NOTIFICATION

No. 18/04/2020-5hg2/1543.-Whereas the Industrial Policy 2003 provided concessions for setting up of Mega Housing Projects in the State of Punjab.
1. Whereas Mega Housing project of M/s Omaxe Ltd. for an area of 42 acres falling in villages Thakarwal & Dad, Teh. & Distt. Ludhiana was approved by the Empowered Committee in its meeting held on 28-02-2006.
Accordingly, Letter of intent was issued by the Chief Administrator, PUDA to this promoter vide Memo No. PUDA/ACA (Pr.) 2006/17360 dated 27-04-2006 and agreement was signed on behalf of the Government on 01-06-2006. Subsequently, Supplementary Agreement was signed on 29-10-2014 for an additional area of 14.613 acres, on 20-03-2018 for an area of 0.396 and on 06-03-2019 for an additional area of 2.421 acres, amounting to a total area of 59.430 acres. As per report of Chief Town Planner, Punjab, net planned area of this project as on today is 58.700 acres.
2. Whereas exemption under section 44(2) of Punjab Apartment and Property Regulation Act, 1995 has already been granted by the Government for 56.281 acres of area of this project vide Notification No. 18/13/2018-5hg2/1267671/6 dated 10-07-2018.
3. Now, therefore, in exercise of the powers vested under section 44 (2) of the Punjab Apartment & Property Regulation (Amendment) Act, 2014, exemption is hereby granted for remaining 2.419 acres of land of this project from the provisions of this Act except section 5 (11), Sections 6 to 20, Section 32 and Sections 36 to 39, subject to the same terms and conditions as mentioned in exemption notification No.18/13/2018-5hg2/1267671/6 dated 10-07-2018.
The promoter shall atrictly abide by the aforesaid legal agreements executed with the Government of Punjab as well as Instuctions/Notifications issued by the Government or Department of Housing & Urban Development, from time to time.
