3. Report of the Sub-Collector (Revenue) North, Puducherry vide Letter Nos. 1504 and 6438/ SC(R)N/A7/PB/2025/2674, dated 09-10-2025.

Whereas, an application, dated 05-02-2025 was received from Tmt. Indira, M/s. Indira Bankers, No. 34, Sivasakthi Complex, Thendral Nagar, New Saram, Puducherry – 605 013, a licensed Pawn Broker (L.No. 666), requesting permission of the District Magistrate to sell unredeemed and time barred articles in public auction;

2. And whereas, the list of unredeemed and time-barred articles submitted by the Pawn Broker was forwarded to the Sub-Collector (Revenue) - North, Puducherry, for causing physical verification of the articles and ascertain that they remain unredeemed after the time allowed for redemption;

3. And whereas, the Sub-Collector (Revenue) - North, Puducherry, has furnished the report vide Reference (3) cited, stating that the Tahsildar, Taluk Office, Oulgaret, Puducherry, had conducted physical verification of the articles that are unredeemed and time-barred pledged with of Tmt. Indira, Pawn Broker (L.No. 666), M/s. Indira Bankers, No. 34, Sivasakthi Complex, Thendral Nagar, New Saram, Puducherry – 605 013 and reported that the articles mentioned in the application remained unredeemed past the time allowed and the articles are kept in the licensed premises itself except the twenty-eight items vide Catalogue Nos. 19, 56, 60, 61, 63, 69, 81, 84, 85, 94, 97, 100, 101, 103, 118, 122, 123, 124, 145, 163, 165, 167, 170, 176, 182, 184, 185 and 188 of the list, which were redeemed subsequently, after the application of the Pawn Broker cited at reference (1);

4. And whereas, the rule 12 of the Puducherry Pawn Brokers Rules, 1966 prescribes detailed procedure on auctioning of pledges;

5. Now, therefore, Thiru B. Karthikeyan, Thirupathiripuliyur, Authorised Auctioneer, is permitted to conduct within 60 days from the date of receipt of this Order, the sale of time-barred and unredeemed pledged articles, as shown in the list enclosed and available with the Pawn Broker, Tmt. Indira, Pawn Broker (L.No. 666), M/s. Indira Bankers, No. 34, Sivasakthi Complex, Thendral Nagar, New Saram, Puducherry – 605 013, in public auction in the licensed premises of the Pawn Broker at the above address, as per the list approved and sent to the Pawn Broker and the Auctioneer, except the twenty-eight items vide Catalogue Nos. 19, 56, 60, 61, 63, 69, 81, 84, 85, 94, 97, 100, 101, 103, 118, 122, 123, 124, 145, 163, 165, 167, 170, 176, 182, 184, 185 and 188 of the list, which were redeemed. The Pawn Broker and Auctioneer shall observe the above formalities detailed as required under the rules framed under the Puducherry Pawn Brokers Act, 1966, before conducting the sale of time-barred and unredeemed pledged articles in the public auction. Further, the Authorised Auctioneer is directed to furnish the details of the successful bidders with their PAN numbers, along with particulars of the auctioned articles, their pawned amount and the sale amount, to this office within 15 days of the conduct of the auction:

Whereas, the manufacture, storage, distribution or

sale of Gutkha and Pan Masala and any other food

And whereas, Regulation 2.3.4. of the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, prohibits and restricts the sale of food products which contain tobacco and nicotine as ingredients as they are injurious to health;

being renewed periodically, the last Notification having

And whereas, it has been brought to notice that, of late, the banned food products containing tobacco or nicotine as ingredients which are injurious to health are sometimes/occasionally available in the market in contravention of the provisions of the Food Safety and Standards Act, 2006 (Central Act 34 of 2006) and the rules made thereunder;

And whereas, in the public interest, it is expedient to prohibit consumption of Gutkha and Pan Masala in the Union territory of Puducherry, being the food products in which tobacco and nicotine are widely used as ingredients;

And now, therefore, in exercise of the powers conferred by clause (a) of sub-section (2) of section 30 of the Food Safety and Standards Act, 2006 (Central Act 34 of 2006), the Commissioner of Food Safety of the Union territory of Puducherry, in the interest of public health, hereby prohibits the manufacture, storage, distribution or sale of Gutkha and Pan Masala (containing tobacco or nicotine), and any other products marketed separately to constitute as Gutkha or Pan Masala as final product, by whatsoever name called, whether packaged or unpackaged and/or sold as one product, or through packaged as separate products, sold or distributed in such a manner so as to easily facilitate mixing by the consumer in the whole of the Union territory of Puducherry, for a further period of one year from 18-11-2025.

2. The State Food Commission of the Union territory of Puducherry shall exercise of the following functions, namely:–

(a) Monitor and evaluate the implementation of this Act, in relation to the State.

(b) Either sue motto or on receipt of complaint inquire into violations of entitlements provided under Chapter-II of the Act.

(c) Give advice to the State Government on effective implementation of this Act. (d) Give advice to the State Government, their agencies, Autonomous Bodies as well as Non-Government Organisations involved in delivery of relevant services, for the effective implementation of food and nutrition related Schemes, to enable individuals to fully access their entitlements specified in this Act. (e) Here appeals against orders of the District Grievance Redressal Officer.

(f) Prepare annual reports which shall be laid before the State Legislature by the State Government.

3. The service conditions of the Food Commission of the Union territory of Puducherry are detailed in the Puducherry Food Security Rules, 2017.
