(2) Dearness Allowance.-The employees referred to above, apart from the minimum rates of basic wages, are eligible for getting dearness allowance as detailed below:-

(i) The dearness allowance shall be linked to the Average Chennai City Consumer Price Index Number for the year 2010, that is 161 points (with base 2001 = 100) and for every raise of one point over and above 161 points, an increase of Rs. 1.20 (Rupee One and Twenty paise only) per day shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated every year on the fi rst April on the basis of the average consumer price indices of the preceding twelve months, that is, from January to December.

(iii) The fi rst calculation shall thus be effective from the date of publication of this Notifi cation in the Tamil Nadu Government Gazette based [G.O. மேற்சொன்ன தொழிற்தகராறை நீதிமன்றத் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

திரு M. ஜனார்த்தனன் பணி எண். 52428 ஓட்டுனருக்கு வருடாந்திர ஊதிய உயர்வினை அதன் திரண்ட பயன்களுடன் ஒரு (1) வருட காலத்திற்கு நிறுத்தம் செய்து நிர்வாகம் வழங்கிய 06-06-2015 நாளிட்ட உத்தரவினை ரத்து செய்ய வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானதா? ஆம் எனில், உரிய உத்தரவு பிறப்பிக்கவும்.

1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்திய சட்டம் XIV/1947) 10(1) (c) பிரிவிலும், 10(1) (d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ளஅதிகாரங்களைக் கொண்டு தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தொழிற்தகராறு, திருநெல்வேலி தொழிலாளர் நீதிமன்றத் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2ஏ) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு திருநெல்வேலி, தொழிலாளர் நீதிமன்றம் கேட்டுக் கொள்ளப்படுகிறது.

மேலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு சேலம், தொழிலாளர் நீதிமன்றத்திடம் கேட்டுக் கொள்ளப்படுகிறது.

தொழிலாளர் மற்றும் வேலைவாய்ப்புத் துறையின் அரசாணை (டி) எண் 224, நாள் 06-05-2019. அரசாணையில் அறிவிக்கை பகுதியில், இடம் பெற்றுள்ள "சென்னை, தொழிலாளர் நீதிமன்றம்" எனும் சொற்களுக்குப் பதிலாக "காஞ்சிபுரம், தொழிலாளர் நீதிமன்றம்" என திருத்தி படிக்கவும்.
