Ms. No. 579, Home (Courts.III), 17th November 2023, கார்த்திகை 1, சோபகிருது, திருவள்ளுவர் ஆண்டு-2054.] No. II(2)/HO/1041/2023.—In exercise of the powers conferred by Section 3A of the Tamil Nadu Civil Courts Act, 1873 (Central Act III of 1873), the Governor of Tamil Nadu, after consultation with the High Court, Madras, hereby appoints one more Additional District Judge to the Principal District Court, Vellore and also alters the number of District Judges and Additional District Judges to be appointed to the said District as eight with effect from the date on which the said Additional District Judge assumes charge of the Additional District Court at Arakkonam in Vellore District. AND WHEREAS, the said financial establishment was incorporated and registered its name as Messers Best Plus Real Estate Private Limited, Rajapalayam, Virudhunagar District with the Registrar of Companies under the Companies Act, 1956 (Central Act 1 of 1956) with Registration No. U70109TN2012PTC089134;

AND WHEREAS, the Government are satisfied that the said financial establishment is not likely to return the deposits to the depositors and hence, the Government have to protect the interests of such depositors;

AND WHEREAS, the movable and immovable properties specified in the Schedule to this order were alleged to have been procured by the Proprietor / Partner of the said Financial establishment from and out of the deposits collected by the Financial Establishment;

NOW, THEREFORE, in exercise of the powers conferred by Section 3 of the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu Act 44 of 1997), the Governor of Tamil Nadu hereby makes an ad-interim order attaching the movable and immovable properties standing in the name of the Proprietor / Partners of the said Financial establishment as specified in the Schedule to this order and transfers the control over the said movable and immovable properties to the Competent Authority, namely, the Competent Authority and District Revenue Officer, Virudhunagar District appointed under the said Act.

2. The Competent Authority and District Revenue Officer, Virudhunagar District is requested to pursue further action in accordance with the procedures laid down in sub-sections (3) and (4) of Section 4 of the said Act and also the formalities prescribed in the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Rules, 1997.

3. The Special Public Prosecutor, Special Court constituted under the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997, Madurai, is requested to render necessary assistance to the Competent Authority and District Revenue Officer, Virudhunagar District in filing the application before the Said Special Court.

From the Additional Director General of Police, Economic Offences Wing, Chennai Letter C.No.C1/EOW/7899/2023, dated 14.07.2023 conferred by Section 3 of the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu Act 44 of 1997), the Governor of Tamil Nadu hereby makes an ad-interim order attaching the movable property of, Thiru. N.Muthukannan (binamy of Accused 2 - Vinoth @ Chellasamy) in connection with the defaulted financial establishment namely, Messers Medcure Pharmacy, functioned at Door No.3, S.F.No.25, Ganapathy Maanagar, Ganapathy, Coimbatore, as specified in the Schedule to this order and transfers the control over the said movable property to the Competent Authority, namely, the Competent Authority and District Revenue Officer, Coimbatore District appointed under the said Act.

2. The Competent Authority and District Revenue Officer, Coimbatore District is requested to pursue further action in accordance with the procedure laid down in sub-sections (3) and (4) of Section 4 of the said Act and also the formalities prescribed in the Order: No. 584, Home (Police-XIX), dated 20th November 2023 WHEREAS, complaints have been received from a number of depositors that Messers Medcure Pharmacy, Coimbatore District, a financial establishment, has defaulted the return of deposits made by the depositors after maturity;
