NOTIFICATION

The 15th November, 2023

File No.E-490642/IW2/400.– 1.0 It is observed that in the State of Punjab due to rapid urbanization and other reasons, certain Command Areas(Irrigable through water courses managed by the Department of Water Resources) have become Uncommand areas, where water for the purpose of irrigation is not required. However, many cases for conversion from Command areas to Uncommands areas are pending decision with the field canal divisions. The Executive Engineers, who are to decide these cases at present, are occupied in otherimportant departmental assignments entrusted to them which causeda considerable delay in the disposal of such cases.

As a result, beneficiaries are anxious for the expeditious disposal of such cases. Therefore, with a view to expeditious disposal of such cases, in public interest, the Governor of Punjab is pleased to delegate powers to the concerned Deputy Collectors to decide such cases i.e. converting the Command Areas into Uncommand Areas.

2.0 After conversion of Command Areas into Un-command areas, the process of Warabandi for distribution of water to the fields falling in Command areas is alsorequired to be completed simultaneously. Therefore, the Governor of Punjab is further pleased to authorize the concerned Deputy Collectors for re-determination of appropriate Warabandi for the remaining Command areas.

3.0 For this purpose, the Deputy Collectors shall observe the procedure as laid down in section 68 of the Northern India Canal and Drainage Act, 1873 (as applicable in the State of Punjab).

4.0 Henceforth, all such pending cases shall be disposed of in accordance with these orders
