MUNICIPAL ADMINISTRATION AND WATER SUPPLY DEPARTMENT

NOTIFICATION UNDER THE PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITATION ACT, 2013.

Under Section 18 of the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013 (Central Act 25 of 2013), the Governor of Tamil Nadu hereby confers the powers and impose the duties on the local authority, as defi ned in clause (f) of sub-section (1) of Section 2 of the said Act and on the District Magistrate, to ensure that the provisions of the Act are properly carried out, as specifi ed below:-

I. Local Authority:

(i) survey of insanitary latrines existing within its jurisdiction;

(ii) publishing a list of such insanitary latrines;

(iii) demolition and removal of insanitary latrines;

(iv) construction of sanitary community latrines in necessary areas and in adequate numbers;

(v) take all necessary steps towards elimination of the practice of open defecation;

(vi) ensure that no person is engaged or employed, either directly or indirectly, for hazardous cleaning of a sewer or a septic tank;

(vii) carry out a survey of manual scavengers in necessary circumstances;

(viii) creation of awareness that no insanitary latrine shall be constructed, used or maintained; and(ix) use appropriate technological appliances for cleaning of sewers, septic tanks and other spaces within its control. [ 1 ] II-2 Ex. (74) 2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY

II. District Magistrate:

(i) rehabilitation of manual scavengers identifi ed under the Act;

(ii) ensuring prohibition of engagement of a person as a manual scavenger by any person or institution within his territorial jurisdiction;

(iii) ensuring that no person or institution constructs, maintains, uses or makes available for use, an insanitary latrines;

(iv) ensuring that persons contravening the provisions of the said Central Act 25 of 2013 are investigated and prosecuted under the relevant provisions of the Act; and

(v) ensuring due compliance of all provisions of the Act applicable within his jurisdiction including by the local authorities.

Further, under Section 18 of the said Central Act 25 of 2013, the Governor of Tamil Nadu hereby authorizes the local authority and the District Magistrate to specify the subordinate offi cers, who shall exercise all or any of the powers, and perform all or any of the duties and the local limits within which such powers or duties shall be carried out by the offi cer or offi cers so specifi ed, strictly in accordance with the provisions of the said Central Act 25 of 2013 and the relevant provisions of the other Central and State Legislations.
