(b) Notwithstanding the exemption, the employees shall continue to receive such benefits under the said Act to which they might have become entitled to on the basis of the contributions paid prior to the date from which exemption granted by this Notification operates.

[G.O.Ms.No.508, Home (Courts-II) 25th September 2019, புரட்டாசி 8, விகாரி, திருவள்ளுவர் ஆண்டு&2050. ] No.II(2)/HO/823/2019.—In exercise of the powers conferred by the proviso to sub-section (1) of Section 11 of the code of criminal Procedure, 1973 (central Act 2 of 1974), the Governor of Tamil Nadu, after consultation with the High court, Madras, hereby makes the following amendment to the Home Department Notification No. II(2)/HO/886/2017, published at page 844 of Part II—Section 2 of the Tamil Nadu Government Gazette, dated the 25th October 2017:-

In the said Notification, for the expression, "establishes one Special court of Judicial Magistrate at Salem, Krishnagiri, Dharmapuri and Namakkal to try the commercial crime Investigation wing, crime Investigation Department (ccIw cID) cases registered at Salem, Krishnagiri, Dharmapuri and Namakkal Districts, respectively, the expression "establishes the Judicial Magistrate court No. IV, Salem, Judicial Magistrate court No.II, Krishnagiri, Judicial Magistrate court No. II, Dharmapuri and Judicial Magistrate court No. II, Namakkal as Special courts to try the commercial crime Investigation wing Department (ccIw cID) cases registered at Salem, Krishnagiri, Dharmapuri and Namakkal districts, respectively, in addition to their regular work" shall be substituted.

(2) The employer of the said management shall submit in respect of the period during which that Management was subject to the operation of the said Act (hereinafter referred to as "the said period") returns, in such form and containing such particulars as were due from it in respect of the said period under the Employees State Insurance (General) Regulations, 1950.

(3) Any Social Security Officer appointed by the corporation under sub-section (1) of Section 45 of the said Act, or other official authorised in this behalf shall, for the purpose of,-

(i) verifying the particulars contained in any return submitted under sub-section (1) of Section 44 of the said Act for the said period; or

(ii) ascertaining whether registers and records were maintained as required by the Employees State Insurance (General) Regulations, 1950 for the said period; or

(iii) ascertaining whether the employees continue to be entitled to the benefits provided by the employer in cash and in kind, being benefits in consideration of which exemption is being granted under this Notification; or

(iv) ascertaining whether any of the provisions of the said Act had been complied with during the period when such provisions where in force in relation to the said workshops and stores be empowered to,- (a) require the principal or immediate employer to furnish to him such information as he may consider necessary; or

Exemption to the Tamil Nadu State Marketing Corporation

Limited Chennai for Certain Period under the

Employees' State Insurance Act.

No.II(2)/LE/824/2019.—In exercise of the powers conferred by Section 87 read with Section 91A of the Employees' State Insurance Act, 1948, (central Act xxxIV of 1948), the Governor of Tamil Nadu hereby exempts the M/s. Tamil Nadu State Marketing corporation Limited, chennai from the operation of the said Act for the period of one year from 01-10-2019 to 30-09-2020.

(1) The above exemption is subject to the following conditions, namely:-

(a) The aforesaid Management wherein the employees are employed shall maintain a Register showing the names and designations of the exempted employees.

(b) enter any Management, office or other premises occupied by such principal or immediate employer at any reasonable time and require any person found in charge thereof to produce to such Social Security Officer or other official and allow him to examine such documents, books and other documents relating to the employment of persons and payment of wages or to furnish to him such information as he may consider necessary; or

(c) examine the principal or immediate employer, his agent or servant, or any person found in such Management Office or other Primises, or any person when the said Social Security Officer or other official has reasonable cause to believe to have been an employee; or (d) make copies of or take extracts from any register, account book or other document maintained in such Management office or other premises.

No.II(2)/LE/825/2019.—wHEREAS the Governor of Tamil Nadu is satisfied that public interest requires that the "Industries Manufacturing and Marketing Earth Moving Equipments like dumpers, loaders, crawler, tractors, coal haulers and excavators" should be declared as a public utility service for the purposes of the Industrial Disputes Act, 1947 (central Act xIV of 1947);

NOw, THEREFORE, in exercise of the powers conferred by sub-clause (vi) of clause (n) of Section 2 of the said Act, the Governor of Tamil Nadu hereby declares the "Industries Manufacturing and Marketing Earth Moving Equipments like dumpers, loaders, crawler, tractors, coal haulers and excavators" to be a public utility service for the purposes of the said Act for a period of six months with effect on and from the date of publication of this Notification in the Tamil Nadu Government Gazette.

No.II(2)/LE/826/2019.—இந்த ஆணையின் இணைப்பில் குறிப்பிட்டுள்ள பொருள் தொடர்பாக, திருவள்ளூர் மாவட்டம், ஒதப்பை கிராமத்தில் இயங்கி வரும் DMc ஆட்டோமோடிவ் பிரைவேட் லிமிடெட் என்ற நிருவாகத்திற்கும் DMc ஆட்டோமோடிவ் பிரைவேட் லிமிடெட் தொழிலாளர்களுக்கான ஐவர் குழு என்ற தொழிற்சங்கத்திற்கும் இடையே தொழிற்தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்;

மேற்சொன்ன தகராறில், இணைப்பு 1-ல் காணும் 56 தொழிலாளர்களுக்காக தொழிற்சங்கம் வலியுறுத்தியுள்ள கோரிக்கை எண்கள் 1 முதல் 26 வரையுள்ள கோரிக்கைகளை சென்னை, தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்; 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்திய சட்டம் xIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தகராறு, சென்னை, தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு சென்னை, தொழிலாளர் நீதிமன்றம் கேட்டுக்கொள்ளப்படுகிறது.

தற்போது தொழிலாளர்களுக்கு வருடந்தோறும் தரமான 4 ஜோடி சீருடை மற்றும் 4 ஜோடி டி-சர்ட் வழங்க வேண்டும் என்ற மனுதாரர்களின் கோரிக்கை நியாயமானதுதானா? ஆம் எனில் உரிய உத்தரவுகள் பிறப்பிக்க.

1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்திய சட்டம் xIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தகராறு, கும்பகோணம், தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.
