Notification under the Delhi Special Police

Establishment Act.

No. II(2)/CFCP/1061/2024.—In exercise of the powers conferred by sub-section (1) of Section 28 of the Consumer Protection Act, 2019 (Central Act 35 of 2019), the Governor of Tamil Nadu hereby establishes Additional District Consumer Disputes Redressal Commissions, to be known as the Additional District Commissions, one each in the Districts of Chennai (South), Chennai (North),Coimbatore, Tirunelveli, Madurai, Trichy, Thanjavur, Nagercoil and Tuticorin.

2. The establishment of the aforesaid Additional District Commissions shall be subject to the following conditions:-

(a) There shall not be any further financial commitment to the Government.

(b) Filling up of the posts in the newly established Additional District Commissions over the present sanctioned cadre strength shall not be claimed.

No. II(2)/CFCP/1063/2024.—In exercise of the powers conferred by clause (b) of Section 32 of the Consumer Protection Act, 2019 (Central Act 35 of 2019), the Governor of Tamil Nadu hereby directs Thiru Y. Gladstone Blessed Tagore, President of the District Consumer Disputes Redressal Commission, Tirunelveli to exercise the powers and discharge the functions of the President of the District Consumer Disputes Redressal WHEREAS, complaints have been received from a number of depositors that Messrs Neomax Properties Private Limited, Madurai District, a financial establishment, has defaulted the return of deposits made by the depositors after maturity;

AND WHEREAS, the Government are satisfied that the said financial establishment is not likely to return the deposits to the depositors and hence, the Government have to protect the interests of such depositors;

AND WHEREAS, in addition to the immovable and movable properties ad-interimly attached in the Government Orders first and second read above, the movable properties (cash in frozen bank accounts) specified in the Schedule to this Order are alleged to have been procured by the said financial establishment from and out of the deposits collected from the depositors;

NOW, THEREFORE, in exercise of the powers conferred by section 3 of the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu Act 44 of 1997), the Governor of Tamil Nadu hereby makes an ad-interim order attaching the movable properties (i.e)., cash in frozen bank accounts of the Directors of the defaulted financial establishment, namely, Messrs Neomax Properties Private Limited and its sister concerns, functioned at Door No. 85, Subramaniya Pillai Street, Ricky Tower 2nd Floor, Bye-Pass Road, S.S.Colony, Madurai, as specified in the Schedule to this Order, and transfers the control over the said movable properties to the Competent Authority, namely, the Competent Authority and District Revenue Officer, Madurai District appointed under the said Act.

2. The Competent Authority and District Revenue Officer, Madurai District is requested to pursue further action in accordance with the procedure laid down in sub- sections (3) and (4) of Section 4 of the said Act and also the formalities prescribed in the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Rules, 1997.

3. The Special Public Prosecutor, Special Court for the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997, Madurai, is requested to render necessary assistance to the Competent Authority and District Revenue Officer, Madurai District in filing the application before the Special Court constituted under the said Act.

Explanations.- (1) Dearness Allowance.- In addition to the above minimum rates of basic wages, the employees shall be paid dearness allowance as indicated below:-

No. II(2)/LWSD/1066/2024.—In exercise of the powers conferred by clause (b) of sub-section (1) of section 3 and sub-section (2) of section 5 of the Minimum Wages Act, 1948 (Central Act XI of 1948) and in supersession of the Labour and Employment Department Notification No. II(2)/LE/560/2019, published at page 663 of Part II—Section 2 of the Tamil Nadu Government Gazette. dated the 10th July, 2019, the Governor of Tamil Nadu, after consultation with the Advisory Board, hereby revises the minimum rates of wages payable to the classes of employees in the employment in tobacco manufactory (Snuff Industry) in the State of Tamil Nadu, specified in Column (2) of the Schedule below, as specified in the corresponding entries in column (3) thereof, the draft of the same having been previously published as required by clause (b) of sub-section (1) of section 5 of the said Act.

(i) The dearness allowance shall be linked to the Average Consumer Price Index number for Chennai City for the year 2010, (that is 161 points with base 2001=100) and for every raise of one point over and above 161 points, an increase of Rs.1.40 (One rupee and forty paise only) per day shall be paid as dearness allowance.

2. This Notification shall come into force with effect on and from the date of its publication in the Tamil Nadu Government Gazette.

The Schedule.

Employment in tobacco manufactory (Snuff Industry).

(ii) The dearness allowance shall be calculated every year on the first April on the basis of the average of the indices of the preceding twelve months, namely from January to December.

published at pages 867 - 868 of Part II—Section 2 of the Tamil Nadu Government Gazette, dated the 20th November 2019, the Governor of Tamil Nadu, after consultation with the Advisory Board, hereby revises the minimum rates of wages payable to the classes of employees in the employment in automobile workshops in the State of Tamil Nadu specified in column (1) of the Schedule below, as specified in the corresponding entries in column (2) thereof, the draft of the same having been previously published as required by clause (b) of sub-section (1) of section 5 of the said Act.

2. This Notification shall come into force with effect on and from the date of its publication in the Tamil Nadu Government Gazette.

Employment in Hand embroidery and jari.

Explanations.- (1) Dearness Allowance: In addition to the minimum rates of basic wages fixed above, employees shall be paid dearness allowance as indicated below:-

(i) The dearness allowance is linked to the Average Chennai City Consumer Price Index for the year 2010, that is 161 points (with base 2001=100) and for every raise of one point over and above 161 points, an increase of Rs.56.29 (Rupees Fifty six and paise twenty nine only) per month shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated every year on the first April on the basis of the average of the consumer price indices for the preceeding twelve months, that is from January to December.

(iii) The first calculation of dearness allowance shall, thus, be effective from the date of publication of this Notification in the Tamil Nadu Government Gazette based on the Average Chennai City Consumer Price Index Number for the previous year, that is from January to December.

(2) Where the nature of work is the same, no distinction in the payment of wages shall be made between male and female employees.

(3) To arrive at the daily wages, the monthly wages shall be divided by 26.

(4) Wherever the existing wages are higher than the minimum rates of wages fixed herein, the existing wages shall be continued to be paid.

Revision of minimum rates of wages for employment

in Hand Embroidery and Jari under the Act.

Explanations.- (1) Dearness allowance.- In addition to the minimum rate of basic wages as fixed above, the employees shall be paid dearness allowance as indicated below:-

No. II(2)/LWSD/1068/2024.— In exercise of the powers conferred by clause (b) of sub-section (1) of Section 3 and sub-section (2) of Section 5 of the Minimum Wages Act, 1948 (Central Act XI of 1948) and in supersession of the Labour and Employment Department Notification No. II(2)/LE/647/2019 published at page 734 of Part II-Section 2 of the Tamil Nadu Government Gazette, dated the 7th August 2019, the Governor of Tamil Nadu, after consultation with the Advisory Board, hereby revises the minimum rates of wages payable to the classes of employees in the employment in Hand embroidery and jari in the State of Tamil Nadu, specified in column (2) of the Schedule below, as specified in the corresponding entries in column (3) thereof, the draft of the same having been previously published as required by clause (b) of sub-section (1) of Section 5 of the said Act. 2. This Notification shall come into force with effect on and from the date of its publication in the Tamil Nadu Government Gazette.

(i) The dearness allowance is linked to the Average Chennai City Consumer Price Index Number for the year 2010, i.e. 161 points (with base 2001=100) and for every raise of one point over and above 161 points, an increase of Rs.2.27 (Two Rupee and Twenty Seven paise only) per day shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated every year on the first April on the basis of the average of the indices for the preceeding twelve months, namely from January to December.

(iii) The first calculation of the dearness allowance shall thus be made effective from the date of publication of this Notification in the Tamil Nadu Government Gazette, based on the average of Chennai City Consumer Price Index Number for the previous year.

(2) Where the nature of work is the same, no distinction in the payment of wages shall be made between the men and women employees.

(3) To arrive at the monthly rates of wages, the daily wages shall be multiplied by 30.

(4) Wherever the existing wages are higher than the minimum rates of wages fixed herein, the same shall be continued to be paid.

No. II(2)/LWSD/1069/2024.—In exercise of the powers conferred by clause (b) of sub-section (1) of Section 3 and sub-section (2) of section 5 of the Minimum Wages Act, 1948 (Central Act XI of 1948) and in supersession ofthe Labour and Employment Department Notification No. II(2)/(LE)/95/2019, published at pages 111 - 112 of Part II - Section 2 of the Tamil Nadu Government Gazette, dated the 23rd January 2019, the Governor of Tamil Nadu, after consultation with the Advisory Board, hereby revises the minimum rates of wages payable to the classes of employees in the employment in Timber Industry in the State of Tamil Nadu, specified in column (2) of the Schedule below, as specified in the corresponding entries in column (3) thereof, the draft of the same having been previously published as required by clause (b) of sub-section (1) of Section 5 of the said Act.

2. This Notification shall come into force with effect on and from the date of its publication in the Tamil Nadu Government Gazette.
