AMENDMENT TO THE TNERC (TERMS AND CONDITIONS FOR DETERMINATION OF TARIFF) REGULATIONS, 2005

In exercise of the powers conferred on it under section 61 of the Electricity Act, 2003 (Central Act 36 of 2003) read with Section 181 of the said Act and all other powers enabling it in this behalf, the Tamil Nadu Electricity Regulatory Commission hereby makes the following amendment to the Tamil Nadu Electricity Regulatory Commission (Terms and Conditions for Determination of Tariff) Regulations 2005, the draft of the same having been previously published as required by sub-section (3) of said Section 181 of the Electricity Act.

It shall come into force on the date of publication in the Tamil Nadu Government Gazette Extraordinary.

Amendment

(i) In the said Regulations, for the present sub-regulation (2) of regulation 11 and entries relating thereto, the following sub-regulation and entries relating, shall be substituted, -

"11. Time-of-the-Day Tariff

(1) xxxx xxxx

(2) The time between 06.00 hrs and 10.00 hrs and between 18.00 hrs and 22.00 hours shall be treated as peak hour" (ii) In the said TNERC (Terms and Conditions for Determination of Tariff) Regulations, 2005 –

In the said Regulations, in sub-regulation 12 in regulation 25, the word "and" shall be substituted by "or"

Explanatory StatEmEnt

The TNERC (Terms and Conditions for Determination of Tariff Regulations, 2005, is proposed to be amended to make it align with the existing Model Tariff Regulations of Forum of Regulators and other State Electricity Regulatory Commissions and to enable the Commission to fix multi-year tariff on a formula based on Consumer Price Index or Whole sale price Index.

The amendment is proposed in TNERC (Terms and Conditions for Determination of tariff) Regulations, 2005 based on the Study Report furnished by the TANGEDCO against the Directives of the Commission in earlier Tariff Order dated 11.08.2017 (refer para 7.1.1 (k) ) to undertake a detailed study of hourly consumption patterns and to flatten the load curve and to ensure the cost of energy paid by the consumer at any point of time reflects the true cost of supply availability. The TANGEDCO filed its Tariff petition based on the recommendations of the consultant on Time of Day. The Commission also taking into account of the guidance of the Govt of India in Tariff Policy to recover the actual level of cost during peak hours, proposed the above amendment in Tariff Regulations 2005.

2. Accordingly, this amendment seeks to give effect for such requirement.

2005 ஆம் ஆண்டு மின்கட்டண வீதத்தை நிர்ணயம் செய்வதற்கான விதிமுறைகள் மற்றும் வரையறைகள் ஒழுங்குமுறை விதிகளுக்குரிய திருத்தம்

2003 ஆம் ஆண்டு மின்சாரச் சட்டத்தின் (மத்தியச் சட்டம் 36/2003) 181 ஆம் பிரிவுடன் சேர்த்துப் படிக்கப்படும் 61 ஆம் பிரிவின்படி தனக்கு வழங்கப்பட்டுள்ள அதிகாரங்களையும் மற்றும் இதன் பொருட்டு அதனை இயல்விக்கும் அனைத்துப்பிற அதிகாரங்களையும் செலுத்தி தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணையம், இதன் மூலம் 2005 ஆம் ஆண்டு (மின்கட்டண வீதத்தினை நிர்ணயிப்பதற்கான விதிமுறைகள் மற்றும் வரையரைகள்) ஒழுங்குமுறை விதிகளுக்கு பின்வரும் திருத்தத்தைக் குறித்துரைத்துள்ளது. இத்திருத்தத்தின் வரைவானது மேற்சொன்ன 181 ஆம் பிரிவின் (3) ஆம் பிரிவின் உட்பிரிவின்படி வேண்டுறுத்தப்பட்டவாறு முன்னதாக வெளியீடு செய்யப்பட்டுள்ளது.

இது தமிழ்நாடு அரசிதழில் சிறப்பு வெளியீடு செய்யப்பட்ட நாளிலிருந்து நடைமுறைக்கு வரும்.

திருத்தம்

மேற்சொன்ன 2005ஆம் ஆண்டு தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணைய (மின்கட்டண வீதத்தினை நிர்ணயம் செய்வதற்கான விதிமுறைகள் மற்றும் வரையறைகள்) ஒழுங்குமுறைவிதிகளில்:-

(அ) 11ஆம் ஒழுங்குமுறை விதியில் (2) ஆம் உள்-ஒழுங்குமுறை விதியிற்கு பதிலாக பின்வரும் கூறு சேர்க்கப்படுதல் வேண்டும், அதாவது:-

"11. நாள் கால அளவு (Time of the Day) மின் கட்டணவீதம்:

(2) 06.00 மணியிலிருந்து 10.00 மணி மற்றும் 18.00 முதல் 22.00 வரையிலான காலம் உச்ச மின் தேவைக் காலமாக கருதப்பட வேண்டும்."

(ஆ) 25ஆம் ஒழுங்குமுறை விதியின் (12) ஆம் உள்-ஒழுங்குமுறை விதியில் "மற்றும்" எனும் சொல்லிற்கு பதிலாக "அல்லது" எனும் சொல் சேர்க்கப்படுதல் வேண்டும்.

விளக்கவுரை

ஆணையம், ஒழுங்குமுறையாளர்களின் அமைப்பின் (Forum of Regulators) தற்போது நடைமுறையிலுள்ள மாதிரி வீதப்பட்டி ஒழுங்குமுறை விதிகள் மற்றும் மற்ற மாநில மின்சார ஒழுங்குமுறை ஆணைய ஒழுங்குமுறை விதிகளினை ஒத்து அமையவேண்டி 2005 ஆம் ஆண்டு மின் கட்டண வீதத்தை நிர்ணயிப்பதற்கான விதிமுறைகள் மற்றும் வரையறைகளில் திருத்தம் செய்ய விழைகிறது. மேலும் தேவையெனில் ஆணையம் நுகர்வோர்களின் விலைக்குறியீடு அல்லது மொத்த விற்பனை விலைக்குறியீடு அடிப்படையில் ஒரு சூத்திரத்தை வகுக்க ஏதுவாக இத்திருத்தம் கொண்டுவரப்பட்டுள்ளது.

2, ஒவ்வொரு மணிநேர மின்உபயோக விதத்தினை விரிவாக ஆய்வு மேற்கொள்ளவும் மின்பளுவிற்கான வளைவமைப்பினை சமதளப்படுத்தி எந்தவொரு காலத்திலும் மின்நுகர்வோர் செலுத்த வேண்டிய மின் கட்டண தொகை அதன் உண்மையான அடக்கவிலையை பிரதிபலிக்கக்கூடியதாக இருக்கவேண்டி வீதப்பட்டி ஆணை 1 நாள் 11.08.2017-ன் அடிப்படையிலான ஆணையத்தின் வழிகாட்டுதலின் (எண்.7.1.1.(k)) படியான தமிழ்நாடு மின் உற்பத்தி மற்றும் பகிர்மான கழகம் வழங்கிய ஆய்வு அறிக்கையின் அடிப்படையில் 2005 ஆம் ஆண்டு தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணைய (மின்கட்டண வீதத்தினை நிர்ணயம் செய்வதற்கான விதிமுறைகள் மற்றும் வரையறைகள்) ஒழுங்குமுறை விதிகளை திருத்தம் செய்வதற்கு உத்தேசிக்கப்பட்டுள்ளது. தமிழ்நாடு மின் உற்பத்தி மற்றும் பகிர்மான கழகம் நாள் கால அளவு அடிப்படையிலான மின்கட்டண வீதத்தின்மீது அவர்களது ஆலோசகரின் பரிந்துரைகளின் அடிப்படையில் மின்கட்டணவீத மனுவினை வழங்கியுள்ளது. இந்திய அரசின் மின்கட்டணவீத கொள்கையின் வழிகாட்டுதலின்படி உச்சபட்ச மின்தேவை காலங்களின் அடக்கச்செலவினை பெறவேண்டிய தேவையை கருத்திற்கொண்டு, ஆணையம் வீதப்பட்டிக்கான ஒழுங்குமுறை விதிகளில் மேற்கண்ட திருத்தத்தினை செய்ய உத்தேசித்துள்ளது.

TRANSMISSION / DISTRIBUTION OF ELECTRICITY UNDER MYT FRAMEWORK) REGULATIONS, 2009.

In exercise of the powers conferred on it under section 61 of the Electricity Act, 2003 (Central Act 36 of 2003) read with Section 181 of the said Act and all other powers enabling it in this behalf, the Tamil Nadu Electricity Regulatory Commission hereby makes the following amendment to the Tamil Nadu Electricity Regulatory Commission (Terms and Conditions for Determination of Tariff for Transmission/Distribution of Electricity under MYT framework) Regulations 2009, the draft of the same having been previously published as required under sub-section (3) of said Section 181 of the Electricity Act.

It shall come into force on the date of publication in the Tamil Nadu Government Gazette Extraordinary

Amendment

In the said TNERC (Terms and Conditions for Determination of Tariff for Transmission / Distribution of Electricity under MYT framework) Regulations, 2009 –

In regulation 3, - for item (i), the following shall be substituted, namely :-

"(i) Control period

The control period under the MYT frame work shall be for a duration of 5 years, and as may be extended by the

Commission. The year preceding the first year of the control period shall be base year. Where the Commission desires to

fix multi year tariff a formula based on Consumers' Price Index (or) Wholesale Price Index (or) a quantum (Percentage /

value) required to meet the Aggregate Revenue Requirement of the licensee shall be prescribed. During the Control

period, if required the Commission shall undertake Mid-term Review for modification in the approval for remaining

Control period based on True-up and/or actual performance."

2009 ஆம் ஆண்டு பல்லாண்டுக்கான மின் கட்டண வீதத் திட்டத்தின்படி மின்செலுத்துதல்/மின் பகிர்மானத்திற்கான மின்கட்டண வீதத்தை நிர்ணயிப்பதற்கான விதிமுறைகள் மற்றும் வரையறைகளுக்குரிய திருத்தம் (அறிக்கை எண்.தமிஒஆ/பஆமி(MYT)/18-4, 05.09.2022 நாளிட்டது)

இது தமிழ்நாடு அரசிதழில் சிறப்பு வெளியீடு செய்யப்பட்ட நாளிலிருந்து நடைமுறைக்கு வரும்.

திருத்தம்

மேற்கூறிய பல்லாண்டுக்கான மின் கட்டண வீதத் திட்டத்தின்படி மின் செலுத்துதல் / மின் பகிர்மானத்திற்கான மின்கட்டண வீதத்தை நிர்ணயிப்பதற்கான விதிமுறைகள் மற்றும் வரையறை 2009-ன் 3ஆம் ஒழுங்குமுறைவிதி இனம் (i) ல் தற்போதுள்ள பத்தியிற்கு பதிலாக பின்வரும் இனம் அமைக்கப்படுதல் வேண்டும்.

"3) பல்லாண்டுக்கான மின் கட்டணவீதத் திட்டம்:

(i) கட்டுப்பாட்டுக் காலம்

பல்லாண்டுக்கான மின் கட்டணவீதத் திட்டத்தின்படியான கட்டுப்பாட்டுக் காலமானது 5 ஆண்டுகள் கால அளவைக் கொண்டிருக்கும் (அல்லது) அவ்வப்போது ஆணையத்தினால் நீட்டிக்கப்படும் பிற கால அளவு ஆகும். ஆணையம் பல்லாண்டுக்கான மின் கட்டண வீதத்தினை நிர்ணயம் செய்கிறவிடத்து, நுகர்வோர்களின் விலைக் குறியீடு (அல்லது) மொத்த விற்பனை விலைக் குறியீடு அடிப்படையிலான சூத்திரத்தின் அடிப்படையில் அல்லது உரிமம்தாரரின் மொத்த வருவாய் தேவையை சரிப்படுத்த தேவைப்படக்கூடிய அளவினை (சதவீதம்/தொகை) நிர்ணயிக்க வேண்டும். குறிப்பிட்ட கட்டுப்பாட்டுக்காலத்தில் ஆணையம், தேவைப்பட்டால், உண்மைநிலை சரிபார்ப்பு (True-up) அல்லது செயல்பாட்டின் அடிப்படையில் இடைக்கால ஆய்வு மேற்கொண்டு எஞ்சிய கட்டுப்பாட்டுக்காலத்திற்கு வழங்கிய ஒப்புதலில் திருத்தங்களை மேற்கொள்ளும்."
