[725]726 LA GAZETTE DE L'ETAT [29 October 2024 GOVERNMENT OF PUDUCHERRY LABOUR DEPARTMENT (G.O. Rt. No. 82/Lab./AIL/S/2024, Puducherry, dated 01st October 2024)
NOTIFICATION
Whereas, the Government is of the opinion that an industrial dispute has arisen between the management of M/s. Superfil Products (P) Ltd., Mangalam, Puducherry and Superfil Products Workers Union, over payment of Ex gratia amount @ 11.67% to the petitioners Thiruvalargal M. Umapathy, K. Muthusamy and C. Murugan on par with other employees for the period of April 2021 to March 2022 and bonus for 4 months on pro rata basis for the year 2022-2023, in respect of the matter mentioned in the Annexure to this order;
And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;
Now, therefore, by virtue of the authority delegated vide G.O. Ms. No. 20/9/Lab./L, dated 23-5-1991 of the Labour Department, Puducherry, to exercise the powers conferred by clause (d) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by the Secretary to Government (Labour) that the said dispute be referred to the Industrial Tribunal, Puducherry for adjudication. Industrial Tribunal, Puducherry, shall submit the Award within 3 months from the date of issue of reference as stipulated under sub-section (2-A) of section 10 of the Industrial Disputes Act, 1947 and in accordance with rule 10-B of the Industrial Disputes (Central) Rules, 1957. The party raising the dispute shall file a statement of claim complete with relevant documents, list of reliance and witnesses to the Industrial Tribunal, Puducherry, within 15 days of the receipt of the order of reference and also forward a copy of such statement to each one of the opposite parties involved in the dispute.

(a) Whether the industrial dispute raised by the petitioners' Union Superfil Products Workers Union (Reg. No. 1228/RTU/2000) against the management of M/s. ORDER
Whereas, Thiru Subramanian, son of Arumugam and Tmt. Sarojini Ammal @ Tilly, wife of Subramanian have executed a Will Deed, dated 29-01-2010 and registered as Document No. 24 of 2010, dated 01-02-2010 in Book-III of the Office of the District Registrar, Puducherry, bequeathing the schedule mentioned property belonging to them;
2. And whereas, the Testators of the Will Deed, Tmt. Sarojini Ammal @ Tilly and Thiru Subramanian have expired on 14-01-2024 and 24-01-2024, respectively and thereby the Will came into effect after the demise of Testators;
3. And whereas, in their Will, the Testators have bequeathed the schedule mentioned property to the Government of Puducherry for establishment of Library in the name of "Sarojini @ Tilly-Dr. Subramanian";
4. And whereas, the Deputy Collector (Revenue), North, Puducherry vide letter, dated 22-08-2024 has reported that the Patta for the schedule mentioned property stands in the name of Saraswathi @ Sarojini, wife of Subramanian vide Patta No. 840 and there exists a single-storeyed RCC building over the said property and the property is free from encumbrances;
5. And whereas, the Director, Department of Art and Culture, Government of Puducherry vide I.D. Note, dated 27-08-2024, has conveyed willingness to establish a Government Branch Library in the scheduled mentioned property donated by the Testators;
6. Now therefore, the approval of the Lieutenant-Governor, Puducherry, is hereby accorded for transfer of the donated property, more particularly described in the Schedule hereunder, in favour of the Department of Art and Culture, Government of Puducherry, for establishment of Library in the name of "Sarojini @ Tilly-Dr.Subramanian".

The Lieutenant-Governor, Puducherry, is pleased to appoint Smt. R. Nivedita, who has been allotted to the Pondicherry Civil Service by DoPT, Government of India, on the basis of the results of Civil Services Examination-2023, to the Grade-II of Pondicherry Civil Service, with effect from the forenoon of 30-09-2024, subject to the conditions mentioned in the Department's letter of offer of Appointment No. A.19011/07/2024/ DPAR/SS-I(2), dated 20-08-2024.

3. Smt. R. Nivedita, PCS Probationer shall take the Oath of Allegiance before the Deputy Secretary to Government (Establishment), Chief Secretariat, Puducherry and furnish surety bond in the prescribed pro forma within ten days from the date of this Notification.
