2. Since no objections and suggestions have been received on this draft notifi cation with in the stipulated time, the same are here by confi rmed and order as below.

CONFIRMATION OF VARIATION

1. Wherever the expression "MAP No.5, DDP(TR)/DTCP No.11/2005 occurs the expression DDP(V)/DTCP No.01/2020 shall be added at the end and to be read with.

As per the High Court's Offi cial Memorandum in the reference (Roc. No. 66806-A/2019/C3, dated 27-11-2020) it is hereby notifi ed that all the Civil and Sessions Court in the Civil Unit of the District Judge, Udhagamandalam, viz., District Court, Udhagamandalam, Sub Courts at Udhagamandalam, Coonoor and Gudalur, District Munsif Courts at Udhagamandalam, Coonoor, Kotagiri and Gudalur and Additional District Munsif Court at Gudalur will be closed for Summer Vacation, Dussera Holidays and Christmas Holidays during the year 2021 as detailed.

SUMMER VACATION

I. All the Civil and Sessions Court of the Unit of the District Judge, Nilgiris at Udhagamandalam will be closed from Saturday, the 1st day of May, 2021 to Monday, the 31 st day of May, 2021 (both days inclusive).

DUSSEHRA HOLIDAYS

II. All the Civil and Sessions Court of the Unit of the District Judge, Nilgiris at Udhagamandalam will be closed from Saturday, the 9th day of October, 2021 to Monday, the 18th day of October, 2021 both days inclusive).

CHRISTMAS HOLIDAYS

Ill. All the Civil and Sessions Court of the Unit of the District Judge, Nilgiris at Udhagamandalam will be closed from Saturday, the 25th day of December, 2021, to Friday, the 31st day of December, 2021 (both days inclusive).

Holidays for all the Courts in the Nilgiris District, for the year 2021 are as follows:-

IV. (a) All Sundays are Holidays.

(b) The following 10 Saturdays are working days:-

23-01-2021, 06-03-2021, 17-04-2021, 05-06-2021, 03-07-2021, 07-08-2021,

04-09-2021, 23-10-2021, 20-11-2021 and 14-12-2021.

(c) Except the above Saturdays, all other Saturdays are holidays for all the Courts, except Family Court.

(d) The Family Court shall work on 1st and 3rd Saturdays of every month except those Saturdays which are declared as Public Holidays. All other Saturdays are declared as holidays, except 23-01-2021 and 23-10-2021 which is declared as working days.

V. No Plaint or Petition except application for grant of Copies and for services of Execution of Process will be received by the Civil Courts during the adjournments.

VI. The Offi ce of the Copyist and Process Service Establishment will be kept open through the Vacation Holidays but no arrest warrants will be executed during the Summer Vacation Holidays.

VII. The Offi ce of the Other Department will remain closed, however arrangements will be made-

(a) For furnishing the Copies and Process Service with necessary relevant original records.

(b) For transmitting the records to High Court for reference in appeals and revisions.

(c) For attending all administrative correspondence.

(d) For receiving printing charges and plan fees in respect of Copy Applications.

VIII. Under Section 30 of Tamil Nadu Civil Courts Act as amended by Section 4 of Tamil Nadu Act VII of 1959 if a Vacation Civil Judge is appointed for the Civil Unit of Nilgiris District. Suits, Appeals and other proceedings or Urgent Civil Nature will be received and disposed of by the Vacation Judge as per rules, if not they should be presented before the Honble High Court of Madras.

IX. If No Vacation Sessions Judge is appointed or in the absence of the Sessions Judge, from the Division during the Vacation holidays, urgent applications for grant of Bail should be made to the Hon'ble High Court of Madras.

X. There will be normally one sitting in the Summer Vacation every week.

(CIVIL COURTS)

The Principal District and Sessions Court, Vellore District, Vellore, the Additional District and Sessions Court, Vellore, Ranipet, Tirupattur and the Subordinate Judges Court, Vellore, Ranipet, Arakkonam, Gudiyatham, Vaniyambadi, Tirupattur.

No plaints or petitions except applications for grant of copies and for service and execution of processes will be received by the Courts during the vacation.

The Offi ce of the Copyist, Process Service and Execution Department will be kept open throughout the vacation but no arrest warrants will be issued during the vaction will be executed.

The Offi ce of other departments will remain closed. Arrangement will however be made.

i. for transmitting records in appeals etc., to the High Court.

ii. for all administrative correspondence; and

iii. for furnishing the Copyist and Process Service Department with necessary records and original orders.

Urgent applications for bail during the Sessions Judge from the Division during the Recess should be made to the High Court of Judicature, Madras.

Appeals of urgent nature that lie to the District Court, shall during the adjournment, be presented to the High Court of Judicature, Madras.

In case of vacation Civil Judge is appointed by the Government for the Combined Vellore District (Vellore, Ranipet and Tirupattur) under Section 30 of the Tamil Nadu Civil Courts Act (Central Act III of 1873) as amended by Section 4 of the Madras Act No.XVII of 1959 suits and appeals and other proceedings will be received and disposed of by him in terms of Section 30 and the Rules framed in this behalf.
