Amendments to the Tamil Nadu Electricity Distribution Code

(Notification No. TNERC/DC/8 –24 dated 02-03-2018.)

In exercise of the powers conferred by section 181 read with section 46 of the Electricity Act, 2003 (central Act 36 of 2003) and all other powers enabling it in this behalf, the Tamil Nadu Electricity Regulatory commission hereby makes the following amendments to the Tamil Nadu Electricity Distribution code, the draft of the same having been previously published, as required under sub-section (3) of the said section 181.

Amendments

In the said Code,-

(1) in regulation 29,-

(i) for sub-regulation (4), the following sub-regulation shall be substituted, namely:-

"(4) Upon receipt of an application for supply of electricity, a notice will be sent to the intending consumer informing that he or his authorized representative shall meet the Engineer to agree on the position of the point of supply, cut-out or circuit-breaker and meter. The Licensee shall not fix its meter, cut-out etc., or allow them to remain in a position which will entail entry by its employees into certain restrictive areas which are socially well defined. The service mains shall be visible and accessible up to metering point for inspection.";

(ii) for sub-regulation (10), the following sub-regulation shall be substituted, namely:-

"(10) In all storied buildings irrespective of the number of floors, service connections (whether through overhead wires or through under-ground cables) will be effected normally at the ground floor. In areas that are prone to floods, the height of the meter shall be raised at a level as may be determined by the Engineer.";

(iii) in sub regulation (12), in the Table under clause (ii) for the expression

"1520 (indoor)" in column (2) against "33 kV sub-station" in column (1), the expression "850 (indoor)" shall be substituted;

(2) In ANNEXURE III,-

(i) for forms 1,2,3 the following forms shall be substituted, namely:-

Explanatory StatEmEnt

It has been decided to amend the Tamil Nadu Electricity Distribution code based on the proposal received from the code Review panel so as to-

(1) make provision for visibility and inspection of service mains for all service connections effected using overhead lines/underground cables;

(2) raise the level of the meters to avoid damage to equipments during rainy and flood seasons;

(3) reduce the requirement of land to be allotted for a 33 kV indoor sub-station in places of group housing/commercial complex where the total demand exceed s.5 MVA;

(4) change the existing application Forms for certain services providing for more details for ease of functioning of the said code and

(5) amend the Form -8 under Annexure III, requiring the consumers to install appropriate correction equipments where the loads are with high harmonic content, low power factor and unacceptable supply voltage and frequency fluctuations.

The proposed amendments seek to give effect to the above proposals.

தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணையம்

அறிவிக்கை

(அறிவிக்கை எண். தமிஒஆ/பவி/8-24 நாள் 02.03.2018)

2003-ஆம் ஆண்டு மின்சாரச் சட்டத்தின் (மத்தியச் சட்டம் 36/2003) 46-ஆம் பிரிவுடன் சேர்த்துப் படிக்கப்படும் 181-ஆம் பிரிவினால் வழங்கப்பட்ட அதிகாரங்களையும் மற்றும் இதன் பொருட்டு அதனை இயல்விக்கும் அனைத்துப் பிற அதிகாரங்களையும் செலுத்தி தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணையம் தமிழ்நாடு மின்பகிர்மான விதித்தொகுப்புக்கு பின்வரும் திருத்தங்களை செய்கிறது. அதன் வரைவு, மேற்சொன்ன சட்டத்தின் 181-ஆம் பிரிவின் (3)-ஆம் உட்பிரிவினால் வேண்டுறுத்தப்பட்டவாறு முன்னதாக வெளியிடப்பட்டுள்ளது.

திருத்தங்கள்

மேற்சொன்ன விதித் தொகுப்பில்,-

(1) 29-ஆம் ஒழுங்குமுறைவிதியில்,-

(i) (4)-ஆம் உள்ஒழுங்குமுறைவிதிக்குப் பதிலாக, பின்வரும் உள் ஒழுங்குமுறைவிதி மாற்றி அமைக்கப்படுதல் வேண்டும், அவையாவன:-

"(4) மின் வழங்கலுக்கான விண்ணப்பதைப் பெற்றதும், மின் வழங்கல் கோரும் நுகர்வோருக்குஅவர் அல்லது அவரது அதிகாரம் பெற்ற பிரதிநிதியை மின் வழங்கும் புள்ளியின் இருப்பிடம், உருகி (cutout) அல்லது மின்சுற்றுப் பிரிகலன் மற்றும் மின்னளவி அமைவிடம் ஆகியவற்றுக்கு இசைவு தெரிவிக்க பொறியாளரை சந்திக்கும்படி அறிவிப்பு அனுப்பப்பட வேண்டும். உரிமம்தாரர், சமூக வழக்கத்தில் வரையறுக்கப்பட்ட தனது பணியாளர்கள் நுழைய முடியாத நிலையில் அமைந்துள்ள கட்டுப்பாடான இடங்களில், தமது மின்னளவி, உருகி, முதலியன போன்றவற்றைப் பொருத்துதல் கூடாது மற்றும் அவை அத்தகைய இடங்களில் இருக்க அனுமதிக்கக் கூடாது. நுகர்வாய் (servicemains) யை ஆய்வு செய்வதற்கு ஏற்றவகையில், மின்னளவி பொருத்தப்பட்ட இடம் வரை அணுகும் வகையிலும் மற்றும் தென்படும் நிலையிலும் இருத்தல் வேண்டும்";

(ii) (10) ஆம் உள் ஒழுங்குமுறைவிதிக்குப் பதிலாக பின்வரும் உள் ஒழுங்குமுறைவிதி மாற்றியமைக்கப்படுதல் வேண்டும், அவையாவன:-

"(10) எல்லா பன்மாடிக் கட்டடங்களிலும், அடுக்குமாடிகளின் எண்ணிக்கையைக் கணக்கில் கொள்ளாமல் மின்னிணைப்புகள் (மேனிலை மின்தொடர் கம்பிகளாலோ அல்லது புதைமின் வடங்களாலோ) சாதாரணமாக தரைத்தளத்தில் வழங்கப்படும். வெள்ளப் பெருக்குக்கு உள்ளாகக்கூடிய பகுதிகளில் பொறியாளரால் தீர்மானிக்கப்படலாகும் மட்டத்தில் மின்னளவி அமையும் இடம் உயர்த்தப்படுதல் வேண்டும்";

(iii) (12)-ஆம் உள் ஒழுங்குமுறைவிதியில், (ii) ஆம் கூறில் அடங்கியுள்ள அட்டவணையில் (2) ஆம் கட்டத்தில் "33 கிவோ துணை மின்நிலையம்" என்பதற்கு எதிரில் 1520 (உட்புறம்) என்ற சொற்றொடருக்குப் பதிலாக 850 (உட்புறம்) என்ற சொற்றொடர் மாற்றியமைக்கப்படுதல் வேண்டும்;

(2) III ஆம் பின் இணைப்பில்,-

(i) படிவங்கள் 1,2,3 க்குப் பதிலாக பின்வரும் படிவங்கள் மாற்றியமைக்கப்படுதல் வேண்டும், அவையாவன:-

விளக்கவுரை

விதித்தொகுப்பு மீள்பார்வைக் குழுவிடமிருந்து பெறப்பட்ட செயற்குறிப்புகளின் அடிப்படையில் பின்வருவனவற்றுக்காக தமிழ்நாடு மின் பகிர்மான விதித் தொகுப்புக்கு திருத்தங்கள் மேற்கொள்ள உத்தேசிக்கப்பட்டுள்ளது-

(1) மேல்நிலை மின்தொடர்கள்/புதை மின்வடங்களை பயன்படுத்தி செய்து முடிக்கப்பட்ட அனைத்து மின்னிணைப்புகளையும் மின்நுகர்வாய் பார்க்கக்கூடிய மற்றும் ஆய்வு செய்வதற்கு ஏற்றவகையில் அமைவதற்காக ஒரு வகைமுறையினை செய்தவதற்காக;

(2) மழை மற்றும் வெள்ளப்பெருக்கு காலங்களில் மின் சாதனங்களுக்கு ஏற்படும் சேதத்தினைத் தவிர்ப்பதற்காக மின்னளவிகள் அமையும் மட்டத்தினை உயர்த்தும் பொருட்டு;

(3) மொத்த மின்தேவை 5 மெகாவோல்ட் ஆம்பியருக்கு கூடுதலாக உள்ள கூட்டுக்குடியிருப்பு/வணிக வளாகங்கள் அமையும் இடங்களில் 33 கிலோ வோல்ட் உட்புற துணை மின்நிலையம் அமைப்பதற்கு ஒதுக்கீடு செய்யப்படவேண்டிய நிலத்தேவையினை குறைத்தல்;

(4) மேற்சொன்ன விதித் தொகுப்பு எளிமையாக செயல்படுவதற்கு சில மின்னிணைப்புகளுக்கான இருந்துவரும் விண்ணப்பப் படிவங்களில் சில கூடுதல் விவரங்களை வழங்க மாற்றம் செய்யவும்.

(i) (4) மின் வழங்கலுக்கான விண்ணப்பத்தைப் பெற்றதும், கோரும் நுகர்வோருக்கு அவரது அதிகாரம் பெற்ற சார்பாளரை மின் வழங்கும் புள்ளியின் இருப்பிடம், உருகி (cutout) அல்லது மின்சுற்றுப் பிரிகலன் வைக்குமிடம் மற்றும் மின்னளவி ஆகியவற்றுக்கு இசைவு தெரிவிக்க, பொறியாளரை வந்து பார்க்கும்படி அறிவிப்பு அனுப்பப்படும். சமூக வழக்கத்தில் வரையறுத்துக் கட்டுப்படுத்தப்பட்ட இருப்பிடங்களில், தனது பணியாளர்கள் நுழைய முடியாத நிலையில் அமைந்துள்ள அத்தகைய இடங்களில், தமது மின்னளவி துண்டிப்பு அமைப்பு போன்றவற்றைப் பொருத்தவோ, ஏற்கனவே பொருத்தப்பட்டிருந்தால் அது தொடர்ந்து அப்படி நிலவவோ உரிமதாரர் எந்தவகைத் தனி நேர்விலும் கூட இசைய வேண்டியதில்லை. மேனிலை மின்தொடரிலிருந்து இணைக்கப்படும் மின்னிணைப்புகளைப் பொருத்த வரையில், மின்னிணைப்பு தலைமை வாயிலை ஆய்வு செய்து பார்க்கவும், அணுகவும் முடிந்த நிலையில் மின்னளவி பொருத்தப்பட்ட இடம் அமைய வேண்டும்.

Notification No. TNERC/SC/7 –39 dated 02.03.2018.

No. VI(2)/44/2018.—In exercise of the powers conferred by section 181 read with section 50 of the Electricity Act, 2003 (central Act 36 of 2003) and all other powers enabling it in this behalf, the Tamil Nadu Electricity Regulatory commission hereby makes the following amendments to the Tamil Nadu Electricity supply code, the draft of the same having been previously published, as required under sub- section (3) of the said section 181.

Amendments

In the said Code,-

(1) in regulation 4, in sub-regulation (1), clause (vi) shall be omitted;

(2) in regulation 5, in sub-regulation (2), for clause (iii), the following clause shall be substituted, namely:-

"(iii) In the case of temporary supply, the excess demand charges shall be as follows:

(a) For hT supply, the demand in excess of the sanctioned demand shall be charged at double the normal rate.

(b) For LT supply, when the recorded demand does not exceed 112 kw, the excess demand charges for every kw or part thereof in excess of the sanctioned demand shall be at the rate of 1% of the total energy charges, and when the recorded demand exceeds 112 kW, the excess demand charges shall be as specified in Para (II) of sub-regulation (2)(ii)(c) of this regulation.";

(3) in regulation 22, for sub-regulation (3), the following sub-regulation shall be substituted, namely:-

"(3) To restore supply to a high Tension service connection which remains disconnected for six months or more, approval of the competent authority with regard to safety and security of the installation shall be obtained." (By order of the Tamil Nadu Electricity Regulatory commission)

Explanatory Statement

1. Regulation 39 (2) (ii) of the Tamil Nadu Electricity Distribution code provides for collection of security Deposit equivalent to three times of the tariff charges for the consumption which is to be maintained throughout the temporary supply period. hence, regulation 4 (1) (vi) of Tamil Nadu Electricity supply code which provides for collection of advance Current Consumption (CC) charges and adjustment of CC charges against the advance CC charges runs contrary to the said provision of the Tamil Nadu Electricity Distribution code and therefore needs to be omitted.

2. It has been decided to levy excess demand charges for the temporary supply on par with the excess demand charges applicable to regular hT supply or LT supply, as the case may be, in order to enforce the concept and collection of excess demand charges on all categories.

3. The cEA (Measures relating to safety and electric supply) Regulations, 2010 provides for the inspection of Electrical Inspector before restoration of supply to a service connection under disconnection beyond six months. hence in line with the above provision, it has been decided to amend Regulation 22 of the Tamil Nadu Electricity supply code.

4. The proposed amendments seek to give effect to the above proposal.

2003 ஆம் ஆண்டு மின்சாரச் சட்டத்தின் (மத்தியச் சட்டம் 36/2003) 50 ஆம் பிரிவுடன் சேர்த்துப் படிக்கப்படும் 181 ஆம் பிரிவினால் வழங்கப்பட்ட அதிகாரங்களையும் மற்றும் இதன் பொருட்டு அதனை இயல்விக்கும் அனைத்துப் பிற அதிகாரங்களையும் செலுத்தி, தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணையம், தமிழ்நாடு மின் வழங்கல் விதித்தொகுப்புக்கு பின்வரும் திருத்தங்களை இதனால் செய்கிறது. அதன் வரைவு, மேற்சொன்ன சட்டத்தின் 181 ஆம் பிரிவின் (3) ஆம் உட்பிரிவினால் வேண்டுறுத்தப்பட்டவாறு முன்னதாக வெளியிடப்பட்டுள்ளது.

திருத்தங்கள்

மேற்சொன்ன விதித்தொகுப்பில்,-

(1) 4 ஆம் ஒழுங்குமுறை விதியில், (1) ஆம் உள் ஒழுங்குமுறைவிதியில், (vi) ஆம் கூறு நீக்கப்பட வேண்டும்;

(2) 5 ஆம் ஒழுங்குமுறைவிதியில், (2) ஆம் உள் ஒழுங்குமுறைவிதியில், (iii) ஆம் கூறுக்கு பதிலாக பின்வரும் கூறு மாற்றியமைக்கப்படுதல் வேண்டும், அவையாவன:-

''(iii) தற்காலிக மின் வழங்கலைப் பொருத்தவரையில், மிகை மின்தேவைக் கட்டணம் பின்வருமாறு இருத்தல் வேண்டும்:

(a) உயர் அழுத்த மின் வழங்கலுக்கு, ஒப்பளித்த மின்தேவைக்கு மிகையான மின்தேவைக்கு இயல்பான கட்டணத்தைப்போன்று இரு மடங்கு கட்டணம் விதிக்கப்படுதல் வேண்டும்.

(b) தாழ்வழுத்த மின் வழங்கலுக்கு, பதிவான மின்தேவை 112 கிலோவாட் அளவுக்கு மிகையாகாமல் இருக்கும்போது, ஒப்பளிக்கப்பட்ட மின்தேவைக்கு மிகையான ஒவ்வொரு கிலோவாட் அல்லது அதனுடைய பகுதிக்கான மிகை மின் தேவைக் கட்டணங்கள் மின் ஆற்றல் கட்டணத்தில் 1 விழுக்காடு வீதத்தில் இருத்தல் வேண்டும், மற்றும் பதிவான மின்தேவை 112 கிலோவாட் அளவைவிட மிகையாகும்போது, மிகை மின்தேவைக் கட்டணங்கள் இந்த ஒழுங்குமுறைவிதியின் 2(ii)(c)ஆம் உள் ஒழுங்குமுறைவிதியின் பத்தி (II) இல் குறித்துரைக்கப்பட்டவாறு இருத்தல் வேண்டும்";

(3) 22 ஆம் ஒழுங்குமுறைவிதியில், (3) ஆம் உள் ஒழுங்குமுறைவிதிக்கு பதிலாக பின்வரும் உள் ஒழுங்குமுறைவிதி மாற்றியமைக்கப்படுதல் வேண்டும், அவையாவன:-

"(3) ஆறு மாதங்கள் அல்லது அதற்குமேல் துண்டிப்பில் இருக்கும் உயர் அழுத்த மின்னிணைப்பினை மீட்டுத்தருவதற்கு, நிறுவல் அமைப்பின் பாதுகாப்பு மற்றும் இடர்காப்பு தொடர்பாக உரிய அதிகார அமைப்பிடமிருந்து ஒப்புதல் பெறப்படவேண்டும்.";

விளக்கவுரை

1. தமிழ்நாடு மின் பகிர்மான விதித்தொகுப்பின் 39 ஆம் ஒழுங்குமுறைவிதியின் (2) ஆம் உள் ஒழுங்குமுறைவிதியின் (ii) ஆம் கூறு, மின் நுகரலுக்கான கட்டணத்தின் மூன்று மடங்கு தொகையை பிணை வைப்புத்தொகையாக வசூல் செய்யவும் மற்றும் அது தற்காலிக மின் வழங்கல் காலம் முழுவதும் பராமரிக்கப்பட வேண்டும் எனவும் வகை செய்கிறது. அவ்வாறிருக்கையில் மின்நுகர்வுக் கட்டணம் முன்னதாக வசூல் செய்யவும் மற்றும் மின்நுகர்வுக் கட்டணங்கள் முன்னதாகச் செலுத்தப்பட்டுள்ள மின்நுகர்வுக் கட்டணங்களிலிருந்து சரிகட்டுவதற்கும் வகை செய்யும் தமிழ்நாடு மின் வழங்கல் விதித்தொகுப்பின் 4 ஆம் ஒழுங்குமுறைவிதியின் (1) ஆம் உள் ஒழுங்குமுறைவிதியின் (vi) ஆம் கூறு, தமிழ்நாடு மின் பகிர்மான விதித்தொகுப்பின் மேற்சொன்ன வகைமுறைகளுக்கு முரண்பாடாக உள்ளது. எனவே அது நீக்கப்பட வேண்டியது அவசியமாகும்.

2. அனைத்து வகையினத்திற்கும் மிகை மின்தேவைக் கட்டணங்கள் வசூல் செய்வது என்ற கோட்பாட்டினை நடைமுறைப்படுத்துவதற்காகவும் மற்றும் வசூல் செய்யும் பொருட்டும் உயர் அழுத்தத்திற்கு அல்லது தாழ்வழுத்தத்திற்கு பொருந்தக்கூடிய மிகை மின்தேவைக் கட்டணங்களுக்கு இணையாக நேர்வுக்கேற்ப தற்காலிக மின்வழங்கலுக்கும் மிகை மின்தேவைக் கட்டணங்கள் விதிப்பதற்கு தீர்மானிக்கப்பட்டுள்ளது.

3. 2010 ஆம் ஆண்டு மத்திய மின்சார அதிகார அமைப்பு (பாதுகாப்பு மற்றும் மின் வழங்கல் தொடர்பான நடவடிக்கைகள்) ஒழுங்குமுறைவிதிகள், ஆறு மாதங்களுக்கு மேலாக மின்துண்டிப்பில் இருக்கும் மின்னிணைப்பிற்கு மின் வழங்கல் மீட்டுத்தருவதற்கு முன்னர் மின் ஆய்வாளரின் ஆய்வுக்கு வகைசெய்கிறது. எனவே மேற்சொன்ன வகைமுறைக்கிணங்க, தமிழ்நாடு மின் வழங்கல் விதித்தொகுப்பின் 22 ஆம் ஒழுங்குமுறை விதிக்கு திருத்தம் செய்வதற்கு தீர்மானிக்கப்பட்டுள்ளது.

4. இந்த திருத்தங்கள் மேற்சொன்ன முன்மொழிவினை செயற்படுத்துவதற்கு முற்படும்.

(b) தாழ்வழுத்த மின் வழங்கலுக்கு, பதிவான மின்தேவை 112 கிலோவாட் அளவுக்கு மிகையாகாமல் இருக்கும்போது, ஒப்பளிக்கப்பட்ட மின்தேவைக்கு மிகையான ஒவ்வொரு கிலோவாட் அல்லது அதனுடைய பகுதிக்கான மிகை மின் தேவை கட்டணங்கள் மின் ஆற்றல் கட்டணத்தில் 1 விழுக்காடு வீதத்தில் இருத்தல் வேண்டும், மற்றும் பதிவான மின்தேவை 112 கிலோவாட் அள-ை வவிட மிகையாகும் போது, மிகை மின்தேவைக் கட்டணங்கள் இந்த ஒழுங்குமுறைவிதியின் (2) (ii) (c) ஆம் உள்ஒழுங்குமுறைவிதியின் பத்தி (II) இல் குறித்துரைக்கப்பட்டவாறு இருத்தல் வேண்டும்.
