No. II(2)/LWSD/55/2023.— In exercise of the powers conferred by clause (a) of sub-section (1) of Section 5 read with Section 9 of the Minimum Wages Act, 1948 (Central Act XI of 1948), the Governor of Tamil Nadu hereby makes the following amendment to the Labour Welfare and Skill Development Department Notifi cation No. II(2)/LWSD/890/2022, published at pages 1037-1038 of Part II-Section 2 of the Tamil Nadu Government Gazette, dated the 23rd November 2022.

In the said Notifi cation, in the tabular column, for the heading "Employers' Representatives", the following heading shall be substituted, namely:-

1947ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்தியச் சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தொழிற் தகராறு, சென்னை தொழிற்தீர்ப்பாயத்தின் தீர்ப்புக்கு அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.
மேலும், 1947ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு சென்னை தொழிற்தீர்ப்பாயத்தைக் கேட்டுக் கொள்ளப்படுகிறது.

தொழிலாளர்களுக்கு அடிப்படை சம்பளத்தில் 15% வீட்டு வாடகைப் படி மாதம்தோறும் வழங்கப்பட வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயம் தானா? ஆம் எனில், உரிய உத்தரவு பிறப்பிக்கவும்.

மேற்சொன்ன தொழிற் தகராறை தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;
1947ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் (மத்தியச் சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு தமிழ்நாடு ஆளுநர் அவர்கள் மேற்சொன்ன தொழிற் தகராறு, திருநெல்வேலி தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மேற்சொன்ன தொழிற்தகராறை தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்;
