THE RAJASTHAN SHOPS AND COMMERCIAL ESTABLISHMENTS

(AMENDMENT) BILL, 2026

further to amend the Rajasthan Shops and Commercial Establishments Act, 1958.

Be it enacted by the Rajasthan State Legislature in the Seventy-seventh Year of the Republic of India, as follows:-

1. Short title and commencement.- (1) This Act may be called the Rajasthan Shops and Commercial Establishments (Amendment) Act, 2026.

(2) It shall be deemed to have been come into force on and from 17th December, 2025.

2. Amendment of section 2, Rajasthan Act No. 31 of 1958.- In the definition of "apprentice" in section 2 of the Rajasthan Shops and Commercial Establishments Act, 1958 (Act No. 31 of 1958), hereinafter referred to as the principal Act, for the existing expression "a person, aged not less than twelve years", the expression "a person, aged not less than fourteen years" shall be substituted.

3. Amendment of section 7, Rajasthan Act No. 31 of 1958.- In section 7 of the principal Act,-

(i) in sub-section (1),-

(a) for the existing expression "nine hours", the expression "ten hours" shall be substituted;

(b) in the second proviso, for the existing expression "exceed fifty", the expression "exceed one hundred forty four" shall be substituted;

(ii) in sub-section (2), for the existing expression "twelve and fifteen", the expression "fourteen and eighteen" shall be substituted.

4. Amendment of section 9, Rajasthan Act No. 31 of 1958.- In section 9 of the principal Act, for the existing word "five", wherever occurring, the word "six" shall be substituted.

5. Amendment of section 21, Rajasthan Act No. 31 of 1958.- In section 21 of the principal Act, for the existing word "twelve", the word "fourteen" shall be substituted.

6. Amendment of section 22, Rajasthan Act No. 31 of 1958. - In section 22 of the principal Act, for the existing expression "child between the ages of 12 and 15", the expression "child between the ages of fourteen and eighteen" shall be substituted.

7. Repeal and savings.- (1) The Rajasthan Shops and Commercial Establishments (Amendment) Ordinance, 2025 (Ordinance No. 3 of 2025) is hereby repealed.

(2) Notwithstanding such repeal, all things done, actions taken or orders made under the said Ordinance shall be deemed to have been done, taken or made under this Act.

STATEMENT OF OBJECTS AND REASONS

Government of India (GOI) has issued a compliance, reduction and deregulation docket for the state seeking revision of working hours limit for Shops and Commercial Establishment workers.

In compliance of the docket, it became necessary to amend working hours of employees working in Shops and Commercial Establishments.

It is proposed to increase the daily working hours from 'nine' hours to 'ten' hours and also to increase the working period from 'five' hours to 'six' hours before an employee has interval of rest of at least half an hour each day. Similarly, quarterly overtime limit is also proposed to be 'one hundred and forty four' hours.

Provisions relating to the Age or working hours of child and woman in an establishment is also proposed to be amended.

Higher Limit of daily working hours would increase the maximum working capacity of Shops and Commercial Establishments and allow employers to create more jobs and to ensure presence of employees to work or to supervise as required.

Since the Rajasthan Legislative Assembly was not in session and the circumstances existed which rendered it necessary for the Governor of Rajasthan to take immediate action, he, therefore promulgated the Rajasthan Shops and Commercial Establishments (Amendment) Ordinance, 2025 (Ordinance No. 3 of 2025) on 17th December, 2025 which was published in the Rajasthan Gazette, Extraordinary, Part-IV (B), dated 18th December, 2025.

The Bill seeks to replace the aforesaid Ordinance.

Hence the Bill.

राजस्थान दकान और वाणिज्यिक अधिष्ठा

ु न अधिनियम, 1958 को और संशोधित करने के लिए विधेयक।

भारत गणराज्य के सतहत्तरवें वर्ष में राजस्थान राज्य विधान-म(cid:214)डल निम्नलिखित अधिनियम बनाता है:-

1. संक्षिप्त नाम और प्रारंभ.- (1) इस अधिनियम का नाम राजस्थान दकान और वाणिज्यिक ु

अधिष्ठान (संशोधन) अधिनियम, 2026 है।

(2) यह 17 दिसम्बर, 2025 को और से प्रवत्तृ समझा जायेगा।

2. 1958 के राजस्थान अधिनियम सं. 31 की धारा 2 का संशोधन.- राजस्थान दकान और ु

वाणिज्यिक अधिष्ठान अधिनियम, 1958 (1958 का अधिनियम सं. 31), जिसे इसमें इसके पश्चात ् मल अधिनियम कहा गया है , की धारा 2(1) में, वि(cid:217)यमान अभिव्यक्ति "बारह वर्ष" के स्थान पर अभिव्यक्ति "चौदह वर्ष" प्रतिस्थापित की जायेगी।

3. 1958 के राजस्थान अधिनियम सं. 31 की धारा 7 का संशोधन.- मल अधिनियम की ू

धारा 7 की,-

(i) उप-धारा (1) में,-

(क) वि(cid:217)यमान अभिव्यक्ति "नौ घंटों" के स्थान पर अभिव्यक्ति "दस घंटों" प्रतिस्थापित की जायेगी;

(ख) (िcid:217)वतीय परन्तुक में, वि(cid:217)यमान अभिव्यक्ति "पचास से अधिक" के स्थान पर अभिव्यक्ति "एक सौ चवालीस से अधिक" प्रतिस्थापित की जायेगी; (ii) उप-धारा (2) में, वि(cid:217)यमान अभिव्यक्ति "बारह और पन्द्रह" के स्थान पर अभिव्यक्ति "चौदह से अठारह" प्रतिस्थापित की जायेगी;

4. 1958 के राजस्थान अधिनियम सं. 31 की धारा 9 का संशोधन.- मल अधिनियम की ू

धारा 9 में, जहां कहीं भी आये वि(cid:217)यमान शब्द "पांच" के स्थान पर शब्द "छह" प्रतिस्थापित किया जायेगा।

5. 1958 के राजस्थान अधिनियम सं. 31 की धारा 21 का संशोधन.- मल अधिनियम की ू

धारा 21 में, वि(cid:217)यमान शब्द "बारह" के स्थान पर शब्द "चौदह" प्रतिस्थापित किया जायेगा।

6. 1958 के राजस्थान अधिनियम सं. 31 की धारा 22 का संशोधन.- मल अधिनियम की ू

धारा 22 में, वि(cid:217)यमान अभिव्यक्ति "बारह से पन्द्रह" के स्थान पर अभिव्यक्ति "चौदह से अठारह" प्रतिस्थापित की जायेगी।

7. निरसन और व्यावत्तियां

ृ .- (1) राजस्थान दकान और वाणिज्यिक अधिष्ठा

अध्यादेश, 2025 (2025 का अध्यादेश सं. 3) इसके (cid:217)वारा निरसित किया जाता है।

(2) ऐसे निरसन के होते हए भीु , उक्त अध्यादेश के अधीन की गयी समस्त बातें, कार्रवाइयां या किये गये आदेश, इस अधिनियम के अधीन किये गये समझे जायेंगे।

उ(cid:217)देश्यों और कारणों का कथन

भारत सरकार ने उन राज्यों के लिए अनपालनु , कमी और अविनियमन डाके ट जारी किया है, जो दकानों और वाणिज्यिक अधिष्ठा

ु नों के कर्मकारों के कार्य के घंटों की सीमा के पनरीक्षण की मांग ु

कर रहे थे।

डाके ट का अनपालन करने के लिएु

ु नों में कार्य करने वाले कर्मचारियों के कार्य के घंटों को संशोधित करना आवश्यक हो गया है।

दैनिक कार्य के घंटों को "नौ घंटों" से "दस घंटों" तक बढाया जाना और किसी कर्मचारी को प्रतिदिन कम से कम आधा घंटे के विश्राम के अन ्तराल से पर्व

ू कार्य करने की अवधि को भी "पांच" घंटे से बढाकर "छह'' घंटे किया जाना प्रस्तावित है। इसी प्रकार, तिमाही अतिकाल की सीमा भी 'एक सौ चवालीस' घंटे किया जाना प्रस ्तावित है।

किसी अधिष ्ठान में बालक और महिला की आयु या कार्य के घंटों से संबंधित उपबंधों को भी संशोधित किया जाना प्रस ्तावित है।

कार्य के घंटों की उच्चतर दैनिक सीमा दकानोंु और वाणिज्यिक अधिष्ठानों की अधिकतम कार्य क्षमता को बढायेगी और नियोजकों को, और अधिक रोजगार सजितृ करने और कार्य करने के लिये कर्मचारियों की उपस्थिति को सनिश्चितु करने या यथा अपेक्षित पर्यवेक्षण करने के लिये अनज्ञातु करेगी।

चंकि राजस्थान विधान सभा सत्र में नहीं थी और ऐसी परिस्थितियां वि(cid:217)य मान थीं जिनके कारण राजस्थान के राज्यपाल के लिए तरन्त कार्रवाई करना आवश्यक हो गया था , इसलिए, उन्होंने 17 दिसम्बर, 2025 को राजस्थान दकान और वाणिज्यिक अधिष्ठा

ु न (संशोधन) अध्यादेश, 2025 (2025 का अध्यादेश सं. 3) प्रख्यापित किया, जो राजस्थान राज-पत्र, असाधारण, भाग-IV(ख), में दिनांक 18 दिसम्बर, 2025 को प्रकाशित हआ।ु

यह विधेयक पर्वोक्तू अध्यादेश को प्रतिस्थापित करने के लिए ईप्सित है।

अत: विधेयक प्रस्तुत है।
