PRELIMINARY NOTIFICATION

No. II(2)/WR/19(f)/2023.

Whereas it appears to the appropriate Government that a total of 0.46.2 hectares of land is required in Pirancheri Village in Cheranmahadevi Taluk in Tirunelveli District for public purpose, namely, Tamirabarani, Karumeniyar, Nambiyar interlinking Flood Carrier Canal Project. Environmental Impact Assessment study for the irrigation project (ie) formation of Flood Carrier Canal from Kannadian Channel to Drought prone areas of Sattankulam & Tisayanvillai by interlinking Tamirabarani, Karumeniya, Nambiyar Rivers in Tirunelveli and Thoothukudi Districts in Tamil Nadu has been carried out by "WAPCOS" under Section 3(3) of the Environmental Protection Act, 1986 The land is acquired to wit for the formation of Flood Carrier Canal. As the Environment Impact Assessment study has been carried out for this irrigation project, Social Impact Assessment shall not apply according to the provision of sub-section (2) of Section 6 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013) (copy of Enviornmental Impact Assessment study report is attached herewith). The Requisition body entered on the project area on 05.10.2009, 03.02.2011 and canal was dug to Flood Carrier Project. No family was displaced due to the land acquisition. The Sub Collector, Cheranmahadevi is appointed as Administrator for the purpose of Rehabilitation and Resettlement. Therefore, it is notifi ed that for the above said project in the Pirancheri Village of Cheranmahadevi Taluk in Tirunelveli District, land measuring an extent of 0.46.2 hectares, whose details are specifi ed in the Schedule below, is under acquisition:

This notifi cation is made under sub-section (1) of Section 11 of the Right to Fair Compensation and Transparency in Land acquisition, Rehabilitation and resettlement Act, 2013 (Central Act 30 of 2013), to all whom it may concern.

A plan of the land may be inspected in the offi ce of the Collector and Land Acquisition Offi cer on any working day during the working hours.

The Government is pleased to authorize the requiring department Executive Engineer, PWD, Special Project Division, Tirunelveli and his staff to enter upon a survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specifi ed in Section 12 of the said Act. Under sub-section (4) of Section 11 of the said Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase, etc or create any encumbrances on such land from the date of publication of this notifi cation in the Tamil Nadu Government Gazette without prior approval of the Collector.

Objections to the acquisition, if any, may be fi led by the person interested within 60 (Sixty) days from the date of publication of this notifi cation in the Tamil Nadu Government Gazette as provided under Section 15 of the said Act before the Collector.

திருநெல்வேலி மாவட்டத்தின் சேரன்மகாதேவி வட்டம் பிராஞ்சேரி கிராமத்தில் மொத்தம் 0.46.2 ஹெக்டேர் நிலம் தாமிரபரணி-கருமேனியாறு-நம்பியாறு இணைப்புத்திட்டத்திற்காக வெள்ள நீர்க்கால்வாய் எனப்படும் பொதுநலப் பயன்பாட்டிற்காகத் தேவைப்படுவதாக உரிய அரசு உத்தேசித்து நிர்வாக அனுமதி வழங்கியுள்ளது. தாமிரபரணி-கருமேனியாறு-நம்பியாறு நதிகளை இணைத்து கன்னடியன் கால்வாய் வழியாக உபரி நீரை சாத்தான்குளம் மற்றும் திசையன்விளை ஆகிய வறண்ட பகுதிகளுக்கு வெள்ளநீர்க் கால்வாய் அமைக்க உபயோகப்படுத்தப்படுவதால் நீர்ப்பாசனத் திட்டத்திற்கான சுற்றுச்சூழல் மதிப்பீட்டாய்வு WAPCOSTAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 3 நிறுவனத்தால் சுற்றுச்சூழல் பாதுகாப்புச் சட்டம், 1986 பிரிவு (3)3)ன்படி சுற்றுச்சூழல் மதிப்பீட்டாய்வு மேற்கொள்ளப்பட்டுள்ளது. இந்நிலங்கள் வெள்ளநீர்க் கால்வாய் நீர்ப்பாசனத் திட்டம் அமைப்பதற்காக மட்டும் கையகம் செய்யப்படுகிறது. இத்திட்டத்திற்காக சுற்றுச்சூழல் மதிப்பீட்டாய்வு மேற்கொள்ளப்பட்டுள்ளதால் 2013ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவு மறைவின்மைக்கும் மறுவாழ்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச் சட்டத்தின் பிரிவு (2)6)- ன்படி சமூக தாக்க மதிப்பீட்டாய்வு மேற்கொள்ள வேண்டியதில்லை. அதற்கான சுற்றுச்சூழல் திட்ட மதிப்பீட்டாய்வு அறிக்கை நகல் இணைக்கப்பட்டுள்ளது. பிராஞ்சேரி கிராமம் பிரஸ்தாபபுல எண்களில் 05.10.2009 மற்றும் 03.02.2011 ஆகிய தேதிகளில் கேட்புத் துறையினால் முன்நுழைவு செய்யப்பட்டு கால்வாய் தோண்டப்பட்டுவிட்டது. இத்திட்டத்திற்காக 0.46.20ஹெக்டேர் நிலங்கள் கையகப்படுத்தப்படுவதன் காரணமாக குடும்பங்கள் ஏதும் இடமாற்றம் செய்யப்படவில்லை. ஆகவே சமூகதாக்க மதிப்பீட்டாய்வு கேட்புத் துறையினர் மூலம் மதிப்பீடு செய்யப்பட்டு திருநெல்வேலி மாவட்ட ஆட்சித்தலைவர் அவர்களுக்கு சமர்ப்பிக்கப்படுகிறது. மறுவாழ்வு மற்றும் மறுகுடியமர்வு வழங்குவதற்காக சேரன்மகாதேவி சார் ஆட்சியர் நிர்வாகியாக நியமனம் செய்யப்பட்டுள்ளார். எனவே திருநெல்வேலி மாவட்டத்தின் சேரன்மகாதேவி வட்டத்தைச் சேர்ந்த பிராஞ்சேரி கிராமத்தில் மேற்சொன்ன திட்டத்திற்காக 0.46.2 ஹெக்டேர் பரப்பளவு கொண்ட நிலப்பகுதி கையகப்படுத்தப்படவுள்ளது. அதன் விரிவான விவரங்கள் பின்வருமாறு:

இந்த அறிவிக்கை, 2013 ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவு மறைவின்மைக்குக்கும், மறுவாழ்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச் ச்சட்டத்தின் (மத்தியச் சட்டம் (30/2013) 11(1)/ பிரிவின் கீழ் வழங்கப்பட்டிருக்கும் விதிமுறைகளின் கீழ் தொடர்புடைய அனைவருக்காகவும் வெளியிடப்படுகிறது. மாவட்ட ஆட்சியர் மற்றும் நிலஎடுப்பு அலுவலர் ஆகியோரின் அலுவலகங்களில் யாதொரு வேலை நாட்களிலும் வேலை நேரங்களிலும் நிலத்தின் திட்டம் குறித்து ஆய்வு செய்யப்படலாம்.

மேற்சொன்ன சட்டத்தின் 12ஆம் பிரிவில் குறிப்பிடப்பட்டுள்ள மற்றும் வழங்கப்பட்டுள்ளவாறு, நிலத்தில் நுழைதல், யாதொரு நிலங்களை அளவெடுத்தல், அடிமண்ணை தோண்டுதல் அல்லது ஆழ்துளையிடுதல் மற்றும் இது தொடர்பான அனைத்து செயல்களையும் முறையாகச் செயல்படுத்த கேட்புத்துறையான நீர்வளத்துறை செயற்பொறியாளர் மற்றும் அவரது பணியாளருக்கு அதிகாரம் அளிக்கப்படுகிறது.

இச்சட்டத்தின் 11(4) ஆம் பிரிவின்கீழ், யாதொரு நபரும் நிலத்தை விற்பனை செய்தல் / வாங்குதல் போன்ற யாதொரு பரிமாற்றங்களில் ஈடுபடுதல் அல்லது பரிமாற்றங்கள் செய்தல் அல்லது மாவட்ட ஆட்சியரின் முன் அங்கீகாரம் இன்றி இந்த அறிவிக்கை வெளியிடப்பட்ட நாளிலிருந்து யாதொரு கையகப்படுத்துதல் தொடர்பாக மறுப்புரை ஏதேனும், இருப்பின், இச்சட்டத்தின் 15ஆம் பிரிவின் கீழ் தெரிவிக்கப்பட்டுள்ளவாறு இந்த அறிவிக்கை வெளியிடப்பட்ட நாளிலிருந்து 60 நாட்களுக்குள்ளாக (அறுபது நாட்களுக்குள்ளாக) பற்றுள்ளவர் அதனை, மாவட்ட ஆட்சியரிடம் அளிக்கலாம்.
