NOTIFICATION

No. 06/14/2003-1HG1(P.F)/395.-Whereas the land acquisition proceedings which were initiated vide notifications no. 6/14/2003-1HG1/320 dated 14.01.2005 & no. 6/14/2003-1HG1/324 dated 14.01.2005 issued under section 4 and notification no. 6/14/2003-1HG1/647 dated 25.01.2005 issued under Section 6 read with section 17(2)(4) of the Land Acquisition Act, 1894 (since repealed) for acquisition of land measuring 10.05 Acre of Village Mauli Baidwan and 47.3645 acres of Village Raipur Khurd (Total Area 57.4145 Acre) for the public purpose namely for the strip for laying out-Fall Sewer (Storm Sewer and Sullage Sewer) passing from Village Mauli Baidwan & Raipur Khurd in the area of Tehsil Mohali, District Roopnagar, now Sahibzada Ajit Singh Nagar.
Whereas after consideration, it has come forth that out of this 57.4145 acre of land under acquisition, an area measuring 43.482 acres falls in the area of Institutional Zone & forms part of Sector-84, Sahibzada Ajit Singh Nagar, which was notified for the Strip for Laying out-fall Sewer (Storm Sewer and Sullage Sewer), as such this 43.482 acres of land falling in Sector-84 was withdrawn vide notification no. 6/14/2003-6HG1/449815/1 dated 30.03.2015 U/s 93(1) of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 .
Whereas after issuance of the above said notification, the award of balance land of Village Mauli Baidwan measuring 58 Kanal 1 Marla and Village Raipur Khurd measuring 32 Bigha 1 Biswa was announced vide Award No. 563 dated 23.12.2015. Now while laying of Storm Sewer and Sullage Sewer it was found that land measuring 0-14 Marla falling in two Khasra no's 39//21/2/1 and 45//2 of Village Mauli Baidwan still falls outside this strips which is not required for the Public Purpose. As such Government of Punjab has decided to withdraw the acquisition of 14 Marla of land involved in the aforementioned Khasra No. of Village Mauli Baidwan.
Now, therefore, in exercise of powers conferred under Section 93(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the Governor of Punjab is pleased to withdraw the land Acquisition proceedings in respect of 14 Marla of land falling in Village Mauli

ਨੰ. 06/14/2003-1ਮਉ1(ਪ.ਫ)/395.-ਭੋਂ ਪ੍ਰਾਪਤੀ ਦੀ ਕਾਰਵਾਈ ਅਧਿਸੂਚਨਾ ਨੰ. 06/14/2003-1ਮਉ1/320 ਮਿਤੀ 14.01.2005 ਅਤੇ ਨੰ. 06/14/2003-1ਮਉ1/324 ਮਿਤੀ 14.01.2005 ਨੂੰ ਧਾਰਾ 4 ਅਧੀਨ ਜਾਰੀ ਕੀਤੀ ਗਈ ਸੀ ਅਤੇ ਅਧਿਸੂਚਨਾ ਨੰ. 06/14/2003-1ਮਉ1/647 ਮਿਤੀ 25.01.2005 ਜੋ ਕਿ ਧਾਰਾ (6) ਅਤੇ ਧਾਰਾ 17 (2) (4) ਭੋਂ ਪ੍ਰਾਪਤੀ ਐਕਟ, 1894 (ਜੋ ਕਿ ਬਦਲ ਚੁੱਕਾ ਹੈ) ਦੇ ਅਧੀਨ ਪਿੰਡ ਮੌਲੀ ਬੈਦਵਾਨ ਦੀ 10.05 ਏਕੜ ਅਤੇ ਪਿੰਡ ਰਾਏਪੁਰ ਖੁਰਦ ਦੀ 47.3645 ਏਕੜ ਰਕਬੇ ਦੀ ਜਮੀਨ (ਕੁੱਲ 57.4145 ਏਕੜ) ਜਨਤਕ ਮੰਤਵ ਲਈ ਐਕੁਆਇਰ ਕੀਤੀ ਗਈ ਸੀ। ਇਹ ਜਮੀਨ ਸਟੌਰਮ ਵਾਟਰ ਅਤੇ ਸਲੇਜ਼ ਸੀਵਰ ਦੇ ਨਿਕਾਸੀ ਲਈ ਸੀ, ਜੋ ਕਿ ਪਿੰਡ ਮੌਲੀ ਬੈਦਵਾਨ ਅਤੇ ਰਾਏਪੁਰ ਖੁਰਦ ਤਹਿਸੀਲ ਮੋਹਾਲੀ ਜਿਲ੍ਹਾ ਰੂਪਨਗਰ ਹੁਣ ਸਾਹਿਬਜਾਦਾ ਅਜੀਤ ਸਿੰਘ ਨਗਰ ਵਿੱਚੋਂ ਲੰਘਦੀ ਹੈ।
ਵਿਚਾਰ ਵਟਾਂਦਰੇ ਤੋਂ ਬਾਅਦ ਇਹ ਸਾਹਮਣੇ ਆਇਆ ਹੈ ਕਿ ਭੋਂ ਪ੍ਰਾਪਤੀ ਦਾ ਰਕਬਾ ਜੋ ਕਿ ਕੁੱਲ 57.4145 ਏਕੜ ਹੈ, ਵਿੱਚੋਂ 43.482 ਏਕੜ ਰਕਬਾ ਵਿਦਿਅਕ ਸੰਸਥਾਵਾਂ ਅਤੇ ਸਾਹਿਬਜਾਦਾ ਅਜੀਤ ਸਿੰਘ ਨਗਰ ਦੇ ਸੈਕਟਰ-84 ਦਾ ਹਿੱਸਾ ਹੈ ਜੋ ਕਿ ਸਟੌਰਮ ਵਾਟਰ ਅਤੇ ਸਲੇਜ਼ ਸੀਵਰ ਦੇ ਨਿਕਾਸੀ ਲਈ ਨੋਟੀਫਾਈ ਕੀਤਾ ਗਿਆ ਸੀ, ਪੰਜਾਬ ਸਰਕਾਰ ਵਲੋਂ ਅਧਿਸੂਚਨਾ ਨੰ. 06/14/2003-1ਮਉ1/449815/1 ਮਿਤੀ 30.03.2015 ਨੂੰ "ਰਾਈਟ ਟੂ ਫੇਅਰ ਕੰਪਨਸੇਸ਼ਨ ਅਤੇ ਟਰਾਂਸਪੇਰੈਂਸੀ ਇੰਨ ਲੈਂਡ ਐਕੁਜੀਸ਼ਨ, ਰੀਹੈਬਲੀਟੇਸ਼ਨ, ਰੀਸੈਟਲਮੈਂਟ ਐਕਟ 2013@ ਭੋਂ ਪ੍ਰਾਪਤੀ ਐਕਟ ਦੀ ਧਾਰਾ 93 (1) ਦੇ ਅਨੁਸਾਰ 43.482 ਏਕੜ ਰਕਬੇ ਨੂੰ ਡੀ-ਨੋਟੀਫਾਈ ਕਰ ਦਿੱਤਾ ਗਿਆ ਸੀ।
ਜਦੋਂ ਕਿ ਉਪਰੋਕਤ ਅਧਿਸੂਚਨਾ ਦੇ ਹੋਣ ਦੇ ਬਾਅਦ ਬਚਦੇ ਰਕਬੇ ਜੋ ਕਿ ਪਿੰਡ ਮੌਲੀ ਬੈਦਵਾਨ ਦਾ 58 ਕਨਾਲ 1 ਮਰਲਾ ਅਤੇ ਪਿੰਡ ਰਾਏਪੁਰ ਖੁਰਦ ਦਾ 32 ਬਿੱਘਾ 1 ਬਿਸਵੇ ਸੀ, ਦਾ ਅਵਾਰਡ ਜੋ ਕਿ ਅਵਾਰਡ ਨੰ. 563 ਮਿਤੀ 23.12.2015 ਨੂੰ ਸੁਣਾ ਦਿੱਤਾ ਗਿਆ ਸੀ। ਹੁਣ ਸਟਰੋਮ ਸੀਵਰ ਅਤੇ ਸਲੇਜ਼ ਸੀਵਰ ਦੇ ਕੰਮ ਸ਼ੁਰੂ ਕਰਨ ਉਪਰੰਤ ਇਹ ਪਾਇਆ ਗਿਆ ਹੈ ਕਿ 0-14 ਮਰਲੇ ਦਾ ਰਕਬਾ ਜੋ ਕਿ ਖਸਰਾ ਨੰ. 39//21/2/1 ਅਤੇ 45//2 ਪਿੰਡ ਮੌਲੀ ਬੈਦਵਾਨ ਵਿੱਚ ਪੈਂਦਾ ਹੈ, ਅਲਾਈਨਮੈਂਟ ਤੋਂ ਬਾਹਰ ਹੈ ਜਿਸ ਨੂੰ ਐਕੁਆਇਰ ਕਰਨ ਦੀ ਲੋੜ ਨਹੀਂ ਹੈ। ਪੰਜਾਬ ਸਰਕਾਰ ਵਲੋਂ ਉਕਤ ਖਸਰੇ ਅਧੀਨ ਪੈਂਦੀ 14 ਮਰਲੇ ਜਮੀਨ ਨੂੰ ਡੀ-ਨੋਟੀਫਾਈ ਕਰਨ ਦਾ ਫੈਸਲਾ ਲਿਆ ਹੈ।
ਇਸ ਲਈ ਹੁਣ "ਰਾਈਟ ਟੂ ਫੇਅਰ ਕੰਪਨਸੇਸ਼ਨ ਅਤੇ ਟਰਾਂਸਪੇਰੇਂਸੀ ਇੰਨ ਲੈਂਡ ਐਕੁਜੀਸ਼ਨ, ਰੀਹੈਬਲੀਟੇਸ਼ਨ, ਰੀਸੈਟਲਮੈਂਟ ਐਕਟ 2013@ ਭੋਂ ਪ੍ਰਾਪਤੀ ਐਕਟ 2013 ਦੀ ਧਾਰਾ 93 (1) ਦੇ ਅਧੀਨ ਦਿੱਤੇ ਗਏ ਅਧਿਕਾਰਾਂ ਦੀ ਵਰਤੋਂ ਕਰਦੇ ਹੋਏ ਪੰਜਾਬ ਦੇ ਰਾਜਪਾਲ ਵਲੋਂ 14 ਮਰਲੇ ਦੀ ਭੋਂ ਜੋ ਕਿ ਪਿੰਡ ਮੌਲੀ ਬੈਦਵਾਨ, ਸਾਹਿਬਜਾਦਾ ਅਜੀਤ ਸਿੰਘ ਨਗਰ ਵਿੱਚੋਂ ਪ੍ਰਾਪਤ ਕੀਤੀ ਗਈ ਸੀ, ਨੂੰ ਰੱਦ/ਡੀ-ਨੋਟੀਫਾਈ ਕੀਤਾ ਜਾਂਦਾ ਹੈ। ਜਿਸ ਦਾ ਵੇਰਵਾ ਹੇਠ ਅਨੁਸਾਰ ਹੈ-
