The following Government Order is Published:

[G.O. (2D) No. 98, Home (Prison IV),22nd April 2020,

சித்திரை 9, சார்வரி, திருவள்ளுவர் ஆண்டு---2051.]

Read:

1. G.O.(Ms)No.549, Home (Prison.IV) Department, dated: 19.08.2018.

2. From the Director General of Police, Chennai-4 letter No.361/Crime. IV(2)/2020, Dated: 15.04.2020 3. From the Director General of Police / Inspector General of Prisons, Chennai-8 letter No.16380/ PW1/2017, Dated: 17.4.2020

Order:

In the order first read above, Government have established a Borstal School in the premises of transit yard in Central Prison, Puzhal under section 3(1) of the Tamil Nadu Borstal Schools Act, 1925 (Tamil Nadu Act V of 1925) for detaining adolescent offenders belonging to Chennai, Kancheepuram and Tiruvallur Districts.

2. The Director General of Police, Chennai-4, in his letter second read above has stated that, 14 cases are registered involving 129 foreign nationals (including some women foreigners) in the State for their violationof VISA conditions and other offences. The Commissioners of Police/ Superintendents of Police concerned are sending proposals to obtain the G.O. under section 3 (2) (e) of the Foreigners Act, 1946, to lodge them in a Special Camp till their deportation and they may be released on bail shortly. At present, Trichy Special Camp [1] II-2 Ex. (166) 2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY is the only Special Camp functioning in the State and it has 40 rooms available (including recently renovated 20 rooms), in which 80 persons as the maximum can only be accommodated. At present, 73 foreigners have been accommodated. About 20 foreigners are yet to be accommodated upon their release on bail from Central Prison, Puzhal, on whom already G.O. has been issued. Presently, Trichy Special Camp is facing space constraint to accommodate any foreigners. In the event of release of the above said 129 foreign nationals (including women foreigners), they have to be accommodated in a special camp, till their deportation. However, as mentioned above, there is no space for accommodating the said foreign nationals in Trichy Special Camp.

He has therefore, requested the Government to designate Borstal School, Puzhal Prison as a Special Camp, as suggested by the Director General of Police/ Inspector General of Prisons to accommodate the foreign nationals against whom 14 cases have been registered recently in the State for violation of VISA conditions and other offences and therefore notification earmarking Borstal School, Puzhal Prison as Special Camp may be issued by the Government at the earliest.

3. The Director General of Police/ Inspector General of Prisons, Chennai-8 in his letter third read above has stated that, in the meeting held with the Director General of Police on 13.04.2020, it was informed that the capacity of Trichy Special Camp is only 80 in which at present 73 foreigners have been accommodated. Further, many foreign nationals who have been remanded to judicial custody for violating visa conditions have to be accommodated in Special Camp in the event of their release on bail by the courts concerned. He has, therefore, requested the Government that the Borstal School, Puzhal which has the capacity of 110 persons can serve as Special Camp to accommodate the foreign nationals on their release from prison.

4. After examining the above proposal of the Director General of Police, Chennai-4 based on the report of the Director General of Police / Inspector General of Prisons, Chennai-8 third read above, Government have decided to rescind the earlier Notification issued in G.D. (Ms.) No.549, Home Department, dated 19.08.2014, establishing a Borstal School in the premises of the transit yard in Central Prison, Puzhal, under Section 3 (1) of the Tamil Nadu Borstal Schools Act, 1925 (Tamil Nadu Act V of 1925), by invoking the powers conferred under Section 3 (1) of the Tarnil Nadu Borstal Schools Act, 1925 (Tamil Nadu Act V of 1925) read with section 15 of the Tamil Nadu General Clauses Act, 1891 (Tamil Nadu Act 1 of 1891);

6. Accordingly, the following Notification shall be published in the Tamil Nadu Government Gazette Extraordinary, dated the 22nd April 2020:-

NOTIFICATION
