

12. Residential accommodation : He will be entitled to residential accommodation according to the rules of the Government/borrowing authority to which he is deputed. No free house or free car will be allowed, nor is any conveyance provided at Government expense, unless such benefits are normally attached as a condition of service to the post to which he is deputed.

13. Deputation period : The deputation period will
