Amendment to the TNERC (Procedure for Payment of Subsidy by the State Government)

In exercise of the powers conferred by Section 65 of the said Electricity Act, 2003, read with clause (zp) of sub-section (2) of Section 181 thereof and all other powers enabling it in this behalf, the Tamil Nadu Electricity Regulatory Commission hereby makes the following amendments to the TNERC (Procedure for payment of subsidy by the State Government) Regulations, 2008, the draft of the same having been previously published as required under sub-section (3) of the said Section 181 of the said Act.
They shall come into force on the date of publication in the Tamil Nadu Government Gazette Extraordinary.

(1) In the said Regulation, in Regulation 5, for sub-regulation (ii), the following sub-regulation shall be
substituted, namely:-
(ii) The subsidy shall be payable by the GOTN to the distribution licensee in advance as below as per the following schedule of payment ordered by the Commission:—
All category of consumers: Quarterly
(2) In the said Regulation, in Regulation 5, for sub-regulation (vii), the following sub-regulation shall
be substituted, namely:-
(vii) The distribution licensee shall reconcile the actual subsidy received with actual consumption within 60 days from the closure of quarterly accounts and send proposal for adjustment of subsidy. The Commission may approve the fi nal subsidy.

The Ministry of Power, Govt. of India, has framed the Standard Operating Procedure (SOP) under Revamped Distribution Sector Scheme (RDSS), to improve the operational effi ciencies and fi nancial sustainability of DISCOMs.
As the Scheme envisages submission of subsidy bills quarterly to the State Government alongwith the reconciliation / true-up of the subsidy, it has become necessary to amend the regulation. The present amendment seeks to adhere the procedure prescribed by the Ministry of Power.

STATEMENT SHOWING THE EXISTING PROVISION AND THE PROVISION EMBODYING AMENDMENT

2008 ஆம் ஆண்டு தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணைய (மாநில அரசால் மானியத் தொகை வழங்குவதற்கான நடைமுறை) ஒழங்குமுறை விதிகளுக்குரிய பின்வரும் திருத்தமானது, 2003 ஆம் ஆண்டு மின்சாரச் சட்டத்தின் 181 ஆம் பிரிவின் (2) ஆம் உட்பிரிவின் (zp) கூறுடன் சேர்த்துப் படிக்கப்படும் அந்தச் சட்டத்தின் 65 ஆம் பிரிவினால் வழங்கப்பட்ட அதிகாரங்களையும் இதன்பொருட்டு அதனை இயல்விக்கும் அனைத்துப்பிற அதிகாரங்களையும் செலுத்தி தமிழ்நாடு மின்சார ஒழுங்குமுறை ஆணையம் இதன் மூலம் மேற்சொன்ன சட்டத்தின் 181 ஆம் பிரிவின் (3) ஆம் உட்பிரிவினால் வேண்டுறுத்தப்பட்டவாறு அதன் வரைவுத் திருத்தத்தை முன்னதாக வெளியிட்டுள்ளது.
இது தமிழ்நாடு அரசிதழில்தமிழ்நாடு அரசிதழில் சிறப்பு வெளியீடு செய்யப்பட்ட நாளிலிருந்து நடைமுறைக்கு வரும்.
திருத்தங்கள்திருத்தங்கள்
i. பின்வரும் ஒழுங்குமுறை விதியின் (ii) ஆம் உள்-ஒழுங்குமுறை விதிக்குப் பதிலாக, பின்வரும் உள்-ஒழுங்குமுறை விதி அமைக்கப்படுதல் வேண்டும், அதாவது:-
ii. மானியமானது ஆணையத்தினால் ஆணையிடப்பட்டதும் பின்வருமாறு பட்டியலிடப்பட்டதுமான வழங்குகையின்படி கீழ்க்கண்டவாறு மின்பகிர்மான உரிமம்தாரருக்கு தமிழ்நாடு அரசினரால் முன்னதாக வழங்கப்படத் தக்கதாகும்/வழங்கத் தக்கதாகும்:-
அனைத்து வகையான மின்நுகர்வோர்களுக்கு: காலாண்டு முறையில்,
மேற்சொன்ன ஒழுங்குமுறை விதியின் 5 ஆம் ஒழுங்குமுறை விதியிலுள்ள (vii) ஆம் உள்-ஒழுங்குமுறை விதி அமைக்கப்படுதல் வேண்டும், அதாவது:-
(vii) மின்பகிர்மான உரிமம்தாரர் காலாண்டுமுறைக் கணக்குகளை முடிப்பதிலிருந்து 60 நாட்களுக்குள் உள்ளபடியேயான மின்நுகர்விற்காகப் பெறப்பட்ட உள்ளபடியான மானியக் கணக்குகளை சீர்செய்தல் மற்றும் மானியக் கணக்கைச் சரிக்கட்டுவதற்கான உத்தேசத் திட்டத்தை அனுப்புதல் வேண்டும். ஆணையம் இறுதியான மானியக் கணக்கிற்கு ஒப்புதலளிக்கலாம்.

விளக்கவுரைவிளக்கவுரை
இந்திய அரசின் மின்துறை அமைச்சகம் மின்பகிர்மான நிறுவனங்களின் செயல்பாட்டுத்திறன் மற்றும் நிதி நிலைத்தன்மையை மேம்படுத்துவதற்காக புதுப்பிக்கப்பட்ட மின்பகிர்மான திட்டத்தின் கீழ் நிலையான செயல்பாட்டு நடைமுறையை வடிவமைத்துள்ளது.
இந்தத் திட்டத்தின்படி மத்திய அரசு முந்திய காலாண்டின் மானியக் கோரிக்கை கணக்குகளைச் சீர்செய்தல் மற்றும் சரிகட்டுதல் செய்வதற்காக மாநில அரசிடம் காலாண்டுக்கு ஒருமுறை மானியப்பட்டிகள் சமர்ப்பிக்கப்பட வேண்டுமென்று கருதுவதால், ஒழுங்குமுறை விதிகளில் திருத்தம் செய்வது அவசியமாகிறது.
தற்போதைய திருத்தம் மின்துறை அமைச்சகத்தினால் வரையறுக்கப்பட்ட நடைமுறையை கடைபிடிக்க விழைகிறது.
