No. II(2)/HE/397/2023.—Under clause 3 of Class-II-Other Members', of Section 23 (b) of the Manonmaniam Sundaranar University Act, 1990, the Hon'ble Governor Chancellor of the University hereby nominates the following three members to the Syndicate of Manonmaniam Sundaranar, Tirunelveli for a period of three years with effect from 28.02.2023:-

WHEREAS, complaints have been received from a number of depositors that the financial establishments M/s. Nirmal Krishna chits Private Limited, Nirmal Krishna Nidhi Limited and Palugal Krishna chits Private Limited, Kanniyakumari District, have defaulted the return of deposits made by the depositors after maturity;

AND WHEREAS, the Government are satisfied that the said financial establishments are not likely to return the deposits to the depositors and hence, the Government have to protect the interests of such depositors;

AND WHEREAS, the immovable properties specified in the Schedule to this order are alleged to have been procured by the said financial establishments from and out of the deposits collected from the depositors;

for Ariyalur District for a period of three years

under the Provincial Insolvency Act.

(2D) No. 168, Home (Courts-V), 29th March 2023, பங்குனி 15, சுபகிருது, திருவள்ளுவர் ஆண்டு-2054.] No. II(2)/Ho/398/2023.—In exercise of the powers conferred by sub-section (1) of Section 57 of the Provincial Insolvency Act, 1920 (Central Act 5 of 1920), the Governor of Tamil Nadu hereby appoints Tmt. T.N. Jeyanthi, Advocate, daughter of T.R. Natarajan, D.No.62, Kallakudi Street, Ariyalur, Ariyalur Taluk and District, as Official Receiver, within the local limits of the jurisdiction of the District Court, Ariyalur for a period of three years with effect on and from the date on which she assumes charge of her Office.

NOW, THEREFORE,in exercise of the powers conferred by Section 3 of the Tamil Nadu protection of Interests of Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu Act 44 of 1997), the Governor of Tamil Nadu hereby makes an ad-interim order attaching the immovable properties standing in the name of the Proprietor / Partners of the defaulted financial establishments, name!y, M/s. Nirmal Krishna Chits Private Limited, Nirmal Krishna Nidhi Limited and Palugal Krishna Chits Private Limited, Kanniyakumari District, functioned at Door No. 17/E1, E2, E4-Mathempalai, Palugal Post, Kanniyakumari District as specified in the Schedule to this order and transfers the control over the said immovable properties to the Competent Authority, namely, the Competent Authority and District Revenue Officer, Kanniyakumari District appointed under the said Act. (2) The Competent Authority and District Revenue Officer,Kanniyakumari District is requested to pursue further action in accordance with the procedure laid down in sub-sections (3) and (4) of section 4 of the said Act and also the formalities prescribed in the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Rules, 1997.

தமிழ்நாடு அரசு போக்குவரத்துக் கழகம் 1947ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்தியச் சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, இத்தகராறை காஞ்சிபுரம் தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்பப்பட வேண்டும் என்று தமிழ்நாடு ஆளுநர் அவர்கள் இதனால் ஆணையிடுகிறார்.

1960 ஆம் ஆண்டை அடிப்படை ஆண்டாகக் கொண்ட சென்னை மையத்திற்கான அகில இந்திய நுகர்வோர் விலைவாசி குறியீட்டு எண். 2,000 வரை ஒரு மாதத்திற்கான குறைந்தபட்ச அடிப்படைச் சம்பளம் ரூ.20,000/- என்று நிர்ணயம் செய்ய வேண்டும் என்றும், ஆண்டு ஊதிய உயர்வு 2% எனக் கொண்டு ஐந்தாண்டிற்கு ஒரு படி வைத்து கால முறை சம்பள விகிதம் நிர்ணயம் செய்து தொழிலாளர்களின் சேவைக் காலத்தை அடிப்படையாகக் கொண்டு ஒவ்வொரு ஆண்டிற்கும் ஒரு வெயிடேஜ் இன்கிரிமெண்ட் வழங்கி புதிய சம்பள விகிதத்தில் பொறுத்தி நிர்ணயம் செய்ய வேண்டும் என்றும், மேலும் மேற்கண்ட கோரிக்கைகள் 01.01.2020-ம் நாள் முதல் வழங்க வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானது தானா? ஆம் எனில் உரிய உத்தரவு பிறப்பிக்கவும்.

மேலும், 1947ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10(2A) பிரிவின் கீழ், இந்த ஆணையைப் பெற்றுக் கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு கோவை, தொழிலாளர் நீதிமன்றம் கேட்டுக் கொள்ளப்படுகிறது.
