No.II(2)LE/29/2021.—In exercise of the powers conferred by Section 87 read with Section 91A of the Employees' State Insurance Act, 1948 (Central Act XXXIV of 1948), the Governor of Tamil Nadu hereby exempts the Tamil Nadu Ex-servicemen's Corporation, Limited (TEXCO), Chennai from the operation of the said Act for the further period of one year from 08.07.2020 to 07.07.2021.

(1) The above exemption is subject to the following conditions, namely:-

(b) enter any Management offi ce or other premises occupied by such principal or immediate employer at any reasonable time and require any person found in charge thereof to produce to such Social Security Offi cer or other offi cial and allow him to examine such documents, books and other documents relating to the employment of persons and payment of wages or to furnish to him such information as he may consider necessary; or

(c) examine the principal or immediate employer, his agent or servant, or any person found in such Management offi ce or other premises, or any person when the said Social Security Offi cer or other offi cial has reasonable cause to believe to have been an employee; or

(d) make copies of or take extracts from any register, account book or other document maintained in such Management offi ce or other premises.

Disputes between Workmen and Managements referred

to Labour Courts for Adjudication.

(a) The aforesaid Management wherein the employees are employed shall maintain a Register showing the names and designations of the exempted employees.

(b) Notwithstanding the exemption, the employees shall continue to receive such benefi ts under the said Act to which they might have become entitled to on the basis of the contributions paid prior to the date from which exemption granted by this Notifi cation operates.

(c) The contribution for the exempted period, if already paid shall not be refunded.

(2) The employer of the said Management shall submit in respect of the period during which that Management was subject to the operation of the said Act (herein after referred to as "the said period") returns, in such form and containing such particulars as were due from it in respect of the said period under the Employees State Insurance (General) Regulations, 1950.

(3) Any Social Security Officer appointed by the Corporation under sub-section (1) of Section 45 of the said Act, or other offi cial authorised in this behalf shall, for the purpose of,-

No.II(2)/LE/30/2021.—இந்த ஆணையின் இணைப்பில் குறிப்பிட்டுள்ள பொருள் தொடர்பாக, சாய்மிர்ரா இன்னோ பார்ம் பிரைவேட் லிமிடெட் என்ற நிர்வாகத்திற்கும் ஜனநாயகத் தொழிலாளர் சங்கம் என்ற தொழிற் சங்கத்திற்குமிடையே தொழிற் தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்;

மேற்சொன்ன தொழிற்தகராறை, சென்னை தொழிலாளர் நீதிமன்ற தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

1947-ஆம் ஆண்டு தகராறுகள் சட்டத்தின் (மத்திய சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தொழிற்தகராறு, சென்னை, தொழிலாளர் நீதிமன்றத் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு சென்னை, தொழிலாளர் நீதிமன்றம் கேட்டுக் கொள்ளப்படுகிறது.

மேற்சொன்ன தகராறில் கோரிக்கை எண் 3-ஐ. வேலூர், தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

"தொழிற்சங்கத்தை சேர்ந்த தொழிலாளர்களை மட்டுமே இயற்கை நீதி கோட்பாடுகளுக்கு புறம்பாக, நிர்வாம் பழி வாங்கி வருகிறது என்றும், தொழிற்சங்கத்தை சேர்ந்த ராமதாஸ் அவர்களுக்கு அளிக்கப்பட்ட தண்டனையான 2019 பிப்ரவரி மாதம் முதல் மாதம் ரூ.5000/& என்ற அடிப்படையில் 3 ஆண்டுகள் சம்பள பிடித்தத்தை நிர்வாகம் பிடித்தம் செய்யக் கூடாது என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானதுதானா? ஆம் எனில் உரிய உத்தரவு பிறப்பிக்கவும்.
