[Environment - Adjudication of disputes relating to Environment and Pollution-Appointment of Chairperson to the Appellate Authority of Tamil Nadu Pollution Control Board-Orders - Issued.]

The following Government Order is published:-

and 13380/98, the Authority has been constituted under a retired Judge of High Court as Chairman and Experts / Scientists in the field of Pollution Control as Members.

Accordingly, the Appellate Authority for Tamil Nadu Pollution Control Board was constituted vide Government order first cited.

3. In Government Order fourth read above, orders were issued appointing Hon'ble Justice M. Govindaraj retired Judge of Madras High Court, as Chairman to the Appellate Authority of Tamil Nadu Pollution Control Board [G.O. (2D). No. 88, Environment, Climate Change and Forest (EC-1), 9th May 2025, சித்திரை 26, விசுவாவசு, திருவள்ளுவர் ஆண்டு-2056.] Read:

1. G.O. (Ms).No. 208, Environment and Forests (EC.1) Department, dated 15.09.2000.

2. G.O. (Ms).No. 46, Environment and Forests (EC.1) Department, dated 01.03.2016.

3. G.O. (Ms).No. 23, Environment and Forests (EC.1) Department, dated 20.02.2019.

4. G.O. (Ms).No. 95, Environment, Climate Change and Forests (EC.1) Department, dated 23.05.2022.

5. From the Chairperson, Tamil Nadu Pollution Control Board Letter No. TNPCB/Law/ LA-III/32167/2013, dated 30-04-2025.

for adjudication of disputes relating to Environment and Pollution Control, for a period of three years from the date of issue of the order. As such, the tenure of the present Chairman to the Appellate Authority of Tamil Nadu Pollution Control Board will expire on 22.5.2025

4. In the letter fifth read above, the Chairperson, Tamil Nadu Pollution Control Board has requested orders of the Government appointing a new Chairman to the Appellate Authority of the Tamil Nadu Pollution Control Board.

5. The Government, after careful examination, appoint Hon'ble Justice Tmt. V. Bhavani Subbaroyan retired Judge of Madras High Court, as Chairperson to the Appellate Authority of Tamil Nadu Pollution Control Board for adjudication of disputes relating to Environment and Pollution Control, for a period of three years with effect from 23.05.2025

6. The terms and conditions of the above appointment Forest (EC-1), 9th May 2025.

Section 28 of the Water (Prevention and Control of Pollution) Act, 1974 and Section 31 of Air (Prevention and Control of Pollution) Act, 1981 provides that the State Government may constitute a State Appellate Authority consisting of one or three persons as it may think fit, to be appointed to help in the adjudication of disputes relating to Environment and Pollution.

2. In pursuance of the orders of the Supreme Court in its Judgement dated: 27.01.1999 in Civil Appeal No. 368-371 of 1999 of SLP (Civil) No. 10317-10320/98 and Civil Appeal Nos. 372, 373/99 in SLP (Civil) No. 10380 shall be applicable as per the terms and conditions issued in Government Order second read above.
