THE RAJASTHAN FISHERIES (AMENDMENT) BILL, 2025

further to amend the Rajasthan Fisheries Act, 1953.
Be it enacted by the Rajasthan State Legislature in the Seventy-sixth Year of the Republic of India, as follows:-
1. Short title and commencement.- (1) This Act may be called the Rajasthan Fisheries (Amendment) Act, 2025.
(2) It shall come into force at once.
2. Amendment of section 8, Rajasthan Act No. XVI of 1953.- In section 8 of the Rajasthan Fisheries Act, 1953 (Act No. XVI of 1953), hereinafter referred to as the principal Act,-
(i) in sub-section (1), for the existing expression "five hundred rupees", the expression "twenty five thousand rupees" shall be substituted; and74 राजस्थान राज-पत्र, सतिम्बर 3 , 2325 भाा ()ि (ii) in sub-section (2), for the existing expression "one thousand rupees", the expression "fifty thousand rupees" shall be substituted.
3. Amendment of section 11, Rajasthan Act No. XVI of 1953.- In sub-section (1) of section 11 of the principal Act, for the existing expression "one hundred rupees", the expression "twenty five thousand rupees" shall be substituted.

The Rajasthan Fisheries Act, 1953 was enacted to provide for the protection, conservation and development of fisheries in the State of Rajasthan. Section 8 of the Act provides for penalties to be imposed, on any person contravening any provision of this Act and also, on a person, having once been convicted of a fishing offence, is again convicted of the same or any other fishing offence. In the present context the penalties are very meager under this Act and fishing offences are increasing day by day. In order to bring down the incidences of fishing offences the State Government has felt the urgent need to revise the rate of penalties. Section 11 of the Act provides for the power to compound offences by accepting a certain amount of sum. It has been decided to enhance the sum to be accepted for compounding the offence.
Accordingly, sections 8 and 11 of the Rajasthan Fisheries Act, 1953 are proposed to be amended.
The Bill seeks to achieve the aforesaid objectives.

(2) ह तुरन्त प्रवृत होाा। 2.1953क राजस्थानविनयन ं ां.16कीनारा8काांोिनन.- राजस्थान मस् -क्षेत्र अधधनन म, 195 (195 ाि अधधनन म ािं. 16), जजेि इमिें इेिि पश्चात म मूल अधधनन म हिा ा ा है, ीि धारा 8 में,-
(i) उप-धारा (1), में धवद् मान असभव् जतत ''पाांच ि ुपप े'' ेि स्थान पर असभव् जतत ''पच्ची िहजार ुपप े'' प्रनतस्थाधपत ीि जा ेाीऔ और
(ii) उप-धारा (2) में धवद् मान असभव् जतत ''ए िहजार ुपप े'' ेि स्थान पर, असभव् जतत ''पचा िहजार ुपप े'' प्रनतस्थाधपत ीि जा ेाी।
3. 1953 क राजस्थान विनयन ं ां. 16 की नारा 11 का ांोिनन.- मूल अधधनन म ीि धारा 11 ीि उप-धारा (1) में धवद् मान असभव् जतत '' ि ुपप े'' ेि स्थान पर असभव् जतत ''पच्ची ि हजार ुपप े'' प्रनतस्थाधपत ीि जा ेाी।

राजस्थान राज् में मस् -क्षेत्र ीि ुिरक्षा, ािंरक्षण, और धवाि िेि सलए राजस्थान मस् -क्षेत्र अधधनन म, 195 अधधनन समत क िा ा ा था। अधधनन म ीि धारा 8, इ िअधधनन म ेि कीिि उपबन्ध ाि उल्लांघन न रिने वाले कीिि व् जतत पर और कीिि सेि व् जतत पर भी जो महली प़निने ेि अपराध ेि सलए ए ि बार सद्धि ोिष ठहरा ा ा ा हो, और उेिि वैेि ही अपराध ा महली प़निने ेि कीिि अन् अपराध ेि सलए पुन: सद्धि ोिष ठहरा ा जाने पर, ािजस्त ाां अधधरोधपत रिने ाि उपबांध रिती है। वतवमान ािंभिव में इ िअधधनन म ेि अधीन ािजस्त ाां बहुत मि हैं और महली प़निने ेि अपराधों में दनि-प्रनतदनि वृधद्ध हो रही है। महली प़निने ेि अपराधों ीि घन टनाओां में मिी लाने ेि सलए राज् रिािर ने ािजस्त ों ीि रि पुनरी्क्षत क िे जाने ीि तािल शवश् तिा महूि ि ीि है। अधधनन म ीि धारा 11 ए िननजश्चत रास िस्वीािर रि अपराधों ाि मिन रिने ीि जितत ाि उपबांध रिती है। ह धवननजश्चत क िा ा ा है क िअपराधों ेि मिन ेि सलए स्वीृि त रास िोि बढा ा जा े।
तनिुािर, राजस्थान मस् –क्षेत्र अधधनन म, 195 ीि धाराएां 8 और 11 ािंोिधधत ीि जानी प्रस्ताधवत है।
