PRELIMINARY NOTIFICATION

Whereas it appears to the appropriate Government has given Administrative Sanction that a total of 1.53.5 hectares of land is required in Pudukudi Village in Cheranmahadevi Taluk in Tirunelveli District for public purpose namely Tamirabarani-Karumeniyar-Nambiyar interlinking Flood Carrier Canal Project. Environmental Impact Assessment study for the irrigation project (ie) formation of Flood Carrier Canal from Kannadian Channel to Drought Prone Areas of Sattankulam, Tisayanvillai by interlinking Tamirabarani-Karumeniyar-Nambiyar Rivers in Tirunelveli and Thoothukudi Districts in Tamil Nadu has been carried out by "WAPCOS" under the Section 3(3) of the Environmental Protection Act 1986. The land is acquired to wit for the formation of Flood Carrier Canal. As the Environment Impact Assessment study has been carried out for this irrigation project, Social Impact Assesment shall not apply according to the provision of sub-section 2 of Section 6 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (copy of Enviornmental Impact Assessment study report is attached herewith). The Requisition body entered on the project area on 08.04.2010 and 02.04.2012 and canal was dug to Flood Carrier Project. No family was displaced due to the land acquisition. The Sub Collector, Cheranmahadevi is appointed as Administrator for the purpose of Rehabilitation and Resettlement. Therefore, it is notified that for the above said project in Pudukudi Village of Cheranmahadevi Taluk in Tirunelveli District, land measuring an extent of 1.53.5 hectares, the details of which are specified in the Schedule below, is under acquisition:

This notification is made under sub-section (1) of Section 11 of the Right to Fair Compensation and Transparency in Land acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013), to all whom it may concern.

A plan of the land may be inspected in the Office of the Special District Revenue Officer, Tamirabarani-Karumeniyar- Nambiyar River Linking Project, Tirunelveli and Land Acquisition Officer on any working day during the working hours

The Government is authorized the requiring department Executive Engineer, water Resources Department, Special Project Division, Tirunelveli and his staff to enter upon a survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in Section 12 of the said Act.

Under sub-section (4) of Section 11 of the said Act, no person shall make any transaction or cause any transaction of land i.e. sale / purchase, etc or create any encumbrances on such land from the date of publication of this notification in the Tamil Nadu Government Gazette without prior approval of the Special District Revenue Officer.

Objections to the acquisition, if any, may be filed by the person intersted within 60 (Sixty) days from the date of publication of this notification in the Tamil Nadu Government Gazette as provided under Section 15 of the said Act before the Special District Revenue Officer.

திருநெல்வேலி மாவட்டத்தின் சேரன்மகாதேவி வட்டம், புதுக்குடி கிராமத்தில் மொத்தம் 1.53.5 `ெக்டேர் நிலம் தாமிரபரணி- கருமேனியாறு-நம்பியாறு இணைப்புத் திட்டத்திற்காக வெள்ளநீர்க்கால்வாய் எனப்படும் பொதுநலப் பயன்பாட்டிற்காகத் தேவைப்படுவதாக உரிய அரசு உத்தேசித்து நிர்வாக அனுமதி வழங்கப்பட்டுள்ளது. தாமிரபரணி, கருமேனியாறு, நம்பியாறு நதிகளை இணைத்து கன்னடியன் கால்வாயிலிருந்து உபரி நீரை சாத்தான்குளம், திசையன்விளை ஆகிய வறட்சிப் பகுதிகளுக்கு வெள்ளநீர்க்கால்வாய் அமைக்க உபயோகப்படுத்தப்படுவதால் நீர்ப்பாசன திட்டத்திற்கான சுற்றுச்#ழல் மதிப்பீட்டாய்வு "WAPCOS" நிறுவனத்தால் சுற்றுச்#ழல் பாதுகாப்புச்சட்டம் 1986 பிரிவு 3(3)ன்படி சுற்றுச்#ழல் மதிப்பீட்டாய்வு மேற்கொள்ளப்பட்டுள்ளது.

இந்நிலங்கள் வெள்ளநீர்க் கால்வாய் நீர்ப்பாசன திட்டம் அமைப்பதற்காக மட்டும் கையகம் செய்்யப்படுகிறது. இத்திட்டத்திற்காக சுற்றுச்#ழல் மதிப்பீட்டாய்வு மேற்கொள்ளப்பட்டுள்ளதால் 2013ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவுமறைவின்மைக்கும் மறுவாழ்்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச் சட்டத்தின் பிரிவு 6(2)-ன்படி ச%க தாக்க மதிப்பீட்டாய்வு மேற்கொள்ள வேண்டியதில்லை. பிரஸ்தாப நிலங்களில் 08.04.2010 மற்றும் 02.04.2012 ஆகிய தேதிகளில் கேட்புத் துறையினால் முன்நுழைவு செய்யப்பட்்டு கால்வாய் தோண்டப்பட்டுவிட்டது. இத்திட்டத்திற்காக நிலங்கள் கையகப்படுத்தப்படுவதன் காரணமாக குடும்பங்கள் ஏதும் இடமாற்றம் செய்யப்படவில்லை. மறுவாழ்வு மற்றும் மறுகுடியமர்வு வழங்குவதற்காக சேரன்மகாதேவி சார் ஆட்சியர் நிர்வாகியாக நியமனம் செய்யப்பட்டுள்ளார். எனவே திருநெல்வேலி மாவட்டத்தின் சேரன்மகாதேவி வட்டத்தைச் சேர்ந்த புதுக்குடி கிராமத்தில் மேற்சொன்ன திட்டத்திற்காக 1.53.5 `ெக்டேர் பரப்பளவு கொண்ட நிலப்பகுதி கையகப்படுத்தப்படவுள்ளது என அறிவிக்கப்படுகிறது. அதன் விரிவான விவரங்கள் பின்வருகின்றன.

இந்த அறிவிக்கை, 2013 ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமாக சரியீடு பெறுவதற்கும் மற்றும் ஒளிவுமறைவின்மைக்கும், மறுவாழ்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச்சட்டத்தின் (மத்தியச் சட்டம் 30/2013) 11(1) பிரிவின் கீழ் வழங்கப்பட்டிருக்கும் விதிமுறைகளின் கீழ் தொடர்புடைய அனைவருக்காகவும் வெளியிடப்படுகிறது.

தனி மாவட்ட வருவாய் அலுவலர், நதிநீர் இணைப்புத்திட்டம், திருநெல்வேலி மற்றும் தனி வட்டாட்சியர் ஆகியோரால் யாதொரு வேலை நாட்களிலும் வேலை நேரங்களிலும் நிலத்தின் திட்டம் குறித்து ஆய்வு செய்யப்படலாம்.

மேற்சொன்ன சட்டத்தின் 12 ஆம் பிரிவில் குறிப்பிடப்பட்டுள்ள மற்றும் வழங்கப்பட்டுள்ளவாறு, நிலத்தில் நுழைதல், யாதொரு நிலங்களை அளவெடுத்தல், அடிமண்ணை தோண்டுதல் அல்லது ஆழ்துளையிடுதல் மற்றும் இது தொடர்பான அனைத்து செயல்களையும் முறையாகச் செயல்படுத்த கேட்புத்துறையான நீர்வளத்துறை சிறப்புத் திட்டக் கோட்டம் செயற் பொறியாளர் அலுவலருக்கு மற்றும் அவரது பணியாளருக்கு அதிகாரம் அளிக்கப்படுகிறது.

இச்சட்டத்தின் 11(4) ஆம் பிரிவின்கீழ், யாதொரு நபரும் நிலத்தை விற்பனை செய்தல் / வாங்குதல் போன்ற யாதொரு பரிமாற்றங்களில் ஈடுபடுதல் அல்லது பரிமாற்றங்கள் செய்தல் அல்லது தனி மாவட்ட வருவாய் அலுவலர், நதிநீர் இணைப்புத்திட்டம், திருநெல்வேலி முன் அங்கீகாரம் இன்றி இந்த அறிவிக்கை வெளியிடப்பட்ட நாளிலிருந்து யாதொரு வில்லங்கங்களையும் ஏற்படுத்த இயலாது.

கையகப்படுத்துதல் தொடர்பாக மறுப்புரை ஏதேனும், இருப்பின், இச்சட்டத்தின் 15ஆம் பிரிவின் கீழ் தெரிவிக்கப்பட்டுள்ளவாறு இந்த அறிவிக்கை வெளியிடப்பட்ட நாளிலிருந்து 60 நாட்களுக்குள் (அறுபது நாட்களுக்குள்ளாக) பற்றுள்ளவர் அதனை, தனி மாவட்ட வருவாய் அலுவலரிடம் அளிக்கலாம்.

திருநெல்வேலி மாவட்டத்தின் சேரன்மகாதேவி வட்டம், மேலச்செவல் பகுதி-2 கிராமத்தில் மொத்தம் 3.14.52 `ெக்டேர் நிலம் தாமிரபரணி-கருமேனியாறு-நம்பியாறு இணைப்புத்திட்டத்திற்காக வெள்ளநீர்க்கால்வாய் எனப்படும் பொதுநலப் பயன்பாட்டிற்காகத் தேவைப்படுவதாக உரிய அரசு உத்தேசித்து நிர்வாக அனுமதி வழங்கப்பட்டுள்ளது. தாமிரபரணி, கருமேனியாறு, நம்பியாறு நதிகளை இணைத்து கன்னடியன் கால்வாயிலிருந்து உபரிநீரை சாத்தான்குளம், திசையன்விளை ஆகிய வறட்சிப் பகுதிகளுக்கு வெள்ளநீர்க்கால்வாய் அமைக்க உபயோகப்படுத்தப்படுவதால் நீர்ப்பாசன திட்டத்திற்கான சுற்றுச்#ழல் மதிப்பீட்டாய்வு "WAPCOS" நிறுவனத்தால் சுற்றுச்#ழல் பாதுகாப்புச்சட்டம், 1986, பிரிவு 3(3)ன்படி சுற்றுச்#ழல் மதிப்பீட்டாய்வு மேற்கொள்ளப்பட்டுள்ளது. இந்நிலங்கள் வெள்ளநீர்க் கால்வாய் நீர்ப்பாசன திட்டம் அமைப்பதற்காக மட்டும் கையகம் செய்்யப்படுகிறது. இத்திட்டத்திற்காக சுற்றுச்#ழல் மதிப்பீட்டாய்வு மேற்கொள்ளப்பட்டுள்ளதால் 2013ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவுமறைவின்மைக்கும் மறுவாழ்்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச் சட்டத்தின் பிரிவு 6(2)-இன்படி ச%க தாக்க மதிப்பீட்டாய்வு மேற்கொள்ள வேண்டியதில்லை. பிரஸ்தாப நிலங்களில் 31.08.2011-ல்் கேட்புத் துறையினால் முன்நுழைவு செய்யப்பட்்டு கால்வாய் தோண்டப்பட்டுவிட்டது. இத்திட்டத்திற்காக நிலங்கள் கையகப்படுத்தப்படுவதன் காரணமாக குடும்பங்கள் ஏதும் இடமாற்றம் செய்யப்படவில்லை. மறுவாழ்வு மற்றும் மறுகுடியமர்வு வழங்குவதற்காக சேரன்மகாதேவி சார் ஆட்சியர் நிர்வாகியாக நியமனம் செய்யப்பட்டுள்ளார். எனவே திருநெல்வேலி மாவட்டத்தின் சேரன்மகாதேவி வட்டத்தைச் சேர்ந்த மேலச்செவல் பகுதி-2 கிராமத்தில் மேற்சொன்ன திட்டத்திற்காக 3.14.52 `ெக்டேர் பரப்பளவு கொண்ட நிலப்பகுதி கையகப்படுத்தப்படவுள்ளது என அறிவிக்கப்படுகிறது. அதன் விரிவான விவரங்கள் பின்வருகின்றன.

கையகப்படுத்துதல் தொடர்பாக மறுப்புரை ஏதேனும், இருப்பின், இச்சட்டத்தின் 15ஆம் பிரிவின் கீழ் தெரிவிக்கப்பட்டுள்ளவாறு இந்த அறிவிக்கை வெளியிடப்பட்ட நாளிலிருந்து 60 நாட்களுக்குள் (அறுபது நாட்களுக்குள்ளாக) பற்றுள்ளவர் அதனை, தனி மாவட்ட வருவாய் அலுவலரிடம் அளிக்கலாம்.

Environmental Impact Assessment study for the irrigation project (ie)formation of Flood Carrier canal from Kannadian Channel to Drought prone Areas of Sattankulam, Tisayanvillai by interlinking Tamirabarani-Karumeniyar-Nambiyar Rivers in Tirunelveli and Thoothukudi Districts in Tamil Nadu has been carried out by "WAPCOS" under the Section 3(3) of the Environmental Protection Act, 1986. திருநெல்வேலி மாவட்டத்தின் திசையன்விளை வட்டம், சேர்ந்த இராமகிரு\்ணாபுரம் கிராமத்தில் $டுதலாக 0.02.79 `ெக்டேர் நிலம் தாமிரபரணி-கருமேனியாறு-நம்பியாறு இணைப்புத்திட்டத்திற்காக வெள்ளநீர்க்கால்வாய் எனப்படும் பொதுநலப் பயன்பாட்டிற்காகத் தேவைப்படுவதாக உரிய அரசு உத்தேசித்து நிர்வாக அனுமதி வழங்கப்பட்டுள்ளது. தாமிரபரணி, கருமேனியாறு, நம்பியாறு நதிகளை இணைத்து கன்னடியன் கால்வாயிலிருந்து உபரி நீரை சாத்தான்குளம், திசையன்விளை ஆகிய வறட்சி பகுதிகளுக்கு வெள்ளநீர் கால்வாய் அமைக்க உபயோகப்படுத்தப்படுவதால் நீHப்பாசன திட்டத்திற்கான சுற்றுச்#ழல் மதிப்பீட்டு ஆய்வு "WAPCOS" நிறுவனத்தால் சுற்றுச்#ழல் பாதுகாப்புச்சட்டம் 1986 பிரிவு 3(3)ன்படி சுற்றுச்#ழல் மதிப்பீட்டாய்வு மேற்கொள்ளப்பட்டுள்ளது. இந்நிலங்கள் வெள்ளநீர்க் கால்வாய் நீர்ப்பாசனத்திட்டம் அமைப்பதற்காக மட்டும் கையகம் செய்யப்படுகிறது. இத்திட்டத்திற்காக சுற்றுச்#ழல் மதிப்பீட்டாய்வு மேற்கொள்ளப்பட்டுள்ளதால் 2013ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவு மறைவின்மைக்கும் மறுவாழ்்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச் சட்டத்தின் பிரிவு 6(2) ன் கீழ் ச%க தாக்க மதிப்பீட்டாய்வு மேற்கொள்ளும்் தேவை எழவில்லை. பிரஸ்தாப நிலங்களில் 06.03.2019 அன்று கேட்புத் துறையினால் முன்நுழைவு செய்யப்பட்்டு கால்வாய் தோண்டப்பட்டுள்ளது. இத்திட்டத்திற்காக நிலங்கள் கையகப்படுத்தப்படுவதன் காரணமாக குடும்பங்கள் ஏதும் இடமாற்றம் செய்யப்படவில்லை. மறுவாழ்வு மற்றும் மறுகுடியமர்வு வழங்குவதற்காக சேரன்மகாதேவி சார் ஆட்சியர் நிர்வாகியாக நியமனம் செய்யப்பட்டுள்ளார். எனவே திருநெல்வேலி மாவட்டத்தின் திசையன்விளை வட்டத்தைச் சேர்ந்த இராமகிரு\்ணாபுரம் கிராமத்தில் மேற்சொன்ன திட்டத்திற்காக $டுதலாக 0.02.79 `ெக்டேர் பரப்பளவு கொண்ட நிலப்பகுதி கையகப்படுத்தப்படவுள்ளது என அறிவிக்கப்படுகிறது. அதன் விரிவான விவரங்கள் பின்வருகின்றன.

இந்த அறிவிக்கை, 2013 ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமாக சரியீடு பெறுவதற்கும் மற்றும் ஒளிவுமறைவின்மைக்கும், மறுவாழ்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச்சட்டத்தின் (மத்தியச் சட்டம் 30/2013) 11(1) பிரிவின் கீழ் வழங்கப்பட்டிருக்கும் விதிமுறைகளின் கீழ் தொடர்புடைய அனைவருக்காகவும் வெளியிடப்படுகிறது.

தனி மாவட்ட வருவாய் அலுவலர்் தாமிரபரணி-கருமேனியாறு-நம்பியாறு இணைப்புத் திட்டம் திருநெல்வேலி ஆகியோரால் யாதொரு வேலை நாட்களிலும் வேலை நேரங்களிலும் நிலத்தின் திட்டம் குறித்து ஆய்வு செய்யப்படலாம்.

மேற்சொன்ன சட்டத்தின் 12 ஆம் பிரிவில் குறிப்பிடப்பட்டுள்ள மற்றும் வழங்கப்பட்டுள்ளவாறு, நிலத்தில் நுழைதல், யாதொரு நிலங்களை அளவெடுத்தல், அடிமண்ணை தோண்டுதல் அல்லது ஆழ்துளையிடுதல் மற்றும் இது தொடர்பான அனைத்து செயல்களையும் முறையாகச் செயல்படுத்த கேட்புத்துறையான நீர்வளத்துறை சிறப்புத் திட்டக் கோட்டம் செயற்பொறியாளர் அலுவலருக்கு மற்றும் அவரது பணியாளருக்கு அதிகாரம் அளிக்கப்படுகிறது.

இச்சட்டத்தின் 11(4) ஆம் பிரிவின்கீழ், யாதொரு நபரும் நிலத்தை விற்பனை செய்தல் / வாங்குதல் போன்ற யாதொரு பரிமாற்றங்களில் ஈடுபடுதல் அல்லது பரிமாற்றங்கள் செய்தல் அல்லது தனி மாவட்ட வருவாய் அலுவலர்் அங்கீகாரம் இன்றி இந்த அறிவிக்கை வெளியிடப்பட்ட நாளிலிருந்து யாதொரு வில்லங்கங்களையும் ஏற்படுத்த இயலாது.

கையகப்படுத்துதல் தொடர்பாக மறுப்புரை ஏதேனும், இருப்பின், இச்சட்டத்தின் 15ஆம் பிரிவின் கீழ் தெரிவிக்கப்பட்டுள்ளவாறு இந்த அறிவிக்கை வெளியிடப்பட்ட நாளிலிருந்து 60 நாட்களுக்குள் (அறுபது நாட்களுக்குள்ளாக) பற்றுள்ளவர் அதனை, தனி மாவட்ட வருவாய் அலுவலரிடம் அளிக்கலாம்.

Whereas it appears to the appropriate Government has given Administrative Sanction that a total of 0.23.00 hectares of land is required in the Konganthanparai Village in Palayamkottai Taluk in Tirunelveli District for public purpose, namely Tamirabarani-Karumeniyar-Nambiyar interlinking Flood Carrier Canal Project. Environmental Impact Assessment study for the irrigation project(i.e) Formation of flood carrier Canal from Cannadian channel to Drought Prone Areas of Sathankulam, Thisayanvilai by interlinking Tamirabarani, Karumeniyar, Nambiyar rivers in Tirunelveli and Tuticorin Districts in Tamil Nadu has been carried out by 'WAPCOS' under the Section 3(3) of the Environmental Protection Act, 1986. The land is acquired to wit for the formation of Flood Carrier Canal. As the Environmental Impact Assessment Study has been carried out for this Irrigation Project, Social Impact Assessment shall not apply according to the provision of Sub Section 2(6) of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 . The Requisition body entered on the 03.12.2010 for Survey No.5/1A1A1 canal was dug to Flood carrier Project. No family was displaced due to the land acquisition. The Sub Collector, Tirunelveli is appointed as Administrator for the purpose of Rehabilitation and Resettlement. Therefore, it is notified that for the above said project in the Konganthanparai Village of Palayamkottai Taluk in Tirunelveli District, land measuring an extent of 0.23.00 hectare, the details of which are specified in the Schedule below, is under acquisition:

The Schedule

This notification is made under sub-section (1) of Section 11 of the Right to Fair Compensation and Transparency in Land acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013), to all whom it may concern.

A plan of the land may be inspected in the Office of the Special District Revenue Officer, River linking Project, Tirunelveli and Land Acquisition Officer on any working day during the working hours.

The Government is authorized the requiring department Executive Engineer, Water Resources Department, Special Project Division, Tirunelveli and his staff to enter upon a survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in Section 12 of the said Act.

Under sub-section (4) of Section 11 of the said Act, no person shall make any transaction or cause any transaction of land i.e. sale / purchase, etc or create any encumbrances on such land from the date of publication of this notification in the Tamil Nadu Government Gazette without prior approval of the Special District Revenue Officer, River linking Project, Tirunelveli.

Whereas it appears to the Government that a total of 0.46.2 hectares of land is required in the Pirancheri Village in Cheranmahadevi Taluk in Tirunelveli District for public purpose, namely in Inter linking of Tamirabarani, Nambiyaru and Karumeniyar rivers for the Flood Carrier Canal Project.

Now, therefore a declaration is made hereby that a piece of land measuring 0.46.2 hectares is under acquisition for the above said project in the Pirancheri Village in Cheranmahadevi Taluk in Triunelveli District whose detailed description is as follows:

This declaration is made after hearing of objections of persons interested and due enquiry as provided under Section 15 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013). The number of families likely to be resettled due to land acquisition is Nil.

Mines of coal, iron-stone, slate or other minerals lying under the said land or any particular portion of the said land, except such parts of the mines and minerals which may be required to be dug or removed or used during the construction phase of the project for the purpose of which the land is being acquired, are not needed.

A plan of the land may be inspected in the office of the Land Acquisition Officer, O/o Special Tahsildar (L.A), River Linking Project, Unit I Ambasamudram @ Cheranmahadevi and O/o Executive Engineer, Water Resources Department, Nambiyar Reservoir Project Division, Vallioor on any working day.

2013ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவுமறைவின்மைக்கும், மறுவாழ்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச்சட்டத்தின் (மத்தியச் சட்டம் 30/2013) 15 ஆம் பிரிவின் கீழ் வகை செய்யப்பட்டவாறு பற்றுள்ள நபரின் மறுப்புரைகளைக் கேட்ட பின்னரும் உரிய விசாரணைக்குப் பின்னரும் இந்த விளம்புகை தயாரிக்கப்பட்டுள்ளது. நிலம் கையகப்படுத்துவதன் காரணமாக மறுகுடியமர்வுக்கு வாய்்்ப்பான குடும்பங்களின் எண்ணிக்கை ஏதுமில்லை.
