Amendment to Notification

NOW, THEREFORE, in exercise of the powers conferred by Section 3 of the Tamil Nadu Protection of Interests of Depositors (in Fincinciai Establishments) Act, 1997 (Tamil Nadu Act 44 of 1997), the Governor of Tamil Nadu hereby makes an ad-interim order attaching the immovable property standing in the name of Thiru R.Vijayaraghavan, son of K. Raju Naidu, one of the partner of Messers Srinivasaperumal Financing Corporation, Coimbatore District, as specifi ed in the Schedule to this order and transfers the control over the said immovable property to the Competent Authority, namely, the Competent Authority and District Revenue Offi cer, Coimbatore District appointed under the said Act.

2. The Competent Authority and District Revenue Offi cer, Coimbatore District, is requested to pursue further action in accordance with the procedure laid down in sub-sections (3) and (4) of Section 4 of the said Act and also the formalities prescribed in the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Rules, 1997.

3. The Special Public Prosecutor, Special Court for the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997, Colmbatore, is requested to render necessary assistance to the Competent Authority for fi ling the application before the said Special Court constituted under the said Act.

Tamil Nadu Ex-servicemen's Corporation Limited (TEXCO), Chennai from the operation of the said Act for the period of one year from 08-07-2019 to 07-07-2020.

(1) The above exemption is subject to the following conditions, namely:-

(a) The aforesaid Management wherein the employees are employed shall maintain a Register showing the names and designations of the exempted employees.

(2) The employer of the said management shall submit in respect of the period during which that Management was subject to the operation of the said Act (hereinafter referred to as "the said period") returns in such form and containing such particulars as were due from it in respect of the said period under the Employees State Insurance (General) Regulations, 1950.

ஆனி 31, விகாரி, திருவள்ளுவர் ஆண்டு-2050.] No.II(2)LE)/627/2019.—In exercise of the powers conferred by clause (a) of sub-section (1) of Section 5 read with Section 9 of the Minimum Wages Act, 1948 (Central Act XI of 1948), the Governor of Tamil Nadu hereby appoints a Committee consisting of the following members to hold enquiries and advise the Government in respect of revision of minimum rates of wages for the employment in hospitals and nursing homes (other than Government and Employees State Insurance Hospitals and Dispensaries):-

(3) Any Social Security Offi cer appointed by the Corporation under sub-section (1) of Section 45 of the said Act, or other offi cial authorised in this behalf shall, for the purpose of,-

(i) verifying the particulars contained in any return submitted under sub-section (1) of Section 44 of the said Act for the said period; or (ii) ascertaining whether registers and records were maintained as required by the Employees State Insurance (General) Regulations, 1950 for the said period; or

(c) examine the principal or immediate employer, his agent or servant, or any person found in such Management Offi ce or other premises, or any person when the said Social Security Offi cer or other offi cial has reasonable cause to believe to have been an employee; or

(d) make copies of or take extracts from any register, account book or other document maintained in such Management offi ce of other premises.

மேற்சொன்ன தகராறை சென்னை, தொழிலாளர் நீதிமன்றத் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்திய சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தகராறு, சென்னை தொழிலாளர் நீதிமன்றத் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு சென்னை தொழிலாளர் நீதிமன்றம் கேட்டுக் கொள்ளப்படுகிறது.
