Notifications under the Tamil Nadu Civil Courts Act.

Ms. No. 497, Home (Courts-III), 19th September 2022, புரட்டாசி 2, சுபகிருது, திருவள்ளுவர் ஆண்டு-2053.] Constitution of District Munsif-cum-Judicial Magistrate Court at Kodavasal in Tiruvarur District under the Act. [G.O. Ms. No. 390, Home (Courts-III), 26th July 2022, ஆடி 10, சுபகிருது, திருவள்ளுவர் ஆண்டு-2053.] No.II(2)/HO/817/2022.—In exercise of the powers conferred by the first paragraph of Section 4 of the Tamil Nadu Civil Courts Act, 1873 (Central Act III of 1873), the Governor of Tamil Nadu, hereby alters the number of District Munsifs to be appointed under the said Act for Tiruvarur District as SIX with effect from the date on which the District Munsif assumes charge of the District Munsif's Court at Kodavasal.

Ms. No. 390, Home (Courts-III), 26th July 2022, ஆடி 10, சுபகிருது, திருவள்ளுவர் ஆண்டு-2053.] No.II(2)/HO/819/2022.—In exercise of the powers conferred by the Section 10 of the Tamil Nadu Civil Courts Act, 1873 (Central Act III of 1873), the Governor of Tamil Nadu hereby directs that in the District of Tiruvarur, the Subordinate Judge's Court at Tiruvarur shall have and exercise original jurisdiction over the District Munsif's Court at Kodavasal, in addition to its existing jurisdiction with effect from the date on which the District Munsif assumes charge of the District Munsif's Court at Kodavasal.

No.II(2)/HO/821/2022.—In exercise of the powers conferred by the second paragraph of Section 4 of the Tamil Nadu Civil Courts Act, 1873 (Central Act III of 1873), the Governor of Tamil Nadu, after consultation with the High Court, Madras, hereby fi xes the number of Subordinate Judges to be appointed for the Subordinate Judge's Court at Thirumayam in Pudukkottai District as ONE with effect from the date on which Subordinate Judge, Thirumayam assumes charge of that Court.

Ms. No. 497, Home (Courts-III), 19th September 2022, புரட்டாசி 2, சுபகிருது, திருவள்ளுவர் ஆண்டு-2053.] No.II(2)/HO/822/2022.—In exercise of the powers conferred by Section 5 of the Tamil Nadu Civil Courts Act, 1873 (Central Act III of 1873), the Governor of Tamil Nadu, hereby fi xes Thirumayam in Pudukkottai District as the place at which the Subordinate Judge's Court, Thirumayam shall be held.

NOTIFICATION-IV.

[G.O. Ms. No. 497, Home (Courts-III), 19th September 2022, புரட்டாசி 2, சுபகிருது, திருவள்ளுவர் ஆண்டு-2053.] No.II(2)/HO/823/2022.—In exercise of the powers conferred by Section 10 of the Tamil Nadu Civil Courts Act, 1873 (Central Act III of 1873), the Governor of Tamil Nadu hereby directs that, in the District of Pudukkottai, the Subordinate Judge's Court at Pudukkottai shall cease to have original jurisdiction over the District Munsif-cum- Judicial Magistrate Court at Thirumayam and hereby fi xes the local limits of the District Munsif-cum-Judicial Magistrate Court at Thirumayam as the local limits of jurisdiction of the Subordinate Judge's Court at Thirumayam with effect from the date on which the Subordinate Judge, Thirumayam assume charge of that Court.

Ms. No. 497, Home (Courts-III), 19th September 2022, புரட்டாசி 2, சுபகிருது, திருவள்ளுவர் ஆண்டு-2053.] No. II(2)/HO/820/2022.—In exercise of the powers conferred by the first paragraph of Section 4 of the Tamil Nadu Civil Courts Act, 1873 (Central Act III of 1873), the Governor of Tamil Nadu, hereby alters the number of Subordinate Judges to be appointed under the said Act for Pudukkottai District as FIVE with effect from the date on which the Subordinate Judge assumes charge of the Subordinate Judge's Court at Thirumayam.

[G.O. (D) No. 477, Labour Welfare and Skill Development (L1), 3rd October 2022, புரட்டாசி 16, சுபகிருது, திருவள்ளுவர் ஆண்டு–2053.]

No. II(2)/LWSD/824/2022.—In exercise of the powers conferred by Section 87 read with Section 91A of the Employees' State Insurance Act, 1948 (Central Act XXXIV of 1948), the Governor of Tamil Nadu hereby exempts Thanjavur West Sarvodaya Sangh, Thanjavur from the operation of the said Act for the further period of one year from 11.10.2022 to 10.10.2023.

(1) The above exemption is subject to the following Revision of minimum rates of wages for Employment in Security Guards under the Minimum Wages Act. conditions, namely:-

(a) The aforesaid management where in the employees employed shall maintain a Register showing the names and designations of the exempted employees.

(b) Notwithstanding the exemption, the employees shall continue to receive such benefi ts under the said Act to which they might have become entitled to on the basis of the contributions paid prior to the date from which exemption granted by this Notifi cation operates.

(c) The contribution for the exempted period, if already paid shall not be refunded.

(2) The employer of the said management shall submit in respect of the period during which that management was subject to the operation of the said Act (hereinafter referred to as "the said period") returns, in such form and containing such particulars as were due from it in respect of the said period under the Employees State Insurance (Genaral) Regulations, 1950.

(3) Any Social Security Officer appointed by the Corporation under sub-section (1) of Section 45 of the said Act, or other offi cial authorised in this behalf shall, for the purpose of,-

(i) verifying the particulars contained in any return submitted under sub-section (1) of Section 44 of the said Act for the said period; or

(ii) ascertaining whether registers and records were maintained as required by the Employees State Insurance (General) Regulations, 1950 for the said period; or (iii) ascertaining whether the employees continue to be entitled to the benefi ts provided by the employer in cash and in kind, being benefi ts in consideration of which exemption is being granted under this Notifi cation; or (iv) ascertaining whether any of the provisions of the said Act had been complied with during the period when such provisions were in force in relation to the said workshops and stores be empowered to,-

(D) No. 470, Labour Welfare and Skill Development (J1) 27th September 2022, புரட்டாசி 10, சுபகிருது, திருவள்ளுவர் ஆண்டு–2053.] No. II(2)/LWSD/825/2022.—The following draft Notifi cation which is proposed to be issued in exercise of the powers conferred by clause (b) of sub-section (1) of Section 3 and sub-section (2) of Section 5 of the Minimum Wages Act, 1948 (Central Act XI of 1948), is hereby published for information of all persons likely to be affected thereby, as required by clause (b) of sub-section (1) of Section 5 of the said Act.

2. Notice is hereby given that any objection or suggestion, which may be received from any person with respect thereto, on or before the 23.12.2022 will be considered by the Government of Tamil Nadu. Objection or suggestion, if any, should be addressed to the Additional Chief Secretary to Govenrment, Labour and Skill Development Department, Secretariat, Chennai-600 009, through the Commissioner of Labour, DMS Campus, Chennai-600 006.

DRAFT NOTIFICATION.

In exercise of the powers conferred by clause (b) of sub-section (1) of Section 3 and sub-section (2) of Section 5 of the Minimum Wages Act, 1948 (Cental Act XI of 1948), and in supersession of the Labour and Employment Department, Notifi cation No.II(2)/LE/561/2019, published at pages 663 and 664 of Part II Section 2 of the Tamil Nadu Government Gazette dated the 10th July 2019, the Governor of Tamil Nadu, hereby revises the minimum rates of wages payable to the classes of employees in the employment in Security Guards in the State of Tamil Nadu specifi ed in column (2) of the Schedule below, as specifi ed in the corresponding entries in column (3) thereof.-

திருநெல்வேலி தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

Explanations.- (1) The Classifi cation of Zones shall be as follows:- Zone-A : Shall include all Municipal Corporations. Zone-B : Shall include all types of Municipalities. Zone-C : Shall include all areas other than those in Zones A and B.

மேலும், 1947 ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு திருநெல்வேலி தொழிலாளர் நீதிமன்றத்தைக் கேட்டுக் கொள்ளப்படுகிறது.

(2) Dearness Allowance.- In addition to the minimum rates of basic wages fi xed above, the employees shall be paid dearness allowance as indicated below:-

(i) The dearness allowance is linked to the Average Chennai City Consumer Price Index Number for the year 2010, that is 161 points (with base year 2001=100) and for every raise of one point over and above 161 points, an increase of Rs.56.00 (Rupee fi fty six only) per month shall be paid as dearness allowance.

S. ரவிச்சந்திரன் (பணி எண்.8937) என்பவருக்கு வருடாந்திர ஊதிய உயர்வினை அதன் திரண்ட பயனுடன் மூன்று வருடத்திற்கு நிறுத்தி வைத்தும், தற்காலிக வேலை நீக்க நாட்களை தகுதி வாய்ந்த விடுப்பாக வரைமுறைபடுத்தியும், நிர்வாகம் பிறப்பித்த 30.7.2018 நாளிட்ட உத்தரவை இரத்து செய்ய வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானதுதானா? ஆம் எனில், உரிய உத்தரவு பிறப்பிக்கவும்.

(ii) The dearness allowance shall be calculated on the fi rst April of every year on the basis of the average of the indices of the preceding 12 (twelve) months, namely from January to December.

No.II(2)/LWSD/826/2022.—இந்த ஆணையின் இணைப்பில் குறிப்பிட்டுள்ள பொருள் தொடர்பாக, தமிழ்நாடு அரசு போக்குவரத்துக் கழகம், (திருநெல்வேலி) லிட்., திருநெல்வேலி மண்டலம், திருநெல்வேலி என்ற நிர்வாகத்திற்கும், தமிழ்நாடு அரசு போக்குவரத்துக்கழக தொழிலாளர் முன்னேற்ற சங்கம், திருநெல்வேலி என்ற தொழிற் சங்கத்திற்குமிடையே தொழிற் தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்;

தமிழ்நாடு அரசு போக்குவரத்துக் கழகம் (கும்பகோணம்) லிட்., மேற்சொன்ன தொழிற் தகராறை தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

நாகப்பட்டினம் மண்டலத்தில் நடத்துநராக பணிபுரியும் திரு. S. வீரராகவன் (பணியாளர் எண் 8-CR-050) என்பவருக்கு வருடாந்திர ஊதிய உயர்வினை மூன்று வருட காலத்திற்கு

மேற்சொன்ன தொழிற் தகராறை தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

1947 ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் (மத்திய சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தொழிற்தகராறு, கும்பகோணம் தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேலும், 1947 ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு கும்பகோணம் தொழிலாளர் நீதிமன்றத்தைக் கேட்டுக் கொள்ளப்படுகிறது.

R. அறிவொளி (பணி எண் 99-CR-350) என்பவருக்கு வருடாந்திர ஊதிய உயர்வினை இரண்டு வருடக் காலத்திற்கு தொடர்ச்சியாக நிறுத்தி வைத்து நிர்வாகம் பிறப்பித்த 30.10.2001 நாளிட்ட உத்தரவை ரத்து செய்ய வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானதுதானா? ஆம் எனில் உரிய உத்தரவு பிறப்பிக்கவும்.

மேற்சொன்ன தொழிற் தகராறை தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;

மேலும், 1947 ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு கடலூர் தொழிலாளர் நீதிமன்றம் கேட்டுக் கொள்ளப்படுகிறது.

தமிழ்நாடு அரசு போக்குவரத்துக் கழகம், (விழுப்புரம்) லிட்., கடலூர் மண்டலத்தில் ஓட்டுநராகப் பணிபுரியும் திரு. ஆர்.முத்துமாணிக்கம் (பணி எண். டி.ஆர்.6066) என்பவருக்கு ஆண்டு ஊதிய உயர்வை மூன்று ஆண்டு காலத்திற்கு நிரந்தரமாக தள்ளி வைத்தும், தற்காலிக வேலை நீக்கத்திலிருந்த காலத்தை அவரின் கணக்கில் இருந்த விடுப்பை கழித்து நிர்வாகம் பிறப்பித்த 25.04.2019-ஆம் நாளிட்ட உத்தரவை இரத்து செய்ய வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானதுதானா?
