G.S.R.37 .-In exercise of the powers conferred by section 36 of the Rajasthan Agricultural Produce Markets Act 1961 (Act No. 38 of 1961) , the State Government hereby makes the following rules further to amend the Rajasthan Agricultural Produce Markets Rules ,1963 and orders with reference to the proviso to sub- section (4) of the said section, that the previous publication of these rules is dispended with as the State Government considers that they should be brought into force at once, namely:-

1. Short title and commencement.- (1) These rules may be called the Rajasthan

Agricultural Produce Markets ( Amendment ) Rules, 2025.

(2) They shall come into force at once .

2. Insertion of new rule 56-AA.- After the existing rule 56-A and before the existing rule 56-B of the Rajasthan Agricultural Produce Markets Rules, 1963, hereinafter referred to as the said rules, the following new rule 56-AA shall be inserted, namely :-

"56-AA. Declaration of warehouse, cold storage or silos as private sub-market yard.- (1) The licensee of any warehouse, cold storage or silos, as the case may be, registered with Warehouse Development Regulatory Authority (WDRA), desirous of declaration of such place as private sub market yard, hereinafter referred to as the deemed private sub-market yard, may apply to the Director or an officer authorised by him in form XI-A with such fee as may be specified by order issued by the State Government, from time to time. (2) The Director or such officer authorized by him shall, on receipt of application, scrutinise the application within a period of thirty days and after satisfaction, the Director or such officer shall inform the applicant to deposit the license fee, within a period of thirty days by way of demand draft payable at Jaipur in favour of Director, Agriculture Marketing. On receipt of license fee, the Director or such officer may issue licence in Form XII-A. The licence may be issued for a period upto three years. The licence, on an application made on plain paper and payment of renewal fees as may be specified by the State Government, from time to time, may be renewed for a maximum period of five years at a time. The licence shall be entered in the register in form XXI-A. (3) A bank guarantee as decided by the State Government shall be deposited by the licensee in favour of the Director, Agriculture Marketing, within one month from the date of grant of licence or before commencement of business, whichever is earlier.

(4) The licensee of such deemed private sub market yard shall collect market fee and krishak kalyan fee on notified agricultural produce, transacted at the deemed private sub market yard, at the rate not exceeding the rate as notified by the State Government, from time to time and same shall be deposited to the market committee, concerned as per the provisions of bye laws but no market fee and krishak kalyan fee shall be collected from agriculturist seller. (5) The licensee of such deemed Private Sub Market Yard shall be abide by the Standard Operating Procedure, as specified in bye laws, for conduct of business and activities ancillary thereto via electronic national warehouse receipt through Electronic National Agriculture Market (eNAM) or other registered e-trading platforms."

3. Insertion of new form XI (A).- After the existing form XI and before the existing Form XII appended to the said rules, the following new Form XI-A shall be inserted, namely:- "FORM XI-A

I/We present this application for grant of licence for declaration of deemed private sub- market yard. Particulars of applicant are as under :

4. Name of proprietors/Partners of the firm/Chairman/Director of the Company.

5. If applicant is a company or co-operative society, if so, give registration No. and date.

6. Details of proposed Deemed Private Sub-Market Yard:-

8. Whether the applicant has been a licensee of any market committee of Rajasthan, if so, give following details :

11. I/We shall abide by the provisions of the Rajasthan Agriculture Produce Market Act, 1961, rules, Bye-laws made thereunder and directions issued by the State Government or the Licensing Authority, from time to time.

4. Insertion of new Form XII-A.- After the existing Form XII and before the existing form XIII appended to the said rules, the following new Form XII-A shall be inserted, namely:-

"FORM XII-A [See Rule 56-AA)) Licence for Deemed Private Sub-Market Yard

Licence is here by granted to M/s............................................. .........(name).................................(Address) under rule 56-AA of the Rajasthan Agricultural Produce Markets Rules, 1963 on the terms and conditions mentioned here in under to declare a deemed private Sub-market Yard at……………. in the market area of the Krishi Upaj Mandi Samiti ……………………. . This licence is non-transferable.

Terms and Conditions of Licence (i) The licensee shall comply with the provisions of the Rajasthan Agricultural Produce Markets Act, 1961, and Rules/Bye-laws made thereunder and instructions issued by the licensing authority from time to time.

(ii) The licensee shall surrender his licence on demand to the Director or the Authorised officer against a receipt to be given to the licensee in this connection.

(iii) The licensee shall inform in writing, the names of his assistants/agents/servants to the Licensing Authority within fifteen days from the date of issue of licence and shall be liable for their acts. Any changes in assistants/agents/servants shall be informed to the Licensing Authority within seven days of such change.

(iv) The licensee shall keep records of market functionaries working in the market and shall furnish information every month to the market committee in the manner specified in the Bye-laws.

(v) The licensee of deemed private Sub-market Yard shall provide and maintain all such amenities/facilities viz. electronic weighing machine, water supply, light, sanitation, parking place, kiosks, canteen, first aid and such other amenities as directed by the Licensing Authority from time to time.

(vi) The expenses on the facilities/amenities and for the maintenance thereof shall be borne by the licensee

(vii) Sale of notified agricultural produce and of such other commodities as permitted by the Licensing Authority shall be made in the deemed private Sub-market Yard.

(viii) The Market Committee shall collect fee from the licensees of a Deemed Private Sub- market Yard as per the provisions of the Act /Rules and Byelaws.

(ix) The licensee shall comply with all the instructions issued by the State Government or Licensing Authority, from time to time.

(x) The licensee shall abide by all the provisions of the Rajasthan Agriculture produce Markets Act, 1961, Rajasthan Agriculture Produce Markets Rules, 1963 and Bye-laws made thereunder."

5. Insertion of new form XXI-A.- After the existing form XXI and before the existing form XXII appended to the said rules, the new form XXI-A shall be inserted, namely:-
