जी.एस.आर.143 :-यत:, राजस्थान मत्स्य नियम, 1958 को और संशोधित करने के लिए प्रारूप नियम, उनसे संभाव्यत: प्रभावित होने वाले समस्त व्यक्तियों से, उस तारीख जिसको राजस्थान राजपत्र
से 21 दिवस के अवसान से पर्व
में यथा प्रकाशित उक्त अधिसचनाू की प्रतियां जनता को 23.12.2025 को उपलब्ध करा दी गयी थीं, ू , आक्षेप और सझावु आमंत्रित करते हएु राजस्थान मत्स्य अधिनियम, 1953 (1953 का अधिनियम सं.16) की धारा 5 की उप-धारा (1) की अपेक्षानसारु , राजस्थान राजपत्र विशेषांक भाग 4 (ग) उप-ख(cid:214)ड (झ) दिनांक 23.12.2025 को प्रकाशित किये गये थे;
और यत:, राज्य सरकार को कोई भी आक्षेप और सझावु प्राप्त नहीं हएु हैं; अब, अत:, राजस्थान मत्स्य अधिनियम, 1953 (1953 का अधिनियम सं.16) की धारा 5 (cid:217)वारा प्रदत्त शक्तियों का प्रयोग करते हएु राज्य सरकार, राजस्थान मत्स्य नियम, 1958 को और संशोधित करने के लिए इसके (cid:217)वारा, निम्नलिखित नियम बनाती है, अर्थात ्:-
1. संक्षिप्त नाम और प्रारंभ.- (1) इन नियमों का नाम राजस्थान मत्स्य (संशोधन) नियम, 2026 है।
(2) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवत्तृ होंगे। 2. नियम 5 का संशोधन.- राजस्थान मत्स्य नियम, 1958, जिन्हें इसमें इसके पश्चात ् उक्त नियमों के रूप में निर्दिष्ट किया गया है, के नियम 5 का वि(cid:217)यमान उप-नियम (5) हटाया जायेगा।
3. नियम 5क का प्रतिस्थापन.- उक्त नियमों के वि(cid:217)यमान नियम 5क के स्थान पर निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थात ्:-
"5क. जनजाति मछआराु सहकारी सोसाइटी को जलाशय का आबंटन.– उन क्षेत्रों को छोड़कर, जो नगरपालिका (cid:217)वारा प्रशासित होते हैं, भारत के संविधान के अनच्छे
निर्दिष्ट राजस्थान के अनसचितु
ु द 244 के ख(cid:214)ड (1) में यथा ू क्षेत्रों में अवस्थित जलाशय, नियम 5 के उप-नियम (1) के ख(cid:214)ड (ख) के अधीन अवधारित आरक्षित कीमत पर रजिस्ट्रीकतृ जनजाति मछआराु सहकारी सोसाइटी को आबंटित किये जा सके गें। ख प्रवर्ग के जलाशय का निदेशक, मत्स्य (cid:217)वारा, और ग तथा घ प्रवर्ग के जलाशय का संबंधित जिले के मत्स्य अधिकारी (cid:217)वारा, आबंटन किया जायेगा।"693 राजस्थान राज-पत्र, मार्च 12, 2026 भाग 4 (ग) 4. नियम 6 का संशोधन.- उक्त नियमों के नियम 6 में, वि(cid:217)यमान अभिव्यक्ति "पंचायती
राज संस्थाओं को अन्तरित जलाशयों के मामले में, जिला परिषद् का मख्यु कार्यपालक अधिकारी या, यथास्थिति, पंचायत समिति का विकास अधिकारी", जहां कहीं भी आयी हो, हटायी जायेगी।

NOTIFICATION
JAIPUR, January 21, 2026
G.S.R.143 .-Whereas, the draft rules further to amend the Rajasthan Fisheries Rules, 1958, was published in the Rajasthan Gazette Extraordinary, Part 4 (ga) up-khand(I) dated 23.12.2025 as required by sub-section (1) of section 5 of the Rajasthan Fisheries Act, 1953 (Act No. XVI of 1953), for inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of 21 days from the date on which the copies of the said notification as published in Rajasthan Gazette were made available to the people on 23.12.2025;
And whereas, no objections and suggestions have been received by the State Government;
Now, therefore, in exercise of the powers conferred by section 5 of the Rajasthan Fisheries Act, 1953 (Act No. XVI of 1953), the State Government hereby makes the following rules further to amend the Rajasthan Fisheries Rules 1958, namely:-
1. Short title and commencement.- (1) These rules may be called the Rajasthan Fisheries (Amendment) Rules,2026. (2) They shall come into force on the date of their publication in the Official Gazette.
2.Amendment of rule 5.- The existing sub-rule (5) of rule 5 of the Rajasthan Fisheries Rules 1958, hereinafter referred to as the said rules, shall be deleted.
3. Substitution of rule 5A.-The existing rule 5A of the said rules shall be substituted by the following, namely:-
"5A. Allotment of water to the Tribal Fisherman Co-operative Society.-Waters, situated in Scheduled areas of the Rajasthan as referred in clause (1) of Article 244 of the Constitution of India except those areas which are administered by a municipality, may be allotted to the Registered Tribal Fisherman Co-operative Society on reserve price determined under clause (b) of sub-rule (1) of rule 5. Allotment of the B category water shall be made by the Director, Fisheries and C and D category water shall be made by the Fishery Officer of district concerned."
4. Amendment of rule 6.- In rule 6 of the said rules,the existing expression "and in case of waters transferred to Panchayati Raj Institutions, Chief Executive Officer of Zilaभाग 4 (ग) राजस्थान राज-पत्र, मार्च 12, 2026 694 Parishad or Vikas Adhikari of Panchayat Samiti as the case may be,", wherever occurring, shall be deleted.
