proviso to rule 121 of the Rules of Procedure and Conduct of Business in the

BILL
further to amend the Punjab State Election Commission Act, 1994.
BE it enacted by the Legislature of the State of Punjab in the Seventy-
fifth Year of the Republic of India as follows: -
1. (1) This Act may be called the Punjab State Election Commission Short title and commencement.

(2) It shall come into force on and with effect from the date of its
publication in the Official Gazette.
2. In the Punjab State Election Commission Act, 1994, for section
129, the following section shall be substituted, namely:-
Substitution of section 129 in Punjab Act 19 of 1994.
"129. (1) The authorities specified in sub-section (2) shall,when so
requested by the State Election Commissioner or a
District Electoral Officer, make available to any
Returning Officer, such staff, as may be necessary
Staff of certain authorities to be made available for election work. for the performance of any duties in connection with
an election.
(2) The following shall be the authorities for the purposes of sub-
section (1), namely:-
(i) every local authority;
(ii) every university established or incorporated by or
under a Central, Provincial or State Act;
(iii) a Government Company as defined in clause (45)
of section 2 of the Companies Act, 2013; and
(iv) any other institution, concern or undertaking which is
established by or under a Central, Provincial or State
Act, or which is controlled or financed wholly or
substantially by funds provided, directly or indirectly,
by the Central Government or a State Government."

STATEMENT OF OBJECTS AND REASONS
The object of the proposed Punjab State Election Commission
(Amendment) Bill, 2024 is to amend section 129 of the Punjab State Election
Commission Act, 1994, on the analogy of the provision of section 159 of the
Representation of People Act, 1991.
2. The purpose for the amendment of this section, is to make available
the staff of every local authority including every university established or
incorporated by or under a Central, Provincial or State Act, a Government
company as defined in the Companies Act, 2013 and any other institution,
concern or undertaking which is established by or under a Central, Provincial
or State Act or which is controlled or financed wholly or substantially by
funds provided, directly or indirectly by the Central Government or a State
Government, in a district, shall, when so requested by the District Electoral
Officer or any other officer of any department of the State Government, as
may be necessary, in connection with conduct of Municipal/Panchyat election
duties in the State of Punjab.
