No.II(2)/HOPE/929/2018.—In exercise of the powers conferred by rule 35 of the Tamil Nadu Indian-made Foreign Spirits (Manufacture) Rules, 1981, the Governor of Tamil Nadu hereby exempts Thiruvalargal Enrica Enterprises Private Limited, Indian Made Foreign Spirits manufacturing unit, Poonamallee, Tiruvallur District from the operation of sub-rule (2) of rule 11 of the said Rules, to carry out and complete the remaining construction works such as replacement of Asbestos roofi ng Sheets, Expansion of existing warehouse, Erection of Spirit Storage tanks, construction of mezzanine fl oors and a shed etc., subject to the condition that the said works shall be completed within three months.
2. This Notifi cation shall be deemed to have come into force with effect on and from the 2nd June 2018.

No.II(2)/HOPE/928/2018.—In exercise of the powers conferred by sub-section (1) of Section 18-B of the Tamil Nadu Prohibition Act, 1937 (Tamil Nadu Act X of 1937), the Governor of Tamil Nadu, hereby makes the following amendment to the Prohibition and Excise Department Notifi cation No.II(1)/PE/239(d)/81, published at page 2 of 4th September 2018, ஆவணி 19, விளம்பி, திருவள்ளுவர் ஆண்டு-2049.]
No.II(2)/LE/930/2018.—In exercise of the powers conferred by Section 87 read with Section 91A of the Employees' State Insurance Act, 1948, (Central Act XXXIV of 1948), the Governor of Tamil Nadu hereby exempts the Tamil Nadu Civil Supplies Corporation, Chennai from978 TAMIL NADU GOVERNMENT GAZETTE [Part II—Sec. 2 the operation of the said Act for the period of one year from 25-7-2018 to 24-7-2019.
(1) The above exemption is subject to the following conditions, namely:- .
(a) The aforesaid Management wherein the employees are employed shall maintain a Register showing the names and designations of the exempted employees.
(c) examine the principal or immediate employer, his agent or servant or any person found in such Management offi ce or other premises, or any person when the said Social Security Offi cer or other offi cial has reasonable cause to believe to have been an employee; or
(d) make copies of or take extracts from any register, account book or other document maintained in such Management offi ce or other premises.
Exemption to the Poompuhar shipping Corporation
Limited, Chennai for the period of One year from
8-7-2018 to 7-7-2019 under the Act.
(b) Not withstanding the exemption, the employees shall continue to receive such benefi ts under the said Act to which they might have become entitled to on the basis of the contributions paid prior to the date from which exemption granted by this Notifi cation operates.

(c) The contribution for the exempted period, if already paid shall not be refunded.
(2) The employer of the said management shall submit in respect of the period during which that Management was subject to the operation of the said Act (hereinafter referred to as "the said period") returns, in such form and containing such particulars as were due from it in respect of the said period under the Employees State Insurance (General) Regulations, 1950.
(3) Any Social Security Offi cer appointed by the Corporation under sub-section (1) of section 45 of the said Act, or other offi cial authorised in this behalf shall, for the purpose of,-
(i) verifying the particulars contained in any return submitted under sub-section (1) of section 44 of the said Act for the said period; or
(ii) ascertaining whether registers and records were maintained as required by the Employees State Insurance (General) Regulations, 1950 for the said period; or
(iii) ascertaining whether the employees continue to be entitled to the benefi ts provided by the employer in cash and in kind, being benefi ts in consideration of which exemption is being granted under this Notifi cation; or
(iv) ascertaining whether any of the provisions of the said Act had been complied with during the period when such provisions were in force in relation to the said workshops and stores be empowered to,- (a) require the principal or immediate employer to furnish to him such information as he may consider necessary; or
(b) enter any Management, offi ce or other premises occupied by such principal or immediate employer at any reasonable time and require any person found in charge thereof to produce to such Social Security Offi cer or other offi cial and allow him to examine such documents, books and other documents relating to the employment of persons and payment of wages or to furnish to him such information as he may consider necessary; or

No.II(2)/LE/931/2018.—In exercise of the powers conferred by Section 87 read with Section 91A of the Employees' State Insurance Act, 1948, (Central Act XXXIV of 1948), the Governor of Tamil Nadu hereby exempts the Poompuhar Shipping Corporation Limited, Chennai from the operation of the said Act for the period of one year from 8-7-2018 to 7-7-2019.
(1) The above exemption is subject to the following conditions, namely:- .
(a) The aforesaid Management wherein the employees are employed shall maintain a Register showing the names and designations of the exempted employees.

No. II(2)/LE/933/2018.—இந்த ஆணையின் இணைப்பில் குறிப்பிட்டுள்ள பொருள் தொடர்பாக எம்.ஆர்.எப். லிமிடெட், சென்னை என்ற நிர்வாகத்திற்கும், எம்.ஆர்.எப். தொழிலாளர்கள் சங்கம் என்ற தெழிற்சங்கத்திற்குமிடையே தொழிற்தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்;
மேற்சொன்ன தகராறை சென்னை, தொழிற்தீர்ப்பாயத்தின் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;
1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்திய சட்டம்-XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தகராறு, சென்னை, தொழிற்தீர்ப்பாயத்தின் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

No. II(2)/LE/932/2018.—இந்த ஆணையின் இணைப்பில் குறிப்பிட்டுள்ள பொருள் தொடர்பாக எம்.ஆர்.எப். லிமிடெட், சென்னை என்ற நிர்வாகத்திற்கும், எம்.ஆர்.எப். தொழிலாளர்கள் சங்கம் என்ற தெழிற்சங்கத்திற்குமிடையே தொழிற்தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்;
மேற்சொன்ன தகராறை சென்னை, தொழிற்தீர்ப்பாயத்தின் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

மேலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு சென்னை, தொழிற்தீர்ப்பாயத்தை கேட்டுக்கொள்ளப்படுகிறது.

நிலையாணை விதி 14-ல் கூறியுள்ளவாறு குற்றம் சாட்டப்பட்ட தொழிலாளிக்கு உதவி புரிய ஆஜராகும் சக தொழிலாளிக்கு கோரிக்கை 1-ல் கூறியுள்ள விதத்தில் பங்கேற்க உரிமை உள்ளது என்று பொருள் விளக்கம் கொடுக்கப்பட வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயம்தானா? ஆம் எனில், உரிய உத்தரவுகள் பிறப்பிக்கவும்.
