No. II(2)/LWSD/731/2022.— In exercise of the powers conferred by section 87 read with section 91A of the Employees' State Insurance Act, 1948 (Central Act XXXIV of 1948), the Governor of Tamil Nadu hereby exempts the Tamil Nadu Cements Corporation Limited, Ariyalur from the operation of the said Act for the period of one year from 01.02.2022 to 31.01.2023.

(1) The above exemption is subject to the following conditions, namely:-

(a) The aforesaid management wherein the employees are employed shall maintain a Register showing the names and designations of the exempted employees.

Award of the Home Guards and Civil Defence Medal for

Meritorious Service on the occasion of the Independence

Day, 2020.

(b) Notwithstanding the exemption, the employees shall continue to receive such benefi ts under the said Act to which they might have become entitled to on the basis of the contributions paid prior to the date from which exemption granted by this Notifi cation operates.

2. These awards are made under Rule 3(ii) of the rules governing the award of Home Guards & Civil Defence Medal for Meritorious Service.

(2) The employer of the said management shall submit in respect of the period during which that management was subject to the operation of the said Act (hereinafter referred to as "the said period") returns, in such form and containing such particulars as were due from it in respect of the said period under the Employees State Insurance (General) Regulations, 1950.

(3) Any Social Security Officer appointed by the Corporation under sub-section(1) of section 45 of the said Act, or other offi cial authorized in this behalf shall, for the purpose of,-

(i) verifying the particulars contained in any return submitted under sub-section(1) of section 44 of the said Act for the said period; or

(ii) ascertaining whether registers and records were maintained as required by the Employees State Insurance (General) Regulations, 1950 for the said period; or (iii) ascertaining whether the employees continue to be entitled to the benefi ts provided by the employer in cash and in kind, being benefi ts in consideration of which exemption is being granted under this Notifi cation; or (iv) ascertaining whether any of the provisions of the said Act had been complied with during the period when such provisions were in force in relation to the said workshops and stores be empowered to,-Sep. 7, 2022] TAMIL NADU GOVERNMENT GAZETTE 943 (a) require the principal or immediate employer to furnish to him such information as he may consider necessary; or

(b) enter any management offi ce or other premises occupied by such principal or immediate employer at any reasonable time and require any person found in charge thereof to produce to such Social Security Offi cer or other offi cial and allow him to examine such documents, books and other documents relating to the employment of persons and payment of wages or to furnish to him such information as he may consider necessary; or

NOW, THEREFORE, in exercise of the powers conferred by sub-clause (vi) of clause (n) of section 2 of the said Act, the Governor of Tamil Nadu hereby declares that the "Industry Manufacturing Boiler Auxiliaries for High Pressure Boilers". to be a public utility service for the purposes of the said Act for a period of six months with effect on and from the date of publication of this Notifi cation in the Tamil Nadu Government Gazette.

No. II(2)/LWSD/732/2022.—WHEREAS, the Governor of Tamil Nadu is satisfi ed that public interest requires that the Critical piping for High Pressure Boilers, Pressure Vessels, Fittings, etc. Industry should be declared as a public utility service for the purposes of the Industrial Disputes Act, 1947 (Central Act XIV of 1947)

NOW, THEREFORE, in exercise of the powers conferred by sub-clause (vi) of clause (n) of section 2 of the said Act, the Governor of Tamil Nadu hereby declares that the "Critical piping for High Pressure Boilers, Pressure Vessels, Fittings, etc. Industry'' to be a public utility service for the purposes of the said Act for a period of six months with effect on and from the date of publication of this Notifi cation in the நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

1947-ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் (மத்தியச் சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, இத்தகராறை எழுவினாவுடன் கோவை தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று தமிழ்நாடு ஆளுநர் அவர்கள் இதனால் ஆணையிடுகிறார்.

மேலும், 1947-ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு கோவை, தொழிலாளர் நீதிமன்றம் கேட்டுக் கொள்ளப்படுகிறது.

3. 2022-ஆம் சுதந்திரத் தினவிழாவில் தகைசால் தமிழர் விருது வழங்குவது குறித்து 27-07-2022 அன்று மாண்புமிகு முதலமைச்சரின் தலைமையில் நடைபெற்ற தேர்வுக்குழு கூட்டத்தில் திரு. ஆர். நல்லகண்ணு அவர்களுக்கு தகைசால் தமிழர் விருது வழங்கலாம் என பரிந்துரைக்கப்பட்டுள்ளது.

4 . ே ம ே ல ப த் தி 3 - ல் ப ரி ந் து ை ர க் க ப் ப ட் டு ள் ள 2022-ஆம் ஆண்டிற்கான தகைசால் தமிழர் விருது-க்கு தேர்வு செய்யப்பட்டுள்ள திரு. ஆர். நல்லகண்ணு அவர்களுக்கு ரூ. 10,00,000/-க்கான (ரூபாய் பத்து இலட்சம் மட்டும்) காசோலை மற்றும் பாராட்டுச் சான்றிதழ் வழங்க ஒப்பளிப்பு செய்து இதன் மூலம் ஆணை வெளியிடப்படுகிறது.

5. பத்தி 4-ல் ஒப்பளிக்கப்பட்ட தொகை ரூ. 10,00,000/- (ரூபாய் பத்து இலட்சம் மட்டும்) கீழ்க்கண்ட கணக்குத் தலைப்பில் பற்று வைக்கப்பட வேண்டும்.

6. மேலே பத்தி 4-ல் அனுமதிக்கப்பட்டுள்ள விருதுத் தொகையான ரூ. 10,00,000/-த்தை வரைவு காசோலையாக விருதாளரின் பெயரில் பெற்று வழங்க பிரிவு அலுவலர், பொது (பட்டியல்-அ)த் துறையின் பிரிவு அலுவலர் அவர்களுக்கு அதிகாரம் வழங்கப்படுகிறது.

7. இவ்வாணைக்கு அரசாணை (நிலை) எண். 519, நிதி (சம்பளங்கள்)த் துறை, நாள் 29-09-1997-ன்படி நிதித்துறையின் ஒப்புதல் தேவையில்லை.
