Amendments to the Tamil Nadu Electricity Regulatory Commission - Conduct of Business Regulations, 2004

In exercise of the powers conferred by clause (zk) of sub-section (2) of Section 181 read with sub-section (1) of Section 92 of the Electricity Act, 2003 (Central Act 36 of 2003) and all other powers enabling it in this behalf, the Tamil Nadu Electricity Regulatory Commission hereby makes the following amendment to the Tamil Nadu Electricity Regulatory Commission – Conduct of Business Regulations, 2004, the draft of the same having been previously published as required by sub-section (3) of Section 181 of the said Act.

In the said Regulations, in regulation 31, for sub-regulation (6), the following sub-regulation shall be substituted, namely;-
"(6) (a) All orders of the Commission shall be deemed to have been communicated to the parties from
the date of hosting of the same in the website of the Commission and for the purpose of compliance of the
orders of the Commission by any party, the downloaded copy of the order of the Commission, as attested by
the counsel for any of the parties to the proceedings before the Commission with his name, seal along with
enrolment number, is deemed to be sufficient for such compliance and shall be accepted and acted upon by a
party which is required to comply with the orders of the Commission.
(b) In all cases concerning initiation of proceedings by any affected or interested person under Regulation
16(1) of the Conduct of Business Regulation consequent to the direction of the High Court or any other forum,
the downloaded and printed copy of the order of the High Court or any other forum and attested by the counsel
for any of the parties before the Commission with his name, seal along with enrolment number shall be deemed
to be sufficient for initiating such proceedings under Regulation 16(1) of the Conduct of Business Regulation,
subject to verification of authenticity of the same with the website of such Forum by the designated officer".

In order to avoid diffi culties caused due to delay in the issue of certifi ed copies of orders / judgements, the Hon'ble High Court of Madras in its order dated 8-1-2019 in W.M.P.No.5 of 2019 in W.P.No.5 of 2019 in the matter of Thiru. P.Gunasekara Senthil Vs AEE/O&M, TANGEDCO, Palayamkottai, Kangeyam, Tiruppur District evolved an alternate mechanism to avoid inconvenience to the litigant and the learned counsels appearing for the parties. The relevant portions of the order / judgements of the High Court of Madras are re-produced below.

11. ……………….... The respective learned counsels appearing for the parties to the lis can download
the orders / judgement copies from the official website of the Hon'ble High Court of Madras and the copy of
the order shall be attested with the Name and Seal of the learned counsel on record along with the enrollment
number and communicate the same to all the parties concerned for implementation of the orders / judgements
of this Court. In the event of communicating any such orders / judgements downloaded and printed from the
official website of the Hon'ble High Court of Madras, the authorities concerned / competent are bound to receive
the same and verify the authenticity of the copy of the order with the official website of the Hon'ble High Court
of Madras and thereafter, initiate action for effective implementation without any further delay.

orders / judgements communicated by the respective learned counsels. All concerned officials are directed to
acknowledge all such orders / judgements and act accordingly. In the event of any violation in this regard, the
persons aggrieved are at liberty to approach the court by filing an appropriate application for violation of the
Court Orders / judgements."
2. The Commission has decided to incorporate the above procedure in its TNERC - Conduct of Business Regulations for the initiation of proceedings before this Commission based on the orders / directions of the Hon'ble High Court and further extend it for compliance of its orders. It has also been decided by the Commission that the date of hosting of the orders of the Commission shall be the date on which such orders are communicated to the parties concerned.
3. The proposed amendment seeks to give effect to the above decisions.

2004-ஆம் ஆண்டு தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணைய அலுவல் நடத்துகை ஒழுங்குமுறைவிதிகளுக்கான திருத்தம் 2004-ஆம் ஆண்டு தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணைய அலுவல் நடத்துகை ஒழுங்குமுறைவிதிகளுக்கான திருத்தம் (அறிவிக்கை எண். தமிஒஆ/அநஒ/1-2, நாள்: 18-3-2019)
2003-ஆம் ஆண்டு மின்சாரச் சட்டத்தின் (மத்தியச் சட்டம் 36/2003) 92 ஆம் பிரிவின் (1) ஆம் உட்பிரிவுடன் சேர்த்துப்படிக்கப்படும் 181 ஆம் பிரிவின் (2) ஆம் உட்பிரிவின் (zk) கூறினால் வழங்கப்பட்ட அதிகாரங்களையும் மற்றும் இதன்பொருட்டு அதனை இயல்விக்கும் அனைத்துப் பிற அதிகாரங்களையும் செலுத்தி, தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணையம் 2004-ஆம் ஆண்டு தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணைய அலுவல் நடத்துகை ஒழுங்குமுறைவிதிகளுக்கு பின்வரும் திருத்தத்தினைச் செய்கிறது. மேற்சொன்ன சட்டத்தின் 181-ஆம் பிரிவின் (3) ஆம் உட்பிரிவினால் வேண்டுறுத்தப்பட்டவாறு அதன் வரைவு முன்னதாக வெளியிடப்பட்டுள்ளது.
திருத்தம்திருத்தம்
மேற்சொன்ன ஒழுங்குமுறைவிதிகளில் 31-ஆம் ஒழுங்குமுறைவிதியில் (6)ஆம் உள் ஒழுங்குமுறைவிதிக்கு பதிலாக பின்வரும் உள் ஒழுங்குமுறைவிதி மாற்றியமைக்கப்படுதல் வேண்டும், அவையாவன :-
"(6) (a) ஆணையத்தின் ஆணைகள் அனைத்தும் அவைகள் ஆணையத்தின் வலைதளத்தில் பதிவேற்றம் செய்யப்பட்ட நாளிலிருந்து சம்பந்தப்பட்ட தரப்பினர்களுக்கு தெரிவிக்கப்பட்டுள்ளதாகக் கருதப்படுதல் வேண்டும் மற்றும் ஏதாவது ஒரு தரப்பினர் ஆணையத்தின் ஆணைகளை நிறைவேற்றும் நோக்கத்திற்காக, ஆணையத்தின் முன் நடைபெற்ற செயல்முறை நடவடிக்கை தொடர்புடைய ஏதாவது ஒரு தரப்பினரின் வழக்குரைஞரால் அவருடைய பெயர், முத்திரை மற்றும் பதிவு எண்ணுடன் சான்றொப்பமிட்ட பதிவிறக்கம் செய்யப்பட்ட ஆணையத்தின் ஆணையின் நகல், ஆணையத்தின் நடவடிக்கைகளை நிறைவேற்றுவதற்கு போதுமானதாக கருதப்படவேண்டும் மற்றும் ஆணையத்தின் ஆணைகளை நிறைவேற்றவேண்டிய தரப்பினரால் அத்தகைய நகல் ஏற்றுக் கொள்ளப்பட்டு நிறைவேற்றப்பட வேண்டும்.
(b) உயர்நீதிமன்றம் அல்லது ஏதாவது நீதிமன்றத்தின் ஆணையின்பேரில் அலுவல் நடத்துகை ஒழுங்குமுறைவிதியின் 16 ஆம் ஒழுங்குமுறைவிதியின் (1) ஆம் உள் ஒழுங்குமுறைவிதியின்கீழ் ஏதாவது பாதிக்கப்பட்ட அல்லது அக்கறையுள்ள நபரினால் தொடரப்படும் அனைத்து செயல்முறை நடவடிக்கைகளிலும், உயர்நீதிமன்றம் அல்லது ஏதாவது பிற நீதிமன்றத்தின் பதிவிறக்கம் செய்து அச்சடிக்கப்பட்ட ஆணையின் நகல் ஆணையத்தின் முன் நடைபெற்ற செயல்முறை நடவடிக்கையில் தொடர்புள்ள ஏதாவது தரப்பினரின் வழக்குரைஞரால் அவருடைய பெயர், முத்திரை மற்றும் பதிவு எண்ணுடன் சான்றொப்பமிட்ட நகல் ஆணையத்தின் முன் தாக்கல் செய்யப்படும் மனுவினை பெறும் நோக்கத்திற்காக பணியமர்த்தப்பட்ட குறிப்பிடப்பட்ட ஆணையத்தின் அலுவலரால் அத்தகைய நீதிமன்றத்தின் வலைதளத்தில் சரிபார்ப்புக்குட்பட்டு அலுவல் நடத்துகை ஒழுங்குமுறைவிதியின் 16-ஆம் ஒழுங்குமுறைவிதியின் (1) ஆம் உள் ஒழுங்குமுறைவிதியின்கீழ் அத்தகைய செயல்முறை நடவடிக்கைகள் தொடங்குவதற்கு போதுமானதாகக் கருதப்படுதல் வேண்டும்.

மாண்புமிகு சென்னை உயர்நீதிமன்றம் நீதிப்பேராணை மனு எண்.5/2019-இன் நீதிப்பேராணை பலவகை மனு எண்.5/2019 நாள் 8-1-2019 ஆணையில் திரு. ப்பி. குணசேகர செந்தில் - எதிர் - உதவிச் செயற்பொறியாளர்/இயக்கம் மற்றும் பராமரிப்பு, தமிழ்நாடு மின் உற்பத்தி மற்றும் பகிர்மான கழகம், பாளையங்கோட்டை, காங்கேயம், திருப்பூர் மாவட்டம் என்ற பொருளில் சான்றளிக்கப்பட்ட ஆணைகள்/தீர்ப்புரைகளின் நகல்கள் வழங்குவதிலுள்ள காலதாமதத்தினால் ஏற்படும் இடையூறுகளை தவிர்ப்பதற்காகவும், தரப்பினர்களுக்காக ஆசராகும் கற்றறிந்த வழக்குரைஞர்களுக்கும் மற்றும் வழக்குத் தொடர்பவருக்கும் ஏற்படும் தொல்லைகளைக் களைவதற்காகவும் ஒரு மாற்று அமைப்புமுறையினை உருவாக்கியுள்ளது. சென்னை, உயர்நீதிமன்ற ஆணை/தீர்ப்புரையின் தொடர்புடைய பாகங்கள் கீழே கொடுக்கப்பட்டுள்ளது.

11. xx xx xx xx xx xx வழக்குகளில் சம்பந்தப்பட்ட தரப்பினர்களுக்காக ஆசராகும் கற்றறிந்த வழக்குரைஞர்கள் சென்னை உயர்நீதிமன்றத்தின் அலுவலக வலைதளத்திலிருந்து ஆணைகள்/தீர்ப்புரைகளின் நகல்களை பதிவிறக்கம் செய்து அந்த ஆணை நகல்களை வழக்கு தொடர்புடைய வழக்குரைஞரின் பதிவு எண், பெயர் மற்றும் முத்திரையுடன் சான்றொப்பமிட்டு இந்த நீதிமன்றத்தின் ஆணைகள்/ தீர்ப்புரைகளை செயல்படுத்துவதற்காக அதனை தொடர்புடைய அனைத்து தரப்பினர்களுக்கும் தெரிவிக்கலாம். மாண்புமிகு உயர்நீதிமன்றத்தின் அலுவலக வலைதளத்திலிருந்து பதிவிறக்கம்செய்து அச்சிட்ட ஏதாவது அத்தகைய ஆணைகள்/தீர்ப்புரைகளை அனுப்பும் நேர்வில், சம்பந்தப்பட்ட தகுதியான அலுவலர்கள் அவைகளை பெறுவதோடு அலுவலக வலைதளத்திலிருந்து ஆணை நகலின் நம்பத்தன்மையினை சரிபார்ப்பதோடு அதன் பின்னர் காலதாமதமின்றி செயல்படுத்துவற்கான நடவடிக்கை எடுக்கவேண்டும்.
12. சம்பந்தப்பட்ட அலுவலர்கள் தொடர்புடைய கற்றறிந்த வழக்குரைஞர்களால் அனுப்பப்பட்டுள்ள அச்சிடப்பட்ட / பதிவிறக்கம் செய்யப்பட்ட ஆணைகள்/தீர்ப்புரைகளின் நகல்களை பெறாமல் இருப்பதோ அல்லது பெற மறுப்பதோ கூடாது எனத் தெளிவுபடுத்தப்படுகிறது. தொடர்புடைய அனைத்து அலுவலர்களும் அத்தகைய ஆணைகள்/தீர்ப்புரைகள் அனைத்துக்கும் ஒப்புதலளிப்பதோடு ஆணைக்கிணங்க செயல்படவேண்டும்June 19, 2019] TAMIL NADU GOVERNMENT GAZETTE 81 எனவும் கட்டளையிடப்படுகிறது. இந்த நிகழ்வில் ஏதாவது மீறல் இருப்பின் பாதிக்கப்பட்ட நபர்கள் நீதிமன்ற ஆணைகள்/தீர்ப்புரைகளின் மீறலுக்கு உரிய மனு தாக்கல் மூலம் நீதிமன்றத்தை அணுகுவதற்கு உரிமையுடையராவர்.
2. மாண்புமிகு உயர்நீதிமன்ற ஆணைகள்/கட்டளைகளின் அடிப்படையில் ஆணையத்தின் முன் செயல்முறை நடவடிக்கைகள் தொடங்குதல் தொடர்பான மேற்சொன்ன நடைமுறையினை ஆணையம் அதனுடைய தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணைய அலுவல் நடத்துகை ஒழுங்குமுறை விதிகளில் ஒன்றுசேர்க்க முடிவு செய்துள்ளது மற்றும் அதனுடைய ஆணைகளின் இணக்கத்திற்கும் அதனை நீட்டித்துள்ளது. மேலும், அதனுடைய ஆணைகளை பதிவேற்றம் செய்த நாள் அத்தகைய ஆணைகள் சம்பந்தப்பட்ட தரப்பினர்களுக்கு தெரிவிக்கப்பட்ட நாளாக இருத்தல் வேண்டும் என்று ஆணையத்தால் முடிவு செய்யப்பட்டுள்ளது.
3. உத்தேசிக்கப்பட்ட திருத்தமானது மேற்சொன்ன முடிவுகளை செயற்படுத்துவதற்கு முற்படும்.

31 (6) ஆணையத்தின் ஆணைகள் அனைத்தும் செயலாளரின் அல்லது இது குறித்து ஆணையத்தினால் அதிகாரமளிக்கப்பட்ட அலுவலரின் கையொப்பத்துடன் ஆணையத்தினால் ஆணை பிறப்பிக்கப்பட்டதிலிருந்து ஏழு நாட்களுக்குள் ஆணையத்தின் செயல்முறை நடவடிக்கையில் சம்பந்தப்பட்ட தரப்பினர்களுக்கு தெரிவிக்கப்படுதல் வேண்டும்.
31 (6) (a) ஆணையத்தின் ஆணைகள் அனைத்தும் அவைகள் ஆணையத்தின் வலைதளத்தில் பதிவேற்றம் செய்யப்பட்ட நாளிலிருந்து சம்பந்தப்பட்ட தரப்பினர்களுக்கு தெரிவிக்கப்பட்டுள்ளதாகக் கருதப்படுதல் வேண்டும் மற்றும் ஏதாவது ஒரு தரப்பினர் ஆணையத்தின் ஆணைகளை நிறைவேற்றும் நோக்கத்திற்காக ஆணையத்தின் முன் நடைபெற்ற செயல்முறை நடவடிக்கை தொடர்புடைய ஏதாவது ஒரு தரப்பினரின் வழக்குரைஞரால் அவருடைய பெயர், முத்திரை மற்றும் பதிவு எண்ணுடன், சான்றொப்பமிட்ட / பதிவிறக்கம் செய்யப்பட்ட ஆணையத்தின் ஆணையின் நகல், ஆணையத்தின் நடவடிக்கைகளை நிறைவேற்றுவதற்கு போதுமானதாக கருதப்படவேண்டும் மற்றும் ஆணையத்தின் ஆணைகளை நிறைவேற்றவேண்டிய தரப்பினரால் அத்தகைய நகல் ஏற்றுக் கொள்ளப்பட்டு நிறைவேற்றப்பட வேண்டும்.

It is hereby notifi ed that the Original Higher Secondary Certifi cates / Matriculation Certifi cates / Diploma Certifi cates / School Certifi cates of the following pupils are reported to have been lost beyond recovery. Necessary steps are being taken to issue the duplicate of the said Certifi cates. If the Originals were to be found by anybody, they should be treated as invalid and sent to the Secretary, Board of Higher Secondary Examination / Directorate of Government Examinations, Chennai-6 / Director of Technical Education, Chennai-25 / Inspector / Inspectress of Matriculation and Anglo-Indian Schools as the case may be for cancellation:–
