No. 76, Backward Classes, Most Backward Classes and Minorities Welfare (S1), 16th November 2021, ஐப்பசி 30, பிலவ, திருவள்ளுவர் ஆண்டு-2052.] No. II(2)/BCMBCMW/815/2021.—In exercise of the powers conferred by Section 2 of the Kazis Act, 1880 (Central Act XII of 1880), the Governor of Tamil Nadu hereby appoints, Thiru Sirajudeen Ahmed Rashathi, S/o. Faqueer Mohamed residing at No.6/48A, Middle Street, Masjid, Keelappaguthi, Chinthamanipatti, Kadavur Taluk, Karur District as Kazi for Karur District. He shall hold the offi ce of the District Kazi for a period of three years from the date of issue of this order.

No. II(2)/LWSD/836/2021.—In exercise of the powers conferred by Section 4 of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982), the Governor of Tamil Nadu after consultation with the Advisory Committee hereby makes the following amendment to the Tamil Nadu Powerloom Weaving Workers, Social Security and Welfare Scheme 2010, namely:-

In the said Scheme, for the expression "Labour Offi cer (Social Security Scheme)" wherever it occurs, the expression "Assistant Commissioner of Labour (Social Security Scheme)" shall be substituted.

No.II(2)/LWSD/839/2021.— இந்த ஆணையின் இணைப்பில் குறிப்பிட்டுள்ள பொருள் தொடர்பாக, தமிழ்நாடு அரசு போக்குவரத்துக் கழகம் (கும்பகோணம்) லிமிடெட், என்ற நிர்வாகத்திற்கும் அரவிந்த் கெஜ்ரிவால் தமிழ்நாடு ஜெனரல் ஒர்க்கர்ஸ் யூனியன், மதுரை என்ற தொழிற் சங்கத்திற்குமிடையே தொழிற் தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்;

மேற்சொன்ன தொழிற் தகராறை கும்பகோணம், தொழிலாளர் நீதிமன்றத் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்தியச் சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, தமிழ்நாடு ஆளுநர் அவர்கள், மேற்சொன்ன தகராறு, கும்பகோணம், தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு கும்பகோணம், தொழிலாளர் நீதிமன்றம் கேட்டுக்கொள்ளப்படுகிறது. 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்தியச் சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, தமிழ்நாடு ஆளுநர் அவர்கள், மேற்சொன்ன தகராறு, சென்னை, தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு சென்னை, தொழிலாளர் நீதிமன்றம் கேட்டுக்கொள்ளப்படுகிறது.

R. அறிவொளி நடத்துனரின் (பணி எண்.99 CR1224) வருடாந்திர ஊதிய உயர்வினை இரண்டு வருடக் காலத்திற்கு அதன் தொடர்ச்சியுடன் நிறுத்தம் செய்து நிர்வாகம் பிறப்பித்த 29.02.2008 நாளிட்ட உத்தரவை ரத்து செய்ய வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானதுதானா? ஆம் எனில் உரிய உத்தரவு பிறப்பிக்கவும்.

No.II(2)/LWSD/840/2021.— இந்த ஆணையின் இணைப்பில் குறிப்பிட்டுள்ள பொருள் தொடர்பாக, சென்னை மாநகர போக்குவரத்துக் கழக நிர்வாகத்திற்கும் அரசாங்க போக்குவரத்து ஊழியர் சங்கம் என்ற தொழிற் சங்கத்திற்குமிடையே தொழிற் தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்;

மேற்சொன்ன தொழிற்தகராறை சென்னை, தொழிலாளர் நீதிமன்றத் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

மாநகர போக்குவரத்துக் கழக ஓட்டுநர் திரு. T. மணி, (பணி எண்.டி.52187) என்பவரின் ஆண்டு ஊதிய உயர்வு மூன்று ஆண்டுகள் தொடர்விளைவுடன் தள்ளிவைத்து நிர்வாகம் பிறப்பித்த 17.01.2009 தேதியிட்ட உத்தரவை ரத்து செய்ய வேண்டுமென்றும், மேலும் வாய்மொழியாக பணி நீக்கம் செய்யப்பட்டுள்ள 07.09.2007 முதல் 24.10.2007 முடிய உள்ள தற்காலிக பணி நீக்க காலமான 48 நாட்களை பணிக்காலமாக கருத வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானதா? ஆம் எனில் உரிய உத்தரவு பிறப்பிக்கவும்.
