NOTIFICATIONS BY GOVERNMENT

RURAL DEVELOPMENT AND PANCHAYAT RAJ DEPARTMENT

VILLUPURAM DISTRICT, VALLAM PANCHAYAT UNION, EACHUR VILLAGE PANCHAYAT, 5TH WARD MEMBER DISQUALIFICATION UNDER THE TAMIL NADU PANCHAYATS ACT, 1994.

WHEREAS, the District Collector, Villupuram District in his report dated 17.02.2023 has stated that Thiru.S.Sudhagaran has contested the Tamil Nadu Local Bodies Election in Eachur Village Panchayat, Vallam Panchayat Union, Villupuram District held on 09.10.2021 and won in the election. He has further stated that on the last date of filing nomination (22.09.2021), he has completed 19 years and 7 months only, that is, he has not completed 21 years of age. Thereby he was not fulfilling the qualification of age as required under clause (ii) of section 33 of the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994). Therefore, he has requested the Government to disqualify Thiru.S.Sudhagaran, 5th Ward Member, Eachur Village Panchayat, Vallam Panchayat Union, Villupuram District.

AND WHEREAS, the opinion of Tamil Nadu State Election Commission has been sought for regarding the disqualification of the said Thiru.S.Sudhagaran, 5th Ward Member, Eachur Village Panchayat, Vallam Panchayat Union, Villupuram District, as required under sub-section (2) of section 41 of the said Act.

AND WHEREAS, the Tamil Nadu State Election Commission, after conducting the enquiry, has stated that on verification of the relevant documents viz. abstract of affidavit submitted by the candidate while filing nomination, voter list containing his name, Aadhar card and Transfer certificate of Government Polytechnic College, Chennai, the age of Thiru.S. Sudhagaran, 5th ward Member, Eachur Village Panchayat, Vallam Panchayat Union, Villupuram District is 19 years, 7 months only on the last date of nomination (22nd September 2021) and thereby opined that Thiru.S.Sudhagaran, 5th ward Member, Eachur Village Panchayat, Vallam Panchayat Union is disqualified to continue as 5th Ward Member of Eachur Village Panchayat, Vallam Panchayat Union, Villupuram District under clause (ii) of section 33 of the said Act.

NOW THEREFORE, under sub-section (1) of section 41 of the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994), the Governor of Tamil Nadu hereby decides, that Thiru.S. Sudhagaran, 5th ward Member, Eachur Village Panchayat, Vallam Panchayat Union, Villupuram District has become disqualified from holding the office of the 5th Ward Member of the Eachur Village Panchayat, Vallam Panchayat Union, Villupuram District as he has not fulfilled the qualification as required under clause (ii) of section 33 of the said Act.
