22-வது நமூனாப்படிக்கான கொடுக்கத்தக்க தொகை மசோதாப் பட்டியலில் (இத்துடன் சேர்த்து வைக்கப்பட்டுள்ளது) சேர்க்கப்பட்டுள்ள நிலம் பொது காரியத்திற்காக 1961-ம் ஆண்டு நிலச்சீர்திருத்த (நில உடைமை உச்சவரம்பு நிச்சயிப்புச்) சட்டத்தின் (தமிழ்நாடு சட்டம் 58/1961 18 (1) பிரிவின் கீழ் அரசினரால் ஆர்ஜிதம் செய்யப்பட்டுள்ளபடியால், அதிகாரம் பெற்ற அதிகாரியான சிதம்பரம் உதவி ஆட்சியர் திருமதி. சுவேதா சுமன், இ.ஆ.ப., என்னும் நான் இவ்விஷயத்தில் முழு விசாரணை செய்த பிறகும், அதற்குச் சம்பந்தப்பட்ட பல்வேறு விஷயங்களைக் கிரமமாய் ஆலோசித்துப் பார்த்த பிறகும் 50 (5)-வது பிரிவின் கீழ் கொடுக்கத் தக்க தொகையை நிச்சயித்துள்ளேன். நான் இதனால் அறிவிப்பதாவது மசோதாப்பட்டியலில் குறிப்பிட்டுள்ள தொகை அந்த நிலத்தின் பற்றுள்ள சகலமான பேர்களுக்கும் கொடுக்கத்தக்க முழு தொகையாகும். இச்சட்டத்தின் மற்ற ஷரத்துகளுக்குட்பட்டு அதில் பெயர் குறிப்பிட்டுள்ளவர்கள் மட்டுமே தொகை பெற உரிமை உள்ளவர்களாவர்கள். அவகள் அதில் குறிப்பிட்டுள்ள வீதாச்சாரப்படி தொகை பெறுவர்.

அரசினர் ஆர்ஜிதம் செய்த உபரி நிலத்திற்குக் கொடுக்கத்தக்கதும் தமிழ்நாடு சட்டம் 1989-ம் ஆண்டு 14-ம் சட்டத்தின் திருத்தப்பட்டபடி 1961-ம் ஆண்டு தமிழ்நாடு நிலச்சீர்திருத்த (நில உடைமை உச்சவரம்பு நிச்சயிப்புச் சட்டத்தின் (தமிழ்நாடு சட்டம் 58/1961 50 (3) பிரிவின் கீழ் நிர்ணயிக்கப்பட்டதுமான கொடுக்கத் தக்க தொகை மசோதாப்பட்டியலில் குறிப்பிடப்பட்டுள்ளது. கொடுக்கத் தக்க தொகை மசோதாப்பட்டியலில் உள்ள யாதொரு பதிவை எவரேனும் ஆட்சேபிக்க விரும்பினால் அவர் தமது ஆட்சேபனையை எழுதி அதிகாரம் பெற்ற அதிகாரி மற்றும் உதவி ஆட்சியர் சிதம்பரம் அவர்களிடம் கொடுத்துக்கொள்ளலாம். இந்த மசோதா தேதி தமிழ்நாடு அரசிதழில்தமிழ்நாடு அரசிதழில் வெளியிடப்பட்ட தேதியிலிருந்து 30 தினங்களுக்குள் அதை அவர் கொடுத்துக்கொள்ளலாம்.

உரிய தேதிக்குள் வந்து சேர்ந்த ஆட்சேபனை பின்னர் தெரிவிக்கும் இடத்தில் தேதியில் நேரத்தில் விசாரிக்கப்படும். அப்போது ஆட்சேபனை செய்பவர் நேரில் வந்திருந்து அல்லது அதிகாரம் பெற்ற ஏஜெண்டை அனுப்பி ஆட்சேபனைக்கு ஆதரவாக வாய்மொழி சாட்சியம் கொடுக்கலாம். தஸ்தாவேஜி சாட்சியம் கொடுக்கலாம்.

இத்தேதி நில மதிப்பீடு பட்டியல் வெளியிடப்பட்ட தேதியிலிருந்து 30 தினங்களுக்குள் இருக்க வேண்டும்.

2. All Sundays are Holidays for all the Subordinate Courts including Family Courts functioning in the State of Tamil Nadu.

3. The following 10 Saturdays are working days for all the Subordinate Courts including Family Court functioning in the State of Tamil Nadu: 07-01-2023, 18-02-2023, 04-03-2023, 03-06-2023, 01-07-2023, 05-08-2023, 02-09-2023, 07-10-2023, 04-11-2023 and 02-12-2023.

4. Except the above Saturdays, all other Saturdays are holidays for all the Subordinate Courts, except Family Courts.

5. All the Family Courts functioning in the state of Tamil Nadu shall also work on 1st and 3rd Saturdays of every month except those Saturdays which are declared as Public Holidays, All other Saturdays are declared as holidays.

All the Holidays notifi ed as Public and Government Holidays for the year 2023 in the High Court's Offi cial Memorandum in R.O.C. No. 97711-A/2022/C3, dated 09-12-2022.

No Plaint or Petitions except applications for grant of copies and for service of processes will be received by the above courts during the summer vacation, 2023.

The Copyist and Process Service Establishment will be kept open throughout the Summer Vacation, Dussehra holidays and Christmas holidays 2023.

The Offi cers' of the other sections will remain closed and arrangements will however be made in respect of the following items.

1. For transmitting records in Appeal to the High Court, Madras.

2. For all administrative correspondence.

3. For furnishing necessary records to the Copyist and Process Service Establishment for preparation of copies and for preparation of process respectively.

Urgent applications for bail during Summer Vacation 2023 will be heard by the Vacation Judge, appointed by High Court, Madras.

Vacation Civil Court

The Vacation Civil Judges appointed by the High Court, Madras will attend the urgent civil work during the Summer Vacation 2023.

Conferment of Magisterial Powers

No. 322/2022.--In exercise of the powers conferred under Section 13 of the Criminal Procedure Code 1973 (Central Act 2 of 1974), the High Court hereby appoints the following (i) 8 Deputy Tahsildars in Madurai District and (ii) 8 Deputy Tahsildars in Villupuram District as Special Judicial Magistrates, to undergo Magisterial Training for a period of 120 days, from the date of assumption of charge and confers upon them the ordinary powers conferrable under this Code on a Judicial Magistrate to try such cases which were earlier triable and dealt with by an erstwhile Judicial Second Class Magistrate.

Variations to the Approved Coimbatore Master Plan for the Local Planning Area

In exercise of power conferred under sub-section (4) of the Section 32 of Tamil Nadu Town and Country Planning Act, 1971 (Tamil Nadu Act 35 of 1972) and exercise of powers confi rmed by the G.O.Ms.No. 94 Housing and Urban Development (4-1) Department dated 12-6-2009 which has been published in Tamil Nadu Government Gazette No.27, Part II—Section 2 dated 15-7-2009.

Land use zone conversion from Agricultural use zone into Industrial use zone ordered in G.O.(2D) No. 297 Housing and Urban Development [UD4(1)] Department dated 2-12-2022 the following variation are made to the approved Master Plan of Coimbatore Local Planning Area under the said act and published in the notifi cation No. II(2)/HOU/4377/94 at Page No. 1978 of Part—II Section 2 of the Tamil Nadu Government Gazette dated 9-11-1994

VARIATIONS

In the Approved Coimbatore Master Plan, under the heading permitted land use in various survey numbers of Coimbatore Local Planning Area, under heading in Appanaickenpatti Village, Page No. 372 the following entries should be made.

Under the heading Industrial (I 36) use zone the expression S.No. 186/2A, 192/1A, 192/2, 192/3, 192/4, 193/1, 193/2A, 193/3A & 197/2, shall be added after the enrty 184.

Under the heading "Agricultural (AG 57) use Zone "the expression S.Nos: 186, 192, 193, 197 shall be deleted and the Expression 186 (Ecept 186/2A) 192 (Except 192/1A, 192/2, 192/3, 192/4] 193 [Except 193/1, 193/2A, 193/3A] 197 [Except 197/2] shall be substituted.

Variations to the Review Approved Tiruppur Master Plan for the Tiruppur Local Planning Area

In exercise of the powers conferred under sub-section (4) of Section 32 of Tamil Nadu Town and Country Planning Act, 1971 (Tamil Nadu Act 35 of 1972) and exercise of powers confirmed by the G.O.Ms. No. 94 Housing and Urban Development [UD4-(1)] Department dated 12-6-2009 which has been published in the Tamil Nadu Government Gazette No.27, Part II—Section 2 dated 15-7-2009.

Land use zone conversion from Existing Educational use zone into Residential use zone ordered in G.O.(2D) No. 292 Housing and Urban Development [UD4(CLU-1)] Department dated 25-11-2022. The following variations are made to the Master Plan of Review Approved Tiruppur Local Planning Authority under the said Act and published in the G.O.Ms. No. 280, Housing and Urban Development [UDIV(2)] dated 27-10-2006 Notifi cation No.II(2)/HOU/573/2006 at Page 375 of Part II—Section 2 of the Tamil Nadu Government Gazette dated the 22nd November 2006.

DRAFT VARIATIONS.

In the Review Approved Tiruppur Master Plan under the heading permitted Land use in various survey numbers of Tiruppur Local Planning Area under heading in Village Chettipalayam Page S-41 in S.F.No. 122 the following entries should be made.

(i) Against the entry of "EXISTING EDUCATIONAL" use zone for the expression "120 to 123", the expression "120, 121, 122 (Except 122/1A2), 123" shall be substituted.

(ii) Against the entry of "Mixed Residential" use zone, the expression "122/1A2" shall be added after the entry 119.

Variations to the Review Approved Tiruppur Master Plan for the Tiruppur Local Planning Area

In exercise of powers conferred under sub-section (4) of Section 32 of Tamil Nadu Town and Country Planning Act, 1971 (Tamil Nadu Act 35 of 1972) and exercise of powers confi rmed by the G.O.Ms. 94 Housing and Urban Development [UD4-(1)] Department dated 12-6-2009 which has been published in the Tamil Nadu Government Gazette No.27, Part II—Section 2, dated 15-7-2009.

Land use zone conversion from Existing Agricultural use zone into Industrial use zone ordered in G.O.(2D) No. 294 Housing and Urban Development [UD4(CLU-1)] Department dated 25-11-2022. The following variations are made to the Master Plan of Review Approved Tiruppur Local Planning Authority under the said Act and published in the G.O.Ms. No. 280, Housing and Urban Development [UDIV(2)] dated 27-10-2006 notifi cation No.II(2)/ HOU/573/2006 at Page 375 of Part II—Section 2 of the Tamil Nadu Government Gazette dated the 22nd November 2006.

DRAFT VARIATIONS.

In the Review Approved Tiruppur Master Plan under the heading permitted Land use in various survey numbers of Tiruppur Local Planning Area under heading in Village Chettipalayam Page S-42 in S.F.No. 110 the following entries should be made.

(i) Against the entry of "EXISTING AGRIGULTURAL" use zone for the expression "110 to 113" the expression "110 (Except "110/3A. 110/3C", 111, 112, 113 shall be substituted.

(ii) Against the entry of INDUSTRIAL use zone, the expression "110/3A, 110/3C" shall be added before the entry 239/2.

The following variations are made to the Master Plan of Approved Madurai Local Planning Authority under the said Act and published in the G.O.Ms. No. 122, Housing and Urban Development (UD4), Department dated 6-2-1995 and published in the Tamil Nadu Government Gazette No. 7. Part II—Section 2, Page 190-191 dated 22-2-1995

VARIATION.

In the said Master Plan in Part II "LAND USE SCHEDULE" in Verrapanajan Village, Thindiyur Panchayat of Madurai East Panchayat Union, Madurai East Taluk and Madurai District under the heading I 'Residential use zone to IV 'Educational use zone the following entries should be made.

Against the entry 'I 'Residential use zone Verrapanajan Village S.No. 1/5A1, 7/1A1, shall be deleted.

Against the entry 'IV 'Educational use zone Verrapanajan Village S.No. 1/5A1, 7/1A1 shall be added.

VARIATION.

In the said Master Plan in Part II "LAND USE SCHEDULE" in Thiruppalai Village and of Madurai Corporation, Madurai North Taluk and Madurai District under the heading VIII Land Under Water use zone to II Commercial use zone the following entries should be made

Against the entry 'VIII Land under Water use Zone Thiruppalai Village S.Nos. 41/2B shall be deleted.

Against the entry 'II 'Commercial use zone Thiruppalai Village S.Nos. 41/2B shall be added.

VARIATIONS.

In the said Modifi ed Master Plan in the 'Land Use Schedule' in Munnilaikottai Village under the heading Agricultural use zone and Residential use zone the following enteries should be made.

(1) Against the entry for the expression next to Residential use Zone- S.Nos. 387/1A, 387/2A, 395/1B, 395/3A3A, 395/3A3C, 395/4A1, 395/4A3 Munnilaikottai Village shall be added.

(2) Against the entry for the expression next to Agricultural use Zone-S.Nos. 387/1A, 387/2A, 387/1B, 395/3A3A,395/3A3C, 395/4A1, 395/4A3 Munnilaikottai Village shall be deleted.

VARIATIONS.

In the said Modifi ed Master Plan in the 'Land Use Schedule' in Adiyanoothu Village under the heading Agricultural use zone and Residential use zone the following enteries should be made.

(1) Against the entry for the expression next to Residential use Zone- S.Nos. 302/1D, 302/1E, 302/1F, 306/1B13, 306/1B14 & 306/2B1 Adiyanoothu Village shall be added.

(2) Against the entry of the expression next to Agricultural use Zone-S.Nos. 302/1D, 302/1E, 302/1F, 306/1B13, 306/1B14 & 306/2B1 Adiyanoothu Village shall be deleted.

VARIATION.

In the said Master Plan in 'LAND USE SCHEDULE' under the heading CHINNAMANUR LOCAL PLANNING AREA under the sub heading Karunkattankulam Revenue Village under the heading-VII, Agricultural use zone under the sub heading B.Dry Land to Residential use zone.

(I) Against the entry 'Agricultural Use Zone under the sub heading B.Dry Land under the sub heading Karukattankulam village for the expression R.S.No.335 to 360, 361 (Except 361/3C), 362 (Except 362/2pt), 363 to 370 the following expression 355 to 360, 361 (Except 361/3C), 362 (Except 362/2pt) 362/2pt (Ward-D, Block-13, T.S.No.10/12), 363 to 370 shall be substituted

(II) Against the entry 'Mixed Residential use zone' under the sub heading Karukattankulam Village for the expression R.S.No. 361/3C, 362/2pt the following expression R.S.No. 361/3C, 362/2pt 362/2pt (Ward-D, Block-13, T.S.No.10/2), shall be substituted

Land use zone conversion from Education use zone into Residential Use Zone ordered in G.O.(2D) No. 277, Housing and Urban Development [UD4(NPM)] Department dated 11-11-2022 the following variation are made to the Master Plan of Mamallapuram Local Planning Authority approved under the said Act and published in the G.O.Ms. No.153 H & UD [UD4(2)] dated 20-6-2013, Notifi cation No.28, at page No.481 of Part II—Section 2 of the Tamil Nadu Government Gazette dated 17th July 2013.

VARIATION.

In the Mamallapuram Master Plan, under the heading permitted land use in various survey numbers of Mamallapuram Local Planning Area, under heading in 46, Padur Village Page No.111 the following entries should be made.

1. Padur Village, Against the entry Residential use Zone the following Survey Number shall be added S.No: 335;

Before the S.No.351 and 388/3A, 3B, 3C; 390; 391/1A, 1B, 2A; 392; 393/1 before the S.No.416.

2. Against the entry 10. Costal Regulation Zone-I the following survey number shall be deleted S.No:335 pt. 3. Against the entry 4. Education Use Zone the following survey number shall be substituted 388 (Except.388/3A, 3B, 3C), 391 (Except. 391/1A, 1B, 2A), 393 (Except. 393/1) instead of Suvey Number: 388, 390 to 393.
