जी.एस.आर.12 :-राजस्थान विधान सभा (अधिकारियों तथा सदस्यों की परिलब्धियां और पेंशन) अधिनियम,1956 (1957 का अधिनियम सं. 6) की धारा 4-क की उप-धारा (2) के साथ पठित धारा 11 (cid:217)वारा प्रदत्त शक्तियों का प्रयोग करते हए राज्य सरकारु , राजस्थान विधान सभा भतपर्व सदस्य ू
और कटं ु ब पेंशनर (चिकित्सा सविधाएं
ु ) नियम, 2010 को और संशोधित करने के लिए इसके (cid:217)वारा निम्नलिखित नियम बनाती है, अर्थात ्:-
1. संक्षिप्त नाम और प्रारंभ.- (1) इन नियमों का नाम राजस्थान विधान सभा भतपर्व सदस्य ू
ु (चिकित्सा सविधाएं
ु ) (संशोधन) नियम, 2026 है।

(2) ये तरन्तु प्रवत्त होंगे।ृ
2. नियम 3 का संशोधन.- राजस्थान विधान सभा भतपर्व सदस्य और कटंब पेंशनर ू
ु (चिकित्सा सविधाएं
ु ) नियम, 2010, जिसे इसमें इसके पश्चात उक्त् नियमों के रूप में निर्दिष्ट किया गया है, के नियम 3 के वि(cid:217)यमानखंड (क) के स्थान पर निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थात ्:-
"(क) 50,000/- रुपये प्रतिवर्ष की अधिकतम खर्च सीमा तक, जिसमें 5,000/- रु. प्रतिवर्ष तक
आरजीएचएस के अधीन सचीब(cid:217)धू जांचें (पैथोलोजिकल, बैक्टैरियोलोजिकल, रेडियोलोजिकल और अन्य) सम्मि लित हैं, बाह्य उपचार के मामले में एलोपैथिक ओषधियां, औषध, वेक्सीन, सीरा, अन्य चिकित्सा
पदार्थ आरजीएचएस के अधीन मान्यता प्राप्त फार्मा स्टोर/ई-फार्मा स्टोर से लिये जा सकें गे। यदि
सरकारी अस्पताल में जांच उपलब्ध नहीं है तो सरकारी अस्पताल से अनपलब्धु ता प्रमाणपत्र अपेक्षित है:
, खर्च सीमा का विचार किये बिना उपलब्ध करवायी जायेंगी।
परंत अंतरंग रोगी को औषधु
परंत यह और कि पेंशनरु
, जिन्होंने 75 वर्ष या अधिक की आय प्राप्तु कर ली है, को 3,000/- रु. प्रतिवर्ष की सीमा तक निम्नलिखित उपचार/रोगों के मामले में, विटामिन्स, मिनरल्स और एंटी- ऑक्सीडेंट उपलब्ध करवाये जायेंगे:-
24 राजस्थान राज-पत्र, मई 05, 2026 भाग 4 (ग)(i) कैं सर, (ii) स्थायी यकत रोगृ , (iii) किडनी फे ल, (iv) मख्यु अंग प्रत्यारोपण (जैसे किडनी, फे फड़े, यकत और अस्थिमज्जा
ृ प्रत्यारोपण) और (v) स्ट्रोकों के परिणामस्वरूप पार्किं सन रोग के स्थायी लक्षण।
प्राधिकत चिृ कित्सा परिचर (cid:217)वारा लिखे गये विटामिन्स, मिनरल्स, एंटी-ऑक्सीडेंट का संदाय आरजीएचएस दरों पर फार्मा स्टोर/ई-फार्मा स्टोर को किया जायेगा।"
3. नियम 4 का प्रतिस्थापन.- उक्त नियमों के वि(cid:217)यमान नियम 4 के स्थान पर निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थात ्:-
"4. नियम 3 के अधीन खर्च सीमा में शिथिलीकरण.- (1) प्रमख सचिवु , नियम 3 में विनिर्दिष्ट औषधों के खर्च की सीमा समस्त पात्र मामलों में प्रतिवर्ष 1,00,000/- रुपये तक और कैं सर, किडनी फे ल और गर्दा ु (रेनल) रोग के उपचार के संबंध में प्रतिवर्ष 2,00,000/- रुपये की सीमा तक, निम्नलिखित से मिलकर बनी समिति की सिफारिश पर और जहां आवश्यक समझी जाये, दसरी ू चिकित्सीय राय अभिप्राप्त करने के पश्चात आरजीएचएस पोर्टल के माध्य् म से बढ़ा सके गा, अर्थात ्:-
1. प्रमख सचिवु - अध्यक्ष
2. राजस्थान विधान सभा के सरकारी अस्पताल
का चिकित्सा अधिकारी - सदस्य
3. वित्तीय सलाहकार/मख्यु लेखा अधिकारी/वरिष्ठ
लेखा अधिकारी - सदस्य-सचिव।
टिप्पण: आरजीएचएस के अधीन सचीब(cid:217)ध जांचों ू (पैथोलोजिकल, बैक्टैरियोलोजिकल, रेडियोलोजिकल और अन्य) के लिए, प्रतिवर्ष 5,000/- रु. की खर्च सीमा है। सचीब(cid:217)ध जांचों की खर्च सीमा ू
में व(िcid:217)धृ , उप-नियम (1) के अधीन खर्च सीमा के भीतर प्रमख सचिव (cid:217)वारा अनमोदित की जायेगी।
(2) समस्त पात्र मामलों में प्रतिवर्ष 1,00,000/- रुपये से अधिक बाह्य उपचार के मामले में औषधों और ओषधियों की खर्च सीमा और प्रतिवर्ष 2,00,000/- रुपये की सीमा से अधिक कैं सर, किडनी फे ल और गर्दा ु (रेनल) रोग के संबंधित उपचार के संबंध में निम्नलिखित सक्षम स्तर (cid:217)वारा विनिश्चय किया जायेगा:-
1. चिकित्सा और स्वास्थ्य विभाग (cid:217)वारा यथा प्राधिकत अतिरिक्तृ सीईओ/संयक्तु सीईओ, राजस्थान राज्य स्वास्थ्य बीमा एजेंसी (समस्त पात्र मामलों में 1,00,000/- रुपये से अधिक)
2. मख्यु कार्यकारी अधिकारी, राजस्थान राज्य स्वास्थ्य बीमा एजेंसी (2,00,000/- रुपये से अधिक और 7,00,000/- रुपये तक)
3. प्रशासनिक विभाग-चिकित्सा और स्वास्थ्य विभाग (7,00,000/- रुपये से अधिक)
टिप्पण: आरजीएचएस के अधीन सचीब(cid:217)ध जांचों ू (पैथोलोजिकल, बैक्टैरियोलोजिकल, रेडियोलोजिकल और अन्य) के लिए खर्च सीमा 5,000/- रु. प्रतिवर्ष है। उप-नियम (2) के अधीन विस्तारितभाग 4 (ग) राजस्थान राज-पत्र, मई 05 2026 25 खर्च सीमा के मामले में सचीब(cid:217)ध जांच की खर्च सीमा में विस्ता र को उप-नियम (2) के अधीन खर्च सीमा में विस्तार के भीतर सीईओ, राजस्थान राज्य स्वास्थ्य बीमा एजेंसी
(cid:217)वारा अनमोदित किया जायेगा।ु

G.S.R.12 .-In exercise of the powers conferred by section 11 read with sub-section (2) of section 4-A of the Rajasthan Legislative Assembly (Officers and Members Emoluments and Pension) Act, 1956 (Act No. 6 of 1957), the State Government hereby makes the following rules further to amend the Rajasthan Legislative Assembly Ex-Members and Family Pensioners (Medical Facilities) Rules, 2010, namely:-
1. Short title and commencement.- (1)These rules may be called the Rajasthan Legislative Assembly Ex-Members and Family Pensioners (Medical Facilities) (Amendment) Rules, 2026. (2) They shall come into force with immediate effect.
2. Amendment of rule 3.- The existing clause (a) of rule 3 of the Rajasthan Legislative Assembly Ex-Members and Family Pensioners (Medical Facilities) Rules, 2010, hereinafter referred to as the said rules, shall be substituted by the following, namely:- "(a) Allopathic drugs, medicines, vaccines, sera, other therapeutic substances can be taken from pharma store/ e-pharma store recognized under the RGHS in case of outdoor treatment upto the cost ceiling of Rs. 50,000/- per annum, which includes the listed tests (pathological, bacteriological, radiological and other) under RGHS upto Rs 5000/- per annum. NAC is required from Government hospitals in case the test is not available in the Government hospitals:
Provided that medicines to the indoor patients shall be made available irrespective of the cost ceiling.
26 राजस्थान राज-पत्र, मई 05, 2026 भाग 4 (ग) Provided further that vitamins, minerals and anti-oxidant shall be made available upto the limit of Rs 3000/- per annum for the pensioners who have attained the age of 75 years or above in the case of following treatment/ diseases:-
(i) Cancer, (ii) Chronic Liver Disease, (iii) Kidney Failure, (iv) Major Organ Transplant (i.e. Kidney, Lungs, Liver and Bone Marrow Transplant) and (v) Strokes resulting in permanents symptom/ Parkinsons disease.
The payment of Vitamins, Minerals and Anti-oxidant prescribed by authorized medical attendant shall be made to Pharma stores/e-pharma stores on RGHS rates."
3. Substitution of rule 4.-The existing rule 4 of the said rules shall be substituted by the following, namely:-
"4. Relaxation in cost ceiling under rule 3.-(1) The Principal Secretary may extend the cost ceiling for medicines specified in rule 3 upto Rs. 1,00,000/- per annum in all deserving cases and in respect of treatment of cancer, kidney failure and renal disease upto limit of Rs. 2,00,000/- per annum through RGHS portal on the recommendation of the committee consisting of the following and after obtaining second medical opinion where it is felt necessary, namely:-
1. Principal Secretary - President 2.Medical Officer of the Government Hospital of the Rajasthan Vidhan Sabha - Member 3.Financial Adviser/Chief Accounts officer/ Senior Accounts officer - Member Secretary
Note: For the listed tests (pathological, bacteriological, radiological and other) under RGHS, there is ceiling of Rs 5000/- per annum. The extension in cost ceiling of the listed tests shall be approved by the Principal Secretary within cost ceiling extended under sub-rule (1).
(2) The extension of cost ceiling of drugs and medicines in case of outdoor treatment above Rs. 1,00,000/- per annum in all deserving cases and in respect of treatment of cancer, kidney failure and renal diseases above the limit of Rs. 2,00,000/- per annum shall be decided by the following competent level:-
1. Additional CEO/Joint CEO, Rajasthan State Health Assurance Agency as authorized by medical and health department (above Rs. 1,00,000/- in all deserving cases)
2. Chief Executive Officer, Rajasthan State Health Assurance Agency (above Rs. 2,00,000/- and upto Rs. 7,00,000/-)
3.Administrative Department- Medical and Health Department (above Rs. 7,00,000/-)भाग 4 (ग) राजस्थान राज-पत्र, मई 05 2026 27 Note: For the listed tests (pathological, bacteriological, radiological and other) under RGHS, there is ceiling of Rs 5000/- per annum. In case of cost ceiling extended under sub-rule (2), the extension in the cost ceiling of the listed tests shall also be approved by the CEO, Rajasthan State Health Assurance Agency within cost ceiling extended under sub-rule (2)."
