Ms. No. 940, Home (Courts-III), 19th December 2022, மார்கழி 4, சுபகிருது, திருவள்ளுவர் ஆண்டு-2053.] No. II(2)/HO/37/2023.—In exercise of the powers conferred by paragraph of Section 4 of the Tamil Nadu Civil Courts Act, 1873 (Central Act III of 1873), the Governor of Tamil Nadu, after consultation with the High Court, Madras hereby fixes the number of Subordinate judges to be appointed for the Subordinate judge's Court at Kodumudi in Erode District as one with effect from the date on which the Subordinate judge, Kodumudi assumes charge of that Court.

In exercise of the powers conferred by clause (b) of sub-section (1) of Section 3 and sub-section (2) of Section 5 of the Minimum Wages Act, 1948 (Central Act XI of 1948) and in supersession of the Labour and Employment Department Notification No. II(2)/LE/565/2019 published at pages 667-669 of Part II—Section 2 of the Tamil Nadu Government Gazette, dated the 10th July 2019, the Governor of Tamil Nadu hereby revises the minimum rates of wages payable to the classes of employees in the employment in Motion Picture Industry (including Production, Distribution and Publicity) in the State of Tamil Nadu specified in column (1) of the Schedule below, as specified the corresponding entries in column (2) thereof.

Explanation.- (1) Dearness Allowance.— In addition to the minimum rates of basic wages fixed above, the employees shall be paid dearness allowance as indicated below:-

(i) The dearness allowance is linked to the Average Chennai City Consumer Price Index Number for the year 2010, i.e. 161 points (with base 2001 = 100) and for every raise of one point over and above 161 points an increase of Rs.52.40 (Rupees Fifty two and paise forty only) per month shall be paid as dearness allowance.

In exercise of the powers conferred by clause (b) of sub-section (1) of Section 3 and sub-section (2) of Section 5 of the Minimum Wages Act, 1948 (Central Act XI of 1948) and in supersession of the Labour and Employment Department Notification No. II(2)/LE/560/2019 published at pages 663 of Part II—Section 2 of the Tamil Nadu Government Gazette, dated the 10th July 2019, the Governor of Tamil Nadu hereby revises the minimum rates of wages payable to the classes of employees in the employment in Tobacco Manufactory (Snuff Industry) in the State of Tamil Nadu specified in column (2) of the Schedule below, as specified in the corresponding entries in column (3) thereof.

(ii) The dearness allowance shall be calculated every year on the first April on the basis of the average of the indices for the preceeding 12 (twelve) months, that is from January to December.

Explanations.- (1) Dearness Allowance.—In addition to the above minimum rates of basic wages, the employees shall be paid dearness allowance as indicated below:-

(i) The dearness allowance shall be linked to the Average Consumer Price Index number for Chennai City for the year 2010, (that is 161 points with base 2001=100) and for every raise of one point over and above 161 points, an increase of Rs.1.40 (One rupee and forty paise only) per day shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated every year on the first April on the basis of the average of the indices of the preceding twelve months, namely from January to December.

(iii) The first calculation shall be effective from the date of publication of this Notification in the Tamil Nadu Government Gazette based on the Average Chennai City Consumer Price Index for the previous year.

(2) Where the nature of work is the same, no distinction in the payment of wages shall be made in case of men and women employees.

(3) To arrive at the monthly rates of wages, the daily wages shall be multiplied by 30.

(4) The minimum wages and dearness allowance fixed above includes the element of holiday wages also.

மேற்சொன்ன தொழிற் தகராறில் உள்ள கோரிக்கைகளை சென்னை தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்; 1947ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் (மத்தியச் சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தகராறு சென்னை, தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேலும், 1947 ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு சென்னை தொழிலாளர் நீதிமன்றம் கேட்டுக் கொள்ளப்படுகிறது.

6. The Government after careful examination have Order: No. 35, Welfare of Differently Abled Persons (DAP-3.2), dated 27th December 2022.

As per Section 33(i) of the Rights of Persons with decided to accept the request of Rural Development and Panchayat Raj Department, as a special case to follow the functional classification of Differently Abled Persons identified for the post of Assistant Engineer (Civil) in Rural Development and Panchayat Raj Department suitable for Differently Abled Persons under 4 % reservation as given below:—

as most suitable for differently abled persons under 4% reservation.

3. In the Government Order third read above, orders were issued as per Section 33 (i) of the Rights of Persons with Disabilities Act, 2016 identifying suitable posts for Differently Abled Persons under Group A & B categories in Public Sector undertakings / Boards / Corporations / Universities among other posts in certain departments the post of Assistant Engineer has not been classified under the functional classification of Differently Abled Persons 'SLD' (Specific Learning Disabilities) for the reservation of 4% vacancies earmarked for the differently abled persons will be applicable to identify the posts in respect of 'A' and 'B' categories for direct recruitment posts only.

4. In the letter fourth read above, the Director, Rural Development and Panchayat Raj has requested that the following category of disabilities identified under 4 % of the vacancies for Direct Recruitment for the post of Assistant Engineer in Rural Development and Panchayat Raj Department to be reserved for the Differently Abled Persons where the rule of reservation is applicable for the SC/STs, SCs and other communities so as to obtain 7. The Government also direct that 4% of the vacancies in direct recruitment for the identified posts in 'A' and 'B' Groups, where the rule of reservation is applicable for the SCs / STs / BCs and other communities, shall be reserved for the Differently Abled Persons. If only one post is available for recruitment in these categories, the usual procedure for recruitment will be followed. The Government also directed that,

(i) The reservation of 4% vacancies earmarked for the Differently Abled Persons will be applicable to identify the posts in respect of 'A' and 'B' categories for direct recruitment posts only.

(ii) The individuals selected for 'A' and 'B' categories of posts should be asked to produce certificate of physical fitness and the disability certificate as stated in Section 3(oo) of Tamil Nadu Government Servants (Conditions of Service) Amendment Act, 2017.

8. The effect of this Government Order will be from the date of publication of/Gazette notification.
