NOTIFICATION
The 19th Februray, 2025
No. S.O.16/C.A.43/1995/S.14/2025.- Whereas the State
Government is satisfied that no Muslim member(s) belonging to the categories
mentioned in sub-clauses (i), (iii) and (iv) of clause (b) of sub-section (1) of
section 14 of the Waqf Act, 1995 (Central Act No. 43 of 1995), is available and
as such, it is not practicable to constitute an electoral college for any of these
categories. At present, only one member of the Punjab Legislative Assembly
is available namely Dr. Mohammad Jamil Ur Rehman, MLA Malerkotla, who
is a Muslim and who can be a member of the Punjab Waqf Board under sub-clause
(ii) of clause (b) of sub-section (1) of section 14 of the said Act.
And whereas as per the second proviso to sub-section (2) of
section 14 of the aforesaid Act, where there are no Muslim members in any of the
categories mentioned in sub- clauses (i) to (iii) of clause (b) of sub section (1), the
Ex-Muslim members of Parliament, the State Legislature or ex-member of the
State Bar Council, as the case may be, shall constitute the Electoral College for
election of chairperson from amongst the members of the Electoral College. It is
unnecessary culture that the Electoral College must be multi-members. Otherwise
also, in the present circumstances, as mentioned above, the Electoral College shall
comprise of a single member only.
Now, therefore, in supersession of Government of Punjab,
Department of Home Affairs and Justice, notification No.HOME-CDR206MC/
114/2023-2CD/226, dated the 16th March, 2024 and in exercise of the powers
conferred by sub-section (3) of section 14 of the Waqf Act, 1995, and all other
powers enabling him in this behalf, the Governor of Punjab is pleased to nominate
the following persons as members of the Punjab Waqf Board, with immediate
effect, namely:-
