राजस्थान नगरपालिका (संशोधन) विधेयक, 2026

राजस्थान नगरपालिका अधिनियम, 2009 को और संशोधित करने के लिए विधेयक।

भारत गणराज्य के सतहत्तरवें वर्ष में राजस्थान राज्य विधान-म(cid:214)डल निम्नलिखित अधिनियम बनाता है:-

1. संक्षिप्त नाम और प्रारम्भ.- (1) इस अधिनियम का नाम राजस्थान नगरपालिका (संशोधन) अधिनियम, 2026 है।

(2) यह तरन्तु प्रवत्त होगा। ृ

2. 2009 के राजस्थान अधिनियम सं. 18 की धारा 2 का संशोधन.- राजस्थान नगरपालिका अधिनियम, 2009 (2009 का अधिनियम सं. 18), जिसे इसमें इसके पश्चात मल अधिनियम कहा ्

गया है, की धारा 2 के ख(cid:214)ड (xix) के उप-ख(cid:214)ड (क) में, वि(cid:217)यमान शब्द और विराम चिह्न "कष्ठु ," हटाया जायेगा।

3. 2009 के राजस्थान अधिनियम सं. 18 की धारा 24 का संशोधन.- मल अधिनियम की ू

धारा 24 में,-484 राजस्थान राज-पत्र, मार्च 05, 2026 भाग 3(क) (i) वि(cid:217)यमान ख(cid:214)ड (xvii) हटाया जायेगा;

(ii) परन्तुक का वि(cid:217)यमान ख(cid:214)ड (ङ) हटाया जायेगा; और

(iii) वि(cid:217)यमान स्पष्टीकरण हटाया जायेगा।

उ(cid:217)देश्यों और कारणों का कथन

राजस्थान नगरपालिका अधिनियम, 2009 (2009 का अधिनियम सं. 18) की धारा 24 किसी नगरपालिका के सदस्यों के लिए सामान्य निरर्हताओं का उपबंध करती है। इस धारा का ख(cid:214)ड (xvii) यह बताता है कि कोई व्यक्ति जिसके दो से अधिक संतानें हैं, तो वह किसी नगरपालिका का सदस्य चने जाने के लिए या होने के लिए निरर्हित होगा।

राज्य सरकार के ध्यान में यह आया है कि भारी तादाद में व्यक्ति जनता को प्रेरित करने और उनकी सेवा करने की क्षमता रखते हैं और नगरपालिका जैसी संस्थाओं का मार्गदर्शन करने की परिकल्पना रखते हैं, उन्हें दो से अधिक सन्तानें होने के कारण नगरपालिका का सदस्य होने का अवसर नहीं मिल पाता है। इसके अलावा, राज्य में जन्म दर पर नियन्त्रण करने के लिए समाज में व्यापक सजगता है। इसलिए, राज्य सरकार ने 2009 के उक्त अधिनियम की धारा 24 से यह निरर्हता हटाने का विनिश्चय किया है।

उच्चतम न्यायालय ने रिट याचिका (सिविल) सं. 83/2010 में दिनांक 07-05-2025 को एक आदेश पारित किया है, जिसमें समस्त राज्य सरकारों को, ऐसे समस्त परिनियमों, विनियमों, नियमों आदि जिनमें कष्ठ प्रभावित या उपचारित व्यक्तियों के विरू(cid:217)ध कोई विभेदकारी, अनादर सचक और ू

अपमानजनक उपबंध अंतर्विष्ट हों, की पहचान करने के लिए एक समिति गठित करने के लिए निदशित किया गया हैर्।े

न उपर्यक्तु आदेश के अनसरण में बनायी गयी समिति ने यह पहचान की है कि राजस्था नगरपालिका अधिनियम, 2009 की धारा 2 में अभिव्यक्ति "खतरनाक रोग" की परिभाषा में "कष्ठु " का संदर्भ है और 2009 के उपर्यक्तु अधिनियम से इसे हटाने का सझाव दिया गया है।ु

अत:, राजस्थान नगरपालिका अधिनियम, 2009 की धारा 2 और धारा 24 को यथोचित रूप से संशोधित किया जाना प्रस्तावित है।

यह विधेयक पर्वोक्तू उ(cid:217)देश्यों की प्राप्ति के लिए ईप्सित है।

अतः विधेयक प्रस्तत है।ु

THE RAJASTHAN MUNICIPALITIES (AMENDMENT) BILL, 2026

(As introduced in the Rajasthan Legislative Assembly)

A

Bill

further to amend the Rajasthan Municipalities Act, 2009.

Be it enacted by the Rajasthan State Legislature in the Seventy-seventh Year of the Republic of India, as follows:-

1. Short title and commencement.- (1) This Act may be called the Rajasthan Municipalities (Amendment) Act, 2026.

(2) It shall come into force at once.

2. Amendment of section 2, Rajasthan Act No. 18 of 2009.- In sub-clause (a) of clause (xix) of section 2 of the Rajasthan Municipalities Act, 2009 (Act No. 18 of 2009), hereinafter referred to as the principal Act, the existing word and punctuation mark "leprosy," shall be deleted.

3. Amendment of section 24, Rajasthan Act No. 18 of 2009.- In section 24 of the principal Act,-

(i) the existing clause (xvii) shall be deleted;

(ii) the existing clause (e) of proviso shall be deleted; and

(iii) the existing Explanation shall be deleted.

STATEMENT OF OBJECTS AND REASONS

Section 24 of the Rajasthan Municipalities Act, 2009 (Act No. 18 of 2009) provides general disqualifications for members of a municipality. Clause (xvii) of this section stipulates that a person having more than two children shall be disqualified for being chosen as or for being a member of a Municipality.

It has come into the notice of the State Government that a great number of persons having the ability to inspire and serve the public and a vision to lead an institution such as municipality, do not get an opportunity for being a member of municipality for the reasons that he or she has more than two children. Therefore, the State Government has decided to remove this disqualification from section 24 of the said Act of 2009.

The Supreme Court in Writ Petition (Civil) No. 83/2010 has passed an order dated 07- 05-2025 wherein it has directed all the State Government to constitute a committee to identify all statutes, regulation, rules etc. containing any discriminatory, derogatory and demeaning provision against leprosy affected or cured persons.

The committee formed in pursuance to the aforesaid order identified that there is reference of leprosy in the definition of expression "dangerous disease" in section 2 of the Rajasthan Municipalities Act, 2009 and suggested to remove it from the aforesaid Act of 2009.

Accordingly, section 2 and section 24 of the Rajasthan Municipalities Act, 2009 are proposed to be amended suitably.

The Bill seeks to achieve the aforesaid objectives.
