No. II(2)/LWSD/298/2024.—தமி ழ் நாடு அ ர சு போக்குவரத்து கழகம் (திருநெல்வேலி) லிட்., நாகர்கோவில் மண் டல ம் , நா கர் ே கா வி ல் எ ன் ற நி ர் வ ாக த் திற்கு ம் பொதுச்செயலாளர், தமிழ்நாடு அரசு போக்குவரத்துக் கழக தொழிலாளர் முன்னேற்றச் சங்கம், நாகர்கோவில் என்ற தொழிற்சங்கத்திற்குமிடையே தொழிற்தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்; இத்தொழிற்தகராறை பின்வரும் எழுவினாவுடன் திருநெல்வேலி தொழிலாளர் நீதிமன்றத்தின் தீர்ப்புக்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்: 1947 ஆம் ஆண்டு தொழிற் தகராறுகள் சட்டத்தின் (மத்திய சட்டம் XIV / 1947) 10 (1) (c) பிரிவிலும், 10 (1) (d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு தமிழ்நாடு ஆளுநர் அவர்கள், மேற்சொன்ன தொழிற்தகராறு, திருநெல்வேலி, தொழிலாளர் நீதிமன்றத் தீர்விற்கு அனுப்பப்பட வேண்டும் என்று இதனால் ஆணையிடுகிறார்.

மனுதாரர் திரு.M.சாந்தப்பன். ஓட்டுநர் (பணி எண். 7867) என்பவருக்கு நிர்வாகத்தின் அலுவலக ஆணை எண் 4184/ லீகல்-4 / ஒழுங்கு / தநாஅபோக/ 2016, நாள். 23.02.2018- ன்படி வழங்கப்பட்ட தண்டனையான ஊதிய உயர்வினை வருங்காலத்தில் பாதிக்கும் வண்ணம் இரண்டு வருடத்திற்கு நிறுத்தி வைத்து ஆணையிடப்பட்டதை ரத்து செய்ய வேண்டும் என்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானது தானா? ஆம் எனில் உரிய உத்தரவு பிறப்பிக்கவும்.

மேலும், 1947 ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் 10 (2A) பிரிவின்கீழ், இந்த ஆணையைப் பெற்றுக்கொண்ட நாளிலிருந்து மூன்று மாதங்களுக்குள் தீர்ப்பு அளிக்குமாறு, திருநெல்வேலி, தொழிலாளர் நீதிமன்றம் கேட்டுக் கொள்ளப்படுகிறது.

மேற்சொன்ன தொழிற்தகராறில் உள்ள கோரிக்கைகளை சென்னை, தொழிலாளர் நீதிமன்றத்தின் தீர்ப்பிற்கு அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும், 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்திய சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1)(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, இத்தகராறை கீழ்க்காணும் எழுவினாக்களுடன் சென்னை, தொழிலாளர் நீதிமன்றத்தின் தீர்ப்பிற்கு அனுப்பப்பட வேண்டும் என்று தமிழ்நாடு ஆளுநர் அவர்கள் இதனால் ஆணையிடுகிறார்.

திரு.வேல்மணி ஓட்டுநரின் (பணி எண் D56594) ஆண்டு ஊதிய உயர்வு இரண்டு வருடம் தொடர்விளைவுடன் தள்ளி வைத்து நிர்வாகம் பிறப்பித்த 08.12.2021 நாளிட்ட இறுதி உத்தரவினை ரத்து செய்ய வேண்டுமென்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானது தானா? ஆம் எனில் உரிய உத்தரவு பிறப்பிக்கவும்.
