आदेश

यतः, भारत नविााचि आयोग की अधधसूचाि सां. 464/राज-वव.स./2023 दाििांक 30 अक्टू बर, 2023 के अुिसरण में 71-नगर ववधाि सभा नविााचि क्षेत्र के शलए राजर्साि ववधाि सभा का साधारण नविााचि, 2023 आयोप्जत ककया गया र्ा; और

यतः, लोक प्रनतनधिधत्व अधधनयिम, 1951 की धारा 78 के अुिसार, ककसी भी नविााचि में नविााचि लड़ेि वाला प्रत्येक अभ्र्यी, नविााधचत अभ्र्यी के नविााचि की तारीख से 30 दोििं के भीतर अपेि नविााचि व्यय के लेखे प्जला नविााचि अधधकारी के पास ािखखल करेगा जो उक्त अधधनयिम की धारा 77 के अांतगात उसके द्वारा या उसके नविााचि अशभकताा द्वारा रखे गए लेखे की एक सत्य प्रनत होगी; और

यतः, राजर्साि के 71-नगर ववधासिभा नविााचि क्षेत्र के शलए नविााचि, 2023 का पररणाम, ररटनंििग अधधकारी द्वारा 03 दसिमबर, 2023 को घोवति ककया गया र्ा और इस प्रकार नविााचि व्यय के लेखे ािखखल करेि की अप्ततम तारीख 02 जविरी, 2024 र्ी; और

यतः, नविााचोिं का सांचालि नयिम, 1961 के नयिम 89 के उप-नयिम (1) के अांतगात, मुख्य नविााचि अधधकारी, राजर्साि से उकिे दाििांक 16.01.2024 के पत्र सां. F3(1)(5)EEM/ELECTION/ Candidates' Exp./433 के तहत प्रातत प्जला नविााचि अधधकारी, भरतपुर की दाििांक 05.01.2024 की ररपोटा के अुिसार, श्री खुशीद अहमद, जो राजर्साि के 71-नगर ववधाि सभा नविााचि क्षेत्र, 2023 से नविााचि लड़ेि वाले अभ्र्यी हैं, ववधध के अांतगात र्यापेक्षक्षत अपेि नविााचि व्यय के लेखे ािखखल करेि में असफल रहे हैं; और52 ्‍राजर्स्‍ाि राज-पत्र,्‍अगस्‍त्‍20,्‍2025्‍ ्‍्‍्‍्‍्‍्‍्‍ ्‍्‍्‍्‍भाग्‍5 (घ) यतः, प्जला नविााचि अधधकारी, भरतपुर की उक्त ररपोटा के आधार पर, भारत नविााचि आयोग द्वारा नविााचोिं का सांचालि नयिम, 1961 के नयिम 89 के उप-नयिम (5) के अांतगात श्री खुशीद अहमद को अपेि नविााचि व्यय के लेखे प्रसतुत हिीां करेि के शलए कारण बताओ ोिदटस सां. 76/राज-वव.स./71 /2023/सीईएमएस- 1 दाििांक 19.03.2024 को जारी ककया गया र्ा; और

ाक्त कारण बताओ ोिदटस के जररए और नविााचोिं का सांचालि नयिम, 1961 के नयिम 89 यतः, उपयु के उप-नयिम (6) के अांतगात, श्री खुशीद अहमद को लेखा ािखखल ि ककए जाेि सांबांधी कारणों को सपष्ट करते हुए आयोग को अपाि अभ्यावेिि शलखखत रूप में प्रसतुत करेि और ोिदटस के प्रातत होेि की तारीख से 20 दोििं के भीतर प्जला नविााचि अधधकारी, भरतपुर प्जला को अपेि्‍नविााच्‍िव्यय्‍के ्‍लेखे्‍प्रसतुत्‍करेि्‍का्‍नेििश्‍ दयिा्‍गयार््‍ा; और

यतः, मुख्य नविााचि अधधकारी, राजर्साि पत्र सां. F3(1)(5)EEM/ELECTION/Candidates' Exp./5486 दाििांक 02.05.2024 के तहत प्रातत प्जला नविााचि अधधकारी, भरतपुर के पत्र दाििांक 16.04.2024 में सूधचत ककया है कक उक्त कारण बताओ ोिदटस श्री खुशीद अहमद के भाई (श्री जमील खााँ) को दाििांक 29.03.2024 को तामील ककया गया र्ा; और

यतः, प्जला नविााचि अधधकारी, भरतपुर ेि पत्र क्रमाांक/नविाा./2024/6694 दाििांक 08.11.2024 एवां पत्र क्रमाांक/नविाा./ईईएम/वव.स.चु. 2023/2025/267 दाििांक 10.06.2025 के द्वारा प्रसतुत की गई अुिपूरक ररपोटा में यह बताया गया है कक श्री खुशीद अहमद ेि नविााचि व्यय का लेखा प्रसतुत हिीां ककया है। इसके अनतररक्त, उक्त ोिदटस की पावती के उपराांत, श्री खुशीद अहमद ेि ववधध के अांतगात र्या-ववदहत लेखे ािखखल करेि में अपीि असफलता के शलए भारत नविााचि आयोग को ि तो कोई कारण बताया है और ि ही कोई सपष्टीकरण दयिा है;

और

यतः, लोक्‍प्रनतनधिधत्व्‍अधधनयिम,्‍1951्‍की्‍धारा्‍10क्‍में्‍यह्‍उपबांधधत्‍ककया्‍गया्‍है्‍ककः- "यदि नविााचि आयोग का समाधाि हो जाता है कक कोई व्यप्क्त-

(क) नविााच्‍िव्ययों्‍का्‍लेखा्‍उस्‍समय्‍के्‍भीर्त‍र्औ‍उस्‍रीनत्‍में्‍जैसी्‍इस्‍अधधनयिम्‍के्‍द्वारा्‍या्‍ अधी्‍िअपेक्षक्षत्‍है,्‍ािखखल्‍करेि्‍में्‍असफल्‍रहा्‍है,्‍र्ता

(ख) उस असफलता के शलए कोई अच्छा कारण र्अवा तयायोधचत्य हिीां रखता है तो नविााचि अयोग, शासकीय राजपत्र में प्रकाशशत आेिश द्वारा उसको नरिदहात घोवति करेगा

और ऐसा व्यप्क्त उस आेिश की तारीख से तीि वाि की कालावधध के शलए नरिदहात होगा।"

यतः, तथ्यों और उपलब्ध ररर्काडों के आधार पर, आयोग का यह समाधाि हो गया है कक श्री खुशीद अहमद अपेि नविााचि व्यय के लेखे ािखखल करेि में असफल रहे हैं और उकिे पास ऐसा करेि में असफल रहेि के शलए कोई भी उधचत कारण र्अवा औधचत्य हिीां है; और

अतः, अब, लोक प्रनतनधिधत्व अधधनयिम, 1951 की धारा 10क के अुिसरण में, भारत नविााचि आयोग एतद्द्वारा घोणिा करता है कक राजर्साि ववधाि सभा के साधारण नविााचि, 2023 में राजर्साि राज्य के 71- नगर ववधाि सभा नविााचि क्षेत्र से नविााचि लड़ेि वाले अभ्र्यी श्री खुशीद अहमद, नर्नासी- ग्राम नांगल हीरा, पो0 ककथूर, तहसील - अर्लर, जजला - अर्लर, इस आेिश की तारीख से तीि वाि की अवधध के शलए सांसि केभाग्‍5 (घ) राजर्स्‍ाि राज-पत्र,्‍अगस्‍त्‍20,्‍2025्‍ ्‍्‍्‍्‍्‍्‍्‍्‍ ्‍्‍्‍्‍ ⁵³ ककसी भी सिि र्अवा राज्य र्अवा सांघ राज्य क्षेत्र की ववधा्‍िसभा र्अवा ववधाि पररिि का ससिय चुेि जाेि

ORDER

WHEREAS, the General Election to Legislative Assembly of Rajasthan, 2023 for 71- Nagar Assembly Constituency was held in pursuance of the Election Commission of India vide Notification No. 464/RJ-LA/2023, dated 30th October, 2023; and WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and WHEREAS, the result of the election for 71-Nagar Assembly Constituency of Rajasthan, 2023 was declared by the Returning Officer on 3rd December, 2023 and hence the last date for lodging the account of Election Expenses was 02nd January, 2024; and WHEREAS, as per the report submitted DEO, Bharatpur report 05.01.2024 forwarded by the CEO, Rajasthan vide his letter no. F.3(1)(5)EEM/ELECTION/Candidates' Exp.2023/433; dated 16.04.2024, under sub-rule (1) of Rule 89 of the Conduct of Election Rules, 1961 Sh. Khushird Ahmed, a contesting candidate from 71-Nagar Assembly Constituency of state of Rajasthan has failed to lodge the account of his election expenses, as required under law; and WHEREAS, on the basis of the said report of the District Election Officer, Bharatpur a Show-Cause Notice' No.76/RJ-LA/71/2023/CEMS-I, dated 19th March, 2024 was issued under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Khushird Ahmed, for not lodging of the account of Election Expenses; and WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Khushird Ahmed, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the54 ्‍राजर्स्‍ाि राज-पत्र,्‍अगस्‍त्‍20,्‍2025्‍ ्‍्‍्‍्‍्‍्‍्‍ ्‍्‍्‍्‍भाग्‍5 (घ) account and also to lodge the account of his election expenses with the District Election Officer, Bharatpur District within 20 days from the date of receipt of the notice; and WHEREAS, the CEO, Rajasthan vide his letter No. F.3(1)(5)EEM/ELECTION/Candidates' Exp.2023/5486, dated 02.05.2024 enclosing the District Election Officer's Bharatpur letter dated 16.01.2025 reported that the 'Show Cause Notice' was served to Sh. Khushird Ahmed's brother (name Sh. Jameel Khan), on 29.03.2024; and WHEREAS, the District Election Officer, Bharatpur in his supplementary report vide

its letter no. क्रमाांक/र्नािा./2024/6694 dated 08.11.2024 and क्रमाांक/नविाा./ईईएम/वव.स.चु. 2023/2025/267 dated 10.06.2025 respectively wherein it has reported that Sh. Khushird Ahmed, has not submitted account of election expenses. Further, after receipt of the said notice, Sh. Khushird Ahmed, has neither furnished any proper reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:- "If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the

manner required by or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare

him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Khushird Ahmed, has failed to lodge account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the Peoples Act, 1951, the Election Commission of India hereby declares Sh. Khushird Ahmed, resident of Village-Nangal Hira, Post-Kithur, Tehsil-Alwar, Rajasthan a contesting candidate for 71-Nagar Assembly Constituency of Rajasthan in General Election to Legislative Assembly, 2023, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

ाक्त कारण बताओ ोिदटस के जररए और नविााचोिं का सांचालि नयिम, 1961 के नयिम 89 यतः, उपयु के उप-नयिम (6) के अांतगात, श्री रार्मीर जाटौललया को लेखा ािखखल ि ककए जाेि सांबांधी कारणों को सपष्ट करते हुए आयोग को अपाि अभ्यावेिि शलखखत रूप में प्रसतुत करेि और ोिदटस के प्रातत होेि की तारीख से 20 दोििं के भीतर प्जला नविााचि अधधकारी, भरतपुर प्जला को अपेि्‍नविााच्‍िव्यय्‍के ्‍लेखे्‍प्रसतुत्‍करेि्‍का्‍ नेििश्‍दयिा्‍गयार््‍ा; और

यतः, मुख्य नविााचि अधधकारी, राजर्साि पत्र सां. F3(1)(5)EEM/ELECTION/Candidates' Exp./5486 दाििांक 02.05.2024 के तहत प्रातत प्जला नविााचि अधधकारी, भरतपुर के पत्र दाििांक 16.04.2024 में सूधचत ककया है कक उक्त कारण बताओ ोिदटस श्री रार्मीर जाटौललया को दाििांक 30.03.2024 को तामील ककया गया र्ा; और

यतः, प्जला नविााचि अधधकारी, भरतपुर ेि पत्र क्रमाांक/नविाा./2024/6694 दाििांक 08.11.2024 एवां पत्र क्रमाांक/नविाा./ईईएम/वव.स.चु. 2023/2025/267 दाििांक 10.06.2025 के द्वारा प्रसतुत की गई अुिपूरक ररपोटा में यह बताया गया है कक श्री रार्मीर जाटौललया ेि नविााचि व्यय का लेखा प्रसतुत हिीां ककया है। इसके अनतररक्त,56 ्‍राजर्स्‍ाि राज-पत्र,्‍अगस्‍त्‍20,्‍2025्‍ ्‍्‍्‍्‍्‍्‍्‍ ्‍्‍्‍्‍भाग्‍5 (घ) उक्त ोिदटस की पावती के उपराांत, श्री रार्मीर जाटौललया ेि ववधध के अांतगात र्या-ववदहत लेखे ािखखल करेि में अपीि असफलता के शलए भारत नविााचि आयोग को ि तो कोई कारण बताया है और ि ही कोई सपष्टीकरण दयिा है; और

अतः, अब, लोक प्रनतनधिधत्व अधधनयिम, 1951 की धारा 10क के अुिसरण में, भारत नविााचि आयोग एतद्द्वारा घोणिा करता है कक राजर्साि ववधाि सभा के साधारण नविााचि, 2023 में राजर्साि राज्य के 73- भरतपुर ववधाि सभा नविााचि क्षेत्र से नविााचि लड़ेि वाले अभ्र्यी श्री रार्मीर जाटौललया, नर्नासी- र्गां- अजरौंदा, तहसील-र्ैर, जजला-भरतपुर, इस आेिश की तारीख से तीि वाि की अवधध के शलए सांसि के ककसी भी सिि र्अवा राज्य र्अवा सांघ राज्य क्षेत्र की ववधा्‍िसभा र्अवा ववधाि पररिि का ससिय चुेि जाेि र्अवा होेि के शलए नरिदहात होंगे।

letter no. क्रमाांक/र्नािा./2024/6694 dated 08.11.2024 and क्रमाांक/नविाा./ईईएम/वव.स.चु. 2023/2025/267 dated 10.06.2025 respectively wherein it has reported that Sh. Ramvir Jatoliya, has not submitted account of election expenses. Further, after receipt of the said notice, Sh. Ramvir Jatoliya, has neither furnished any proper reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:- "If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner

required by or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to

be disqualified and any such person shall be disqualified for a period of three years from

the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Ramvir Jatoliya, has failed to lodge account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the Peoples Act, 1951, the Election Commission of India hereby declares Sh. Ramvir Jatoliya, resident of Village- Ajronda, Tehsil-Weir, District-Bharatpur, Rajasthan a contesting candidate from 73-Bharatpur Assembly Constituency of Rajasthan in General Election to Legislative Assembly, 2023, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, नविााचोिं का सांचालि नयिम, 1961 के नयिम 89 के उप-नयिम (1) के अांतगात, मुख्य नविााचि अधधकारी, राजर्साि से उकिे दाििांक 16.01.2024 के पत्र सां. F3(1)(5)EEM/ELECTION/Candidates' Exp./433 के तहत प्रातत प्जला नविााचि अधधकारी, भरतपुर की दाििांक 05.01.2024 की ररपोटा के अुिसार, श्री जगत पाल लसंह, जो राजर्साि के 74-नदबई ववधाि सभा नविााचि क्षेत्र, 2023 से नविााचि लड़ेि वाले अभ्र्यी हैं, ववधध के अांतगात र्यापेक्षक्षत अपेि नविााचि व्यय के लेखे ािखखल करेि में असफल रहे हैं; औरभाग्‍5 (घ) राजर्स्‍ाि राज-पत्र,्‍अगस्‍त्‍20,्‍2025्‍ ्‍्‍्‍्‍्‍्‍्‍्‍ ्‍्‍्‍्‍ ⁵⁹ यतः, प्जला नविााचि अधधकारी, भरतपुर की उक्त ररपोटा के आधार पर, भारत नविााचि आयोग द्वारा नविााचोिं का सांचालि नयिम, 1961 के नयिम 89 के उप-नयिम (5) के अांतगात श्री जगत पाल लसंह को अपेि नविााचि व्यय के लेखे प्रसतुत हिीां करेि के शलए कारण बताओ ोिदटस सां. 76/राज-वव.स./74/2023/सीईएमएस- 1 दाििांक 19.03.2024 को जारी ककया गया र्ा; और

ाक्त कारण बताओ ोिदटस के जररए और नविााचोिं का सांचालि नयिम, 1961 के नयिम 89 यतः, उपयु के उप-नयिम (6) के अांतगात, श्री जगत पाल लसंह को लेखा ािखखल ि ककए जाेि सांबांधी कारणों को सपष्ट करते हुए आयोग को अपाि अभ्यावेिि शलखखत रूप में प्रसतुत करेि और ोिदटस के प्रातत होेि की तारीख से 20 दोििं के भीतर प्जला नविााचि अधधकारी, भरतपुर प्जला को अपेि्‍नविााच्‍िव्यय्‍के ्‍लेखे्‍प्रसतुत्‍करेि्‍का्‍नेििश्‍ दयिा्‍गयार््‍ा; और

यतः, मुख्य नविााचि अधधकारी, राजर्साि पत्र सां. F3(1)(5)EEM/ELECTION/Candidates' Exp./5486 दाििांक 02.05.2024 के तहत प्रातत प्जला नविााचि अधधकारी, भरतपुर के पत्र दाििांक 16.04.2024 में सूधचत ककया है कक उक्त कारण बताओ ोिदटस श्री जगत पाल लसंह को दाििांक 08.04.2024 को तामील ककया गया र्ा; और

यतः, प्जला नविााचि अधधकारी, भरतपुर ेि पत्र क्रमाांक/नविाा./2024/6694 दाििांक 08.11.2024 एवां पत्र क्रमाांक/नविाा./ईईएम/वव.स.चु. 2023/2025/267 दाििांक 10.06.2025 के द्वारा प्रसतुत की गई अुिपूरक ररपोटा में यह बताया गया है कक श्री जगत पाल लसंह ेि नविााचि व्यय का लेखा प्रसतुत हिीां ककया है। इसके अनतररक्त, उक्त ोिदटस की पावती के उपराांत, श्री जगत पाल लसंह ेि ववधध के अांतगात र्या-ववदहत लेखे ािखखल करेि में अपीि असफलता के शलए भारत नविााचि आयोग को ि तो कोई कारण बताया है और ि ही कोई सपष्टीकरण दयिा है; और

यतः, लोक्‍प्रनतनधिधत्व्‍अधधनयिम,्‍1951्‍की्‍धारा्‍10क्‍में्‍यह्‍उपबांधधत्‍ककया्‍गया्‍है्‍ककः- "यदि नविााचि आयोग का समाधाि हो जाता है कक कोई व्यप्क्त-

(क) नविााच्‍िव्ययों्‍का्‍लेखा्‍उस्‍समय्‍के्‍भीर्त‍र्औ‍उस्‍रीनत्‍में्‍जैसी्‍इस्‍अधधनयिम्‍के्‍द्वारा्‍या्‍ अधी्‍िअपेक्षक्षत्‍है,्‍ािखखल्‍करेि्‍में्‍असफल्‍रहा्‍है,्‍र्ता

(ख) उस असफलता के शलए कोई अच्छा कारण र्अवा तयायोधचत्य हिीां रखता है तो नविााचि अयोग, शासकीय राजपत्र में प्रकाशशत आेिश द्वारा उसको नरिदहात घोवति करेगा और ऐसा व्यप्क्त उस आेिश की तारीख से तीि वाि की कालावधध के शलए नरिदहात होगा।"

यतः, तथ्यों और उपलब्ध ररर्काडों के आधार पर, आयोग का यह समाधाि हो गया है कक श्री जगत पाल लसंह अपेि नविााचि व्यय के लेखे ािखखल करेि में असफल रहे हैं और उकिे पास ऐसा करेि में असफल रहेि के शलए कोई भी उधचत कारण र्अवा औधचत्य हिीां है; और

अतः, अब, लोक प्रनतनधिधत्व अधधनयिम, 1951 की धारा 10क के अुिसरण में, भारत नविााचि आयोग एतद्द्वारा घोणिा करता है कक राजर्साि ववधाि सभा के साधारण नविााचि, 2023 में राजर्साि राज्य के 74- नदबई ववधाि सभा नविााचि क्षेत्र से नविााचि लड़ेि वाले अभ्र्यी श्री जगत पाल लसंह, नर्नासी- र्गां+पोसट

ORDER

WHEREAS, the General Election to Legislative Assembly of Rajasthan, 2023 for 74- Nadbai Assembly Constituency was held in pursuance of the Election Commission of India vide Notification No. 464/RJ-LA/2023, dated 30th October, 2023; and WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which copy of the account kept by him or his election agent under Section 77 of the said act; and WHEREAS, the result of the election for 74-Nadbai Assembly Constituency of Rajasthan, 2023 was declared by the Returning Officer on 3rd December, 2023 and hence the last date for lodging the account of Election Expenses was 02nd January, 2024; and WHEREAS, as per the report submitted DEO, Bharatpur report 05.01.2024 forwarded by the CEO, Rajasthan vide his letter no. F.3(1)(5)EEM/ELECTION/Candidates' Exp.2023/433; dated 16.04.2024, under sub-rule (1) of Rule 89 of the Conduct of Election Rules, 1961 Sh. Jagat Pal Singh, a contesting candidate from 74-Nadbai Assembly Constituency of state of Rajasthan has failed to lodge the account of his election expenses, as required under law; and WHEREAS, on the basis of the said report of the District Election Officer, Bharatpur a Show-Cause Notice' No.76/RJ-LA/71/2023/CEMS-I, dated 19th March, 2024 was issued under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Jagat Pal Singh, for not lodging of the account of Election Expenses; and WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Jagat Pal Singh, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the भाग्‍5 (घ) राजर्स्‍ाि राज-पत्र,्‍अगस्‍त्‍20,्‍2025्‍ ्‍्‍्‍्‍्‍्‍्‍्‍ ्‍्‍्‍्‍ ⁶¹ account and also to lodge the account of his election expenses with the District Election Officer, Bharatpur District within 20 days from the date of receipt of the notice; and WHEREAS, the CEO, Rajasthan vide his letter No. F.3(1)(5)EEM/ELECTION/Candidates' Exp.2023/5486, dated 02.05.2024 enclosing the District Election Officer's Bharatpur letter dated 16.04.2025 reported that the 'Show Cause Notice' was served to Sh. Jagat Pal Singh, on 08.04.2024; and WHEREAS, the District Election Officer, Bharatpur in his supplementary report vide

its letter no. क्रमाांक/र्नािा./2024/6694 dated 08.11.2024 and क्रमाांक/नविाा./ईईएम/वव.स.चु. 2023/2025/267 dated 10.06.2025 respectively wherein it has reported Sh. Chirmoli, a contesting candidate from 75-Weir (SC) Assembly Constituency of state of Rajasthan has failed to lodge the account of his election expenses, as required under law; and WHEREAS, on the basis of the said report of the District Election Officer, Bharatpur a Show-Cause Notice' No.76/RJ-LA/71/2023/CEMS-I, dated 19th March, 2024 was issued under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Chirmoli, for not lodging of the account of Election Expenses; and WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Chirmoli, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Bharatpur District within 20 days from the date of receipt of the notice; and WHEREAS, the CEO, Rajasthan vide his letter No. F.3(1)(5)EEM/ELECTION/Candidates' Exp.2023/5486, dated 02.05.2024 enclosing the District Election Officer's Bharatpur letter dated 16.04.2025 reported that the 'Show Cause Notice' was served to Sh. Chirmoli, on 27.03.2024; and WHEREAS, the District Election Officer, Bharatpur in his supplementary report vide

its letter no. क्रमाांक/र्नािा./2024/6694 dated 08.11.2024 and क्रमाांक/नविाा./ईईएम/वव.स.चु. 2023/2025/267 dated 10.06.2025 respectively wherein it has reported that Sh. Chirmoli, has not submitted account of election expenses. Further, after receipt of the said notice, Sh. Chirmoli, has neither furnished any proper reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:- "If the Election Commission is satisfied that a person- भाग्‍5 (घ) राजर्स्‍ाि राज-पत्र,्‍अगस्‍त्‍20,्‍2025्‍ ्‍्‍्‍्‍्‍्‍्‍्‍ ्‍्‍्‍्‍ ⁶⁵ (a) has failed to lodge an account of election expenses, within the time and in the

manner required by or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare

him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Chirmoli, has failed to lodge account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the Peoples Act, 1951, the Election Commission of India hereby declares Sh. Chirmoli, resident of Nayi Sabji Mandi Ke Pas Bada jatav Mohalla, Bhusawar, Rajasthan a contesting candidate for 75-Weir (SC) Assembly Constituency of Rajasthan in General Election to Legislative Assembly, 2023, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
