GOVERNMENT OF PUNJAB DEPARTMENT OF WATER RESOURCES

NOTIFICATION

The 5th March, 2024

No. 1478/works.–

1.0 In section 68 of the North Indian Canal and Drainage Act, 1873 (Hereinafter shall be referred to as the 'Said Act'), the Deputy Collectors working in the Department of Water Resources have been given certain powers in respect of use or distribution of water and settlement of differences as to mutual rights and liabilities of persons interested in water-course.

2.0 In the recent developments, the Kandi canal has successfully been made operational and is running as per its designed capacity. Being a new system the warabandi process for distribution of water from the aforesaid canal is yet to be completed, which is likely to consume some time. In the meanwhile due to these technicalities, the farmers and other users are likely to be deprived of the use of waters from the Kandi Canal. The powers to finalize the process of warabandi vests with the Deputy Collectors.

3.0 As a result thereof and in the absence of completion of warabandi process, the farmers and other users would find it difficult to take water from the said Kandi Canal. Therefore, in order to remove such difficulties and technicalities and with a view to provide water from the said Canal immediately in the public interest, it is considered expedient to authorize the Sub Divisional Officers to exercise the powers of Deputy Collectors as laid down in section 68 of the North Indian Canal and Drainage Act, 1873.Therefore, the Governor of Punjab is pleased to authorize the concerned Sub Divisional Engineers in addition to their own duties and responsibilities to exercise the powers of the Deputy Collectors as laid down in section 68 of the 'Said Act' in respect of Warabandi and to provide water from the Kandi Canal being managed by the Department of Water Resources subject to the condition that the concerned Sub Divisional Engineers shall adhere to the procedure as laid down in sections 68 and 69 of the Northern India Canal and Drainage Act, 1873.

4.0 Further in order to expeditious disposal of other incidental matter, the Governor of Punjab is further pleased to authorize the concerned Junior Engineers in addition to their own duties to perform the duties and responsibilities attached with the Canal Patwaris relating to warabandi process relating to the Kandi Canal. 5.0 This notification shall come into force on and with effect from the date of its publication in the Official Gazette.
