Ms. No. 167, Home (Courts-II), 7th April 2021, பங்குனி 25, சார்வரி, திருவள்ளுவர் ஆண்டு-2052.] No.II(2)/HO/317/2021.—In exercise of the powers conferred by the proviso to sub-section (i) of Section 11 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974), the Governor of Tamil Nadu, after consultation with the High Court of Madras, hereby makes the following amendment to the Home Department Notifi cation No.II(2)/HO/2727/82, published at page 384 of Part II-Section 2 of the Tamil Nadu Government Gazette, dated the 16th June 1982, as subsequently amended, namely:-

Ms. No. 167, Home (Courts-II), 7th April 2021, பங்குனி 25, சார்வரி, திருவள்ளுவர் ஆண்டு-2052.] Tamil Nadu Town and Country Planning Act, 1971 (Tamil Nadu Act 35 of 1972) and in exercise of powers conferred by the G.O.Ms.No.94, Housing and Urban Development [UD 4-(1)] Department dated 12-06-2009 which has been published in the Tamil Nadu Government Gazette No.27, Part II-Section 2, Page No.228, dated 15-07-2009 of the following variations are made to the New Town Development plan of the Hosur New Town Development Area consented under this said Act and published in the Housing and Urban Development Department Notifi cation No. 12 at page Nos. 159, 160 of Part VI-Section 1, of the Tamil Nadu Government Gazette dated the 26th March 2003.

Variations to the Approved Master Plan of

Nagapattinam Local Planning Authority under the Act.

Under the heading Primary Residential (PR 5) use zone the following R.S.No.276/1A, 278/3 shall be added before the R.S.No.385.

Under the heading Agricultural (AG 19) use zone the following R.S.Nos. 271 to 283 shall be deleted. The Expression 271 to 275, 276pt (Except 276/1A), 277, 278pt (Except 278/3), 279 to 283 shall be substituted.

Under the heading Residential use zone the following shall be added the S.No./R.S.No.577/1B1 and before the entry 599.

Under the heading Agricultural use zone the following S.Nos. 575 to 577 shall be deleted. The expression 575, 576, 577pt (Except 577/1B1) shall be substituted.

Under sub-section (1) of Section 3 of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 (Tamil Nadu Act 10 of 1999), the Governor of Tamil Nadu hereby acquires the dry lands specifi ed in the schedule below and 6.47.0 Hectares to the same, a little more or less needed for Industrial purpose, to wit, for setting up of SIPCOT Industrial Complex, " Marudandapalli, Village Shoolagiri Taluk and Krishnagiri District.

The Plan of the lands are kept in the offi ce of the District Collector, Krishnagiri and may be inspected at any time during the offi ce hours.

Amendments to the Tamil Nadu Manual Workers

(Construction Workers) Welfare Scheme Under the

Tamil Nadu Workers (Regulation of Employment and

Conditions of Work ) Act.

[G.O.Ms. No. 67, Labour and Employment (I2), 6th May 2021,

சித்திரை 23, பிலவ, திருவள்ளுவர் ஆண்டு-2052.] No.II(2)/IND/325/2021.—The Government of Tamil Nadu, having been satisfi ed that the lands specifi ed in the schedule below have to be acquired for the Industrial purpose of setting up of SIPCOT Industrial Complex and it having already been decided that the entire amount of compensation to be awarded for the lands to be paid out of the funds controlled or managed by the Government. The following

No.II(2)/LE/326/2021.—In exercise of the powers conferred by Section 4 of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982), the Governor of Tamil Nadu, after consultation with the Advisory Committee, hereby makesJune. 9, 2021] TAMIL NADU GOVERNMENT GAZETTE 217 the following amendments to the Tamil Nadu Manual Workers (Construction Workers) Welfare Scheme, 1994, namely:-

In the said Scheme,-

(1) in clause 2, in sub-clause (c), for the expression "construction or maintenance of dams, bridges, roads", the expression "construction or maintenance or demolition of dams, bridges, roads" shall be substituted;

(2) in SCHEDULE I, after Serial Number 53 and the category relating thereto, the following shall be added namely:-

" 54.Demolition worker engaged in dams, bridges, roads or any other building"

was subject to the operation of the said Act (hereinafter referred to as "the said period") returns, in such form and containing such particulars as were due from it in respect of the said period under the Employees State Insurance (General) Regulations, 1950.

(3) Any Social Security Offi cer appointed by the Corporation under sub-section (1) of section 45 of the said Act, or other offi cial authorised in this behalf shall, for the purpose of,-

(i) verifying the particulars contained in any return submitted under sub-section (1) of section 44 of the said Act for the said period; or

(ii) ascertaining whether registers and records were maintained as required by the Employees State Insurance (General) Regulations, 1950 for the said period; or (iii) ascertaining whether the employees continue to be entitled to the benefi ts provided by the employer in cash and in kind, being benefi ts in consideration of which exemption is being granted under this Notifi cation; or Renewal of exemption granted to the Tamil Nadu Fisheries Development Corporation Limited, Chennai for the further period of one year from 19-7-2020 to 18.07.2021 under the Employees, State Insurance Act.

No.II(2)/LE/327/2021.—In exercise of the powers conferred by Section 87 read with section 91A of the Employees' State Insurance Act, 1948 (Central Act XXXIV of 1948), the Governor of Tamil Nadu hereby exempts the Tamil Nadu Fisheries Development Corporation Limited, Chennai from the operation of the said Act for the further period of one year from 19.07.2020 to 18.07.2021.

(1) The above exemption is subject to the following conditions, namely:-

(a) The aforesaid Management wherein the employees are employed shall maintain a Register showing the names and designations of the exempted employees.

(b) Notwithstanding the exemption, the employees shall continue to receive such benefi ts under the said Act to which they might have become entitled to on the basis of the contributions paid prior to the date from which exemption granted by this Notifi cation operates.

(c) The contribution for the exempted period, if already paid shall not be refunded.

(2) The employer of the said management shall submit in respect of the period during which that Management (iv) ascertaining whether any of the provisions of the said Act had been complied with during the period when such provisions were in force in relation to the said workshops and stores be empowered to,-

(a) require the principal or immediate employer to furnish to him such information as he may consider necessary; or

(b) enter any Management, offi ce or other premises occupied by such principal or immediate employer at any reasonable time and require any person found in charge thereof to produce to such Social Security Offi cer or other offi cial and allow him to examine such documents, books and other documents relating to the employment of persons and payment of wages or to furnish to him such information as he may consider necessary; or

(c) examine the principal or immediate employer, his agent or servant, or any person found in such Management offi ce or other premises, or any person when the said Social Security Offi cer or other offi cial has reasonable cause to believe to have been an employee; or

(d) make copies of or take extracts from any register, account book or other document maintained in such Management offi ce or other premises.
